WARRANTY/QUALITY. Unless a longer warranty is called for elsewhere in the Contract, Contractor, manufacturer, or their assigned agents shall guarantee the workmanship, product or Services performed against defective workmanship, defects or failures of materials for a minimum period of one (1) year from District’s written approval of the Work. All workmanship and merchandise must be warranted to be in compliance with applicable California energy, conservation, environmental, and educational standards.
WARRANTY/QUALITY a. In addition to any other warranties provided at law, express or implied, and without limiting any other warranties that may appear in this AGREEMENT, Seller expressly warrants that all Products shall be manufactured, provided and transported in full and complete conformity and in compliance with all the requirements of this AGREEMENT, specifications, drawings, designs, samples and other descriptions or requirements as Buyer may furnish or specify. Seller expressly warrants all Products furnished by it or any of its subcontractors or suppliers at any tier shall be (i) merchantable; (ii) fit and sufficient for the purposes intended; and (iii) free from all deficiencies in materials, workmanship and design, whether or not the Seller has supplied the design for the Products (including services) sold hereunder. The warranty period shall commence upon Buyer’s acceptance, use or operation of the Products, whichever is later, and continue for a period of (1) year thereafter.

The CONTRACTOR, manufacturer, or their assigned agents shall guarantee the workmanship, product or service performed against defects or failures of materials for a minimum period of one (1) year from delivery or the final completion date for the work. All workmanship and merchandise must be warranted to be in compliance with applicable California energy, conservation, environmental, and educational standards.

All workmanship and merchandise must be warranted to be in compliance with applicable California energy, conservation, environmental, and educational standards.

Unless a longer warranty is included with the installed equipment, the Vendor, manufacturer, or their assigned agents shall guarantee the workmanship, product or service performed against defective workmanship, defects or failures of materials for a minimum period of one (1) year from completion. All workmanship and merchandise must be warranted to be in compliance with applicable California energy, conservation, environmental, and educational standards.
WARRANTY/QUALITY. The District reserves the right to refuse complete shipments if there is any evidence of damaged or thawed products. Evidence of thawing include and not limited to cases that are not firm, soft or spongy to the touch, water stained, crushed and cases that stick together as a result of freezing. Damaged containers will not be accepted. Credit will be required on damaged or unacceptable Products. A legible delivery discrepancy receipt shall be left at the site in the case of a return or shortage. Credit shall be issued in a timely manner.

Seller further expressly warrants that all Services shall be performed (i) with due diligence and in full compliance with the highest professional standards of practice in the industry and in accordance with the specifications and requirements of this AGREEMENT, and (ii) by personnel who are adequately skilled, experienced, licensed (if applicable) and supervised, to perform the Services. The warranty period shall commence upon Buyer’s acceptance, use or operation of the Products, whichever is later, and continue for a period of one (1) year thereafter; provided, however, if any warranty clause is incorporated by reference as a U.S. Government flow down requirement into this AGREEMENT, such warranty provisions are in addition to the provisions in this clause to the extent to which they are consistent. To the extent the provisions of the U.S. Government flow down requirement are inconsistent with this clause, the provisions of any warranty incorporated as a U.S. Government flow down requirement shall prevail.

Should Seller or Seller’s subcontractor’s or supplier’s warranty provide for a longer period, Seller shall extend such longer warranty period to Buyer. This warranty shall survive inspection, test, acceptance, and payment. Buyer may, at its option, either return for full refund or credit, or require prompt correction or replacement of defective or nonconforming Products. Replacement Products shall be made at Seller’s expense and no replacements of defective or nonconforming Products shall be made unless specified by Buyer. Transportation costs for returning nonconforming Products to Seller and the transportation costs for replacement Products shall be borne by Seller. Products required to be corrected or replaced shall be subject to a new full warranty period as described in Article 6 above to the same extent as Products originally delivered under this Agreement.

WARRANTY/QUALITY. Except for any longer warranty called for elsewhere in the Contract and except for the specific warranties that are made part of the Contract as Exhibit F, attached hereto and incorporated by this reference, Designer/Builder, manufacturer, or assigned agents shall guarantee the Work or Services performed against defective workmanship, defects or failures of materials for a minimum period of one (1) year from date of Completion of the Work or when District accepts Beneficial Use, whichever comes first. If the District accepts Beneficial Use, Designer/Builder shall prepare a list of exceptions for specific items or components for which the period of warranty shall not commence (“Exception List”). District shall approve the Exception List. The period of warranty for any item on the Exception List shall commence upon District’s acceptance of that item’s Beneficial Use or completion of that item, whichever comes first. All workmanship and merchandise must be warranted to be in compliance with applicable California energy, conservation, environmental, and educational standards. This warranty shall not apply to (a) equipment that has been repaired or altered by other than Designer/Builder so as to affect the same adversely, or (b) equipment that has been subject to negligence, accident or damage by circumstances beyond Designer/Builder's control, or improper operation, maintenance or storage, or other than normal use and service. The Parties agree that any implied warranties of merchantability or fitness for a particular purpose shall survive the warranties in this section.
