Vendor Stocking. (a) The Representatives of Companies that supply baked goods (breads and cakes), beer, wine, liquors, soft drinks and water chips/salty snacks and similar-type products, nuts and candies, non-food products and natural products, may move their product throughout the Store and place it on or remove it from the shelves. (b) The Representatives of Suppliers may set up seasonal displays or special displays on a non-weekly basis (e.g., Kraft festival).

Vendor Stocking. (a) The Representatives of Companies that provide direct delivery products, may move their product throughout the Store (including the backroom) and place it on or remove it from the shelves. (b) The Representatives of Suppliers may set up displays. (c) The use of representatives of companies to perform vendor stocking or set up displays shall not eliminate the positions of employees working under this agreement.
Vendor Stocking. Outside vendors including drivers/salesmen may stock the following items: 1) All general merchandise items including but not limited to pet food and supplies, books, magazines, cards, candies, photo supplies and all household goods. 2) All health, beauty and cosmetic products. 3) All Dairy products including but not limited to milk, cream, butter, cottage cheese. 4) All soda, water, and beer products. 5) All commercial bread including fresh bakery goods. 6) All cookies and crackers. 7) All spices. 8) All types of chips in both box and bag form. 9) All tobacco products. 10) All Kool-Aid products. 11) All gourmet specialty type foods. 12) All institutional sized packages of foods.
Vendor Stocking a) The following salespersons or vendor representatives shall engage in the handling and selling of merchandise in the retail stores of the Employer: 1. Primary Pop Vendors (currently Coca Cola and Pepsico) 2. Primary Chip Vendors (currently Old Dutch and Frito Lay) 3. Primary Bakery Vendors (currently Canada Bread and Portofino) These salespersons or vendor representatives shall be permitted to perform work in each store to a combined maximum of one and one-half percent (1.5%) of each store’s total weekly bargaining unit hours. Vendors shall be required to sign in and out and that shall be accessible upon the Union’s request. Any concerns regarding salespersons or vendor representatives exceeding these hours shall be addressed by discussion between the Employer and the Union upon request of either party. Full time employees employed at ratification will not have their hours of work reduced as a result of the implementation of the above language. 1. First violation - a written warning from the Union will be given to the Employer. 2. Second violation within the twelve (12) month period following written notice as per Point (1) - a two hundred dollar ($200.00) fine. 3. Third and subsequent violations within the twelve (12) month period - a three hundred dollar ($300.00) fine for each violation. Where no violation occurs for a period of twelve (12) months following a written warning or from the date of the last fine, the Employer shall be entitled to another written warning from the Union. Where the Employer has been fined, such fine is to be dispatched to the “UFCW 1518 Member Emergency Fund”.

  • End Users Customer will control access to and use of the Products by End Users and is responsible for any use of the Products that does not comply with this Agreement.

  • Third Party Vendors Nothing herein shall impose any duty upon DST in connection with or make DST liable for the actions or omissions to act of the following types of unaffiliated third parties: (a) courier and mail services including but not limited to Airborne Services, Federal Express, UPS and the U.S. Mails, (b) telecommunications companies including but not limited to AT&T, Sprint, MCI and other delivery, telecommunications and other such companies not under the party’s reasonable control, and (c) third parties not under the party’s reasonable control or subcontract relationship providing services to the financial industry generally, such as, by way of example and not limitation, the National Securities Clearing Corporation (processing and settlement services), Fund custodian banks (custody and fund accounting services) and administrators (blue sky and Fund administration services), and national database providers such as Choice Point, Acxiom, TransUnion or Lexis/Nexis and any replacements thereof or similar entities, provided, if DST selected such company, DST shall have exercised due care in selecting the same. Such third party vendors shall not be deemed, and are not, subcontractors for purposes of this Agreement.
