WARRANTY/QUALITY. Unless a longer warranty is called for elsewhere in the Contract, Contractor, manufacturer, or their assigned agents shall guarantee the workmanship, product or Services performed against defective workmanship, defects or failures of materials for a minimum period of one (1) year from District’s written approval of the Work. All workmanship and merchandise must be warranted to be in compliance with applicable California energy, conservation, environmental, and educational standards.
WARRANTY/QUALITY a. In addition to any other warranties provided at law, express or implied, and without limiting any other warranties that may appear in this AGREEMENT, Seller expressly warrants that all Products shall be manufactured, provided and transported in full and complete conformity and in compliance with all the requirements of this AGREEMENT, specifications, drawings, designs, samples and other descriptions or requirements as Buyer may furnish or specify. Seller expressly warrants all Products furnished by it or any of its subcontractors or suppliers at any tier shall be (i) merchantable; (ii) fit and sufficient for the purposes intended; and (iii) free from all deficiencies in materials, workmanship and design, whether or not the Seller has supplied the design for the Products (including services) sold hereunder. The warranty period shall commence upon Buyer’s acceptance, use or operation of the Products, whichever is later, and continue for a period of (1) year thereafter.
b. All warranties of Seller or Seller's subcontractors or suppliers at any tier shall flow to Buyer and Xxxxx's customer(s). Should Seller or Seller’s subcontractor’s or supplier’s warranty run for a longer period, Seller shall extend such longer warranty period to Buyer.
c. This warranty shall survive inspection, test, acceptance, and payment.
d. Buyer may, at its option: (i) return for full refund or credit; (ii) require prompt correction or replacement of defective or nonconforming Products; or (iii) replace the non-conforming Products with similar Products from another source and charge the costs occasioned to the Buyer thereby to the Seller. Correction or replacement shall be made at Seller’s expense and no correction or replacements of defective or nonconforming products shall be made unless approved by Buyer. Products required to be corrected or replaced shall be subject to this warranty and a new warranty period and to Article 6, Delivery and Title, above, to the same extent as products originally delivered under this AGREEMENT.
e. Seller warrants all Products sold hereunder shall be free of any claim of any nature by any third person or entity, and that Seller shall convey clear and marketable title to Buyer. Seller shall furnish, upon Xxxxx's request, waivers by Seller and all other persons entitled to assert any lien rights in connection with the performance of this AGREEMENT.

25.1. Contractor shall provide the following warranties, at a minimum:
25.1.1. Any warranty required to qualify the PV System for NEM 2.0 25.1.2. 5-year complete PV System warranty 25.1.3. 25-year PV panel warranty 25.1.4. 10-year inverter warranty 25.1.5. 10-year roof and building penetration warranty
25.2. Contractor shall provide a copy of the installation and product warranties prior to installation. Upon completion of the Project, Contractor shall transfer and convey to the District, all warranty documentation and shall assist the District in completing any warranty or submittal forms which are required in order to effectuate coverage of the warranties required herein and all my otherwise be available to the District.
WARRANTY/QUALITY. The District reserves the right to refuse complete shipments if there is any evidence of damaged or thawed products. Evidence of thawing include and not limited to cases that are not firm, soft or spongy to the touch, water stained, crushed and cases that stick together as a result of freezing. Damaged containers will not be accepted. Credit will be required on damaged or unacceptable Products. A legible delivery discrepancy receipt shall be left at the site in the case of a return or shortage. Credit shall be issued in a timely manner.
13.1. All Products received under this Agreement shall be processed according to the health and sanitation standards for plant facilities and food processing established by the locality or state in which Vendor’s plant is located or by the applicable federal standards, whichever is higher.
13.2. Vendor shall provide products from manufacturers with a Hazard Analysis Critical Control Point (HACCP) system in place. Additionally, Vendor shall ensure that all products received under this contract shall be prepared, handled and are stored in accordance with the health and sanitation standards for the County of Los Angeles or local city/county agency in which product was produced, State of California, and/or Federal Government, whichever is higher.
13.3. Vendor shall follow appropriate procedures for First in First out (FIFO) stock rotation system. Products received shall not have a shelf life or expiration date less than eight (8) weeks from the date of delivery, without prior consent of the District(s).
13.4. In the event of a product contamination issue, Vendor shall provide trace back capabilities for all products to the point of origin.
13.5. Vendor agrees to permit inspection of the delivered items by a representative of the District’s Food Services Department with the right of rejection of inferior merchandise. The District’s decision shall be final, and credits must be provided upon request.

18.1. PV modules used in this project shall have a 25-year product warranty from the date of sale.
18.2. Power Conditioning Equipment, including inverter(s), shall have a 5-year minimum product warranty from the date of sale.
18.3. Design-Builder shall be responsible for providing no-cost repair and component replacement not covered by the manufacturers of the components of the Systems for a period of 10 years after the Final Completion Date on all equipment, systems and controls necessary to endure PV production at the performance level set forth in the Performance Guarantee. This provision does not reduce any of Design- Builder’s obligations to the District required by the Maintenance Service Agreement or the Performance Guarantee.
