Wage Rates, etc. With respect to those individuals who are employees of the Company immediately prior to the Closing Date (the “Company Employees”), Buyer shall cause the Company, to the extent permitted by applicable Law and the respective Company Plans, to (i) employ such Company Employees on those terms and conditions, including the Buyer’s severance policy, that are afforded to similarly situated employees of the Buyer and its Affiliates (other than the Company Employees) and (ii) credit all Company Employees with service with the Company, to the extent credited under the corresponding or comparable Company Plans, as service with Buyer for (i) calculating severance benefits under Buyer’s severance policy then in effect, and (ii) eligibility and vesting purposes (but not for benefit accrual purposes) under the employee benefit plans of Buyer and its Affiliates (each a “Buyer Group Plan”), solely to the extent permitted under Buyer Group Plans and to the extent that Buyer makes such Buyer Group Plans available to the Continuing Employees.; provided, that nothing in this Agreement shall (i) obligate the Company to continue the employment of any Company Employee following the Closing, (ii) limit the ability of Buyer or its Affiliates from revising, amending or terminating from time to time any Company Plan, any Buyer Group Plan or other employee benefit plan, program or policy in accordance with the terms thereof, or (iii) be construed as an amendment of any Company Plan or Buyer Group Plan.

Wage Rates, etc. (a) The wage rates contained herein shall be effective and retroactive as of February 1st, 2005, and shall continue in effect for the life of this Agreement until such time as a new Agreement is negotiated. Retroactive pay shall be for all hours worked subsequent to January 31st, 2005, by all persons, and shall be paid within thirty (30) days of the signing of this Agreement. (b) All employees covered by this Agreement shall be paid for all time spent in the service of the Employer. Rates of pay provided for by this Agreement shall be minimums. Time shall be computed from the time the employee commences his day's work until he is released from duty by the Employer. (c) If a second shift is employed, the hours of work shall be seven and one-half (7½) hours per shift for which eight (8) hours will be paid. Shift hours shall be 4:30 P.M. to 12:30 A.M., with a designated thirty (30) minute lunch period. (d) If a third shift is employed, the hours of work shall be seven (7) hours per shift for which eight (8) hours shall be paid. Shift hours shall be 12:30 A.M. to 8:00 A.M., with a designated thirty (30) minute lunch period. (e) Employees shall not be required to change shifts in the event they do not have ten (10) consecutive hours free from duty, and shifts shall be rotated every two (2) weeks. (f) When an employee is temporarily removed from his regular work and put on other work for the Employer's convenience, he shall, where the job pays less, receive his regular rate of pay, and where the job pays more, the higher rate of pay. (g) When an employee meets with an accident at work and is unable to work on the advice of a qualified First-Aid Attendant or physician, he or she shall be paid a full day's wages for the day of the accident.   • Wage Rates Contractor shall post a copy of the wage rates at the job site and shall pay the adopted prevailing wage rates as a minimum. Pursuant to the provisions of Section 1773 of the Labor Code of the State of California, the Board of Supervisors has obtained the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work in this locality for each craft, classification, or type of xxxxxxx needed to execute this Contract from the Director of the Department of Industrial Relations. These rates are on file with the Clerk of the Board of Supervisors. Copies may be obtained at cost at the office of County's OC Public Works/OC Facilities & Asset Management/A&E Project Management or visit the website of the Department of Industrial Relations, Prevailing Wage Unit at xxx.xxx.xx.xxx/XXXX/XXX. The Contractor shall comply with the provisions of Sections 1774, 1775, 1776 and 1813 of the Labor Code.

  • Wage Rate The hourly rates for full-time junior and adult apprentices as set out in this agreement shall apply to school based apprentices except that the school based apprentice for pay purposes will be paid a further 25% of hours to the actual hours worked for off the job training.
