FUNCTION OF MANAGEMENT. Section 1. Except as limited by this Agreement, the Employer shall have the right to: plan, direct, and control all its work; hire employees; direct the working forces in the field; assign employees to their jobs; direct and assign work to employees; determine the number of employees to be employed; discipline for just cause (just cause for discharge includes but is not necessarily limited to incompetence, insubordination, habitual tardiness or absenteeism, safety violations, and participation in unauthorized work stoppage or slowdown); transfer employees; lay off employees because of lack of work or for other legitimate reasons; require employees to observe the Employer's and/or contracting entities' rules and regulations that do not conflict with this Agreement; regulate the amount of equipment used and the use of equipment and other property of the Employer; require the observance of applicable government regulations and safety standards; maintain reasonable standards of production and quality of work; and decide upon methods, equipment, and procedures to be used in the performance of all work covered by this Agreement; provided, however, that the Employer will not use its rights for the purpose of discrimination against any employee. Section 2. The Employer and the IUPAT recognize the necessity of promoting efficiency and agree that no Local rules, customs, or practices shall be permitted that limit production or manpower required to do the work, and that no limitations shall be placed on the amount of work that an employee is performing during the work day. No regulations of tools shall be interpreted or enforced in any way to prevent their use provided that all safety regulations are satisfied.

FUNCTION OF MANAGEMENT. Section 1. In the exercise of its functions of management, the Employer shall have the right to plan, direct and control operations of all its work, hire employees, direct the working forces in the field, assign employees to their jobs, discharge, suspend or discipline for proper cause (proper cause for discharge includes but is not necessarily limited to incompetence, insubordination, habitual tardiness or absenteeism) transfer, promote, demote, or lay off employees because of the lack of work, or for other legitimate reasons, require employees to observe the Employer’s and/or contracting entities, rules and regulations not inconsistent with this Addendum, institute a fair and consistent drug policy, regulate the amount of equipment used and the use of equipment and other property of the Employer, decide the number of employees needed; provided, however, that the Employer will not use its rights for the purpose of discrimination against any employee. Section 2. On work as defined under Article I, the Employer and the IUPAT recognize the necessity of promoting efficiency and agree that no Local rules, customs or practices shall be permitted that limit production or manpower required to do the work and that no limitations shall be placed on the amount of work which an employee is performing during the work day. FUNCTION OF MANAGEMENT. 3.1 The Union recognizes the right of the Company to hire, promote and demote, transfer, suspend or otherwise discipline and discharge any employees, subject to the right of the employee concerned to lodge a grievance in the manner and to the extent herein provided. 3.2 The Union further recognizes the right of the Company to operate and manage its business in all respects in accordance with its commitments and responsibilities. In addition, the location of the plants, the products to be manufactured, the schedules of production and hours of work, the methods, processes, the means of manufacturing and operating are solely the responsibility of the Company. The Company also has the right to make and alter from time to time rules and regulations to be observed by the employees, which rules and regulations shall not be inconsistent with the provisions of this Agreement. It is agreed that the enumeration of the above functions shall not exclude customary management functions not herein enumerated. 3.3 The Company agrees that these functions are subject to the terms of this Agreement and will be exercised in a manner consistent with the provisions of this Agreement.
FUNCTION OF MANAGEMENT. Section 1. The Union agrees that the function of Management rests solely with the Company, and further agrees that it will not interfere with the Company's free exercise of this right except where the Company specifically is limited in the Articles or Sections of this Contract. Section 2. Foremen, Assistant Foremen, Supervisors, Coaches, Lead persons, Group Leaders, and Team leaders in all departments shall be selected by the Employer.
FUNCTION OF MANAGEMENT. The Employer shall have the right to determine the extent of his operations at all job sites including but not limited to the selection of the kind of materials, supplies or equipment used in the execution of the work, the right to plan, direct, and control job site operations; to screen applicants, to hire, promote, lay-off, discipline or discharge for proper cause; to maintain efficient work standards and to introduce new, improved or different methods on facilities for any purpose including more efficient and economical operations.
FUNCTION OF MANAGEMENT. 13.01 The Union acknowledges that it is the exclusive function of the Company to manage the plant and direct the working force, in particular: (a) To maintain order, discipline and efficiency. (b) To hire, lay off, classify, transfer, promote, and demote, and to discharge or otherwise discipline for just cause; all these to be subject to the provisions of this Agreement. (c) To make appointments to supervisory positions outside the scope of the bargaining unit. (d) To manage the industrial enterprises in which the Company is engaged, determining the products to be manufactured, the methods of manufacturing, the schedules of production, the kinds and location of machines and equipment to be used, the processes of manufacturing and the nature and quality of its products.

FUNCTION OF MANAGEMENT. 70 6.01 It is agreed that the Company has the right to direct generally the work of the employees subject to the terms and conditions of this Agreement, including the right to hire employees, to promote and transfer employees for proper cause, to discipline for just cause (i.e. counseling session, written reprimand, suspension, or discharge), to assign them to shifts with due regard to seniority, to determine the amount of work needed, and to lay them off because of lack of work in accordance with the provisions herein. However, none of the foregoing shall be done for the purpose of unfair discrimination. 71 6.02 To enable the Company to keep its products abreast of scientific and technical advances, it is agreed that the Company from time to time, and without reference to the rules of seniority set out in this contract, hire, transfer, teach, and assign duties to a small number of technical individuals or others to be mutually agreed upon between the Company and the Union. 72 6.03 The Company has the right to maintain discipline of employees including the right to make reasonable rules and regulations for the purpose of efficiency, safe practices and discipline. The Company will inform the Union of any changes in existing rules and regulations or the establishment of new rules and regulations before such changes are made effective. Any complaint as to the reasonableness of such rules or any grievance involving claims of discrimination against any employee in the application of such rules shall be subject to the grievance procedure of this Contract.
FUNCTION OF MANAGEMENT. The Company has the right to direct the work of the employees, maintain order, discipline and efficiency, hire, discharge or suspend employees or demote them for proper cause, assign them to shifts with due regard to ability, determine the amount of work needed and to lay them off because of lack of work in accordance with the provisions of the Agreement. However, no employee shall be discharged by the Company except for proper cause and none of the foregoing shall be used for the purpose of discrimination. Any grievance that may arise from such changes as stated above shall be settled through the grievance procedure.
FUNCTION OF MANAGEMENT. The management and control of the Employer’s operations and the direction of the working force shall remain the exclusive function of management, provided that such management and direction does not contravene the express provisions of this agreement.
