Access and Site Regulations. ‌ 7.1 The CP shall do all things as shall reasonably be necessary to enable provision of the Services and shall maintain competent and appropriately trained staff in sufficient numbers for this purpose. CP shall and shall ensure that End Users shall use all reasonable endeavours to ensure that KCOM or KCOM’s sub- contractors are granted access to the End User Site where necessary. 7.2 CP shall and shall ensure that End Users shall use reasonable endeavours to ensure KCOM’s staff or KCOM’s sub-contractor’s staff are provided with a suitable and safe environment. CP will indemnify KCOM against all loss, damages, costs and expenses arising or incurred in respect of any actions, claims or legal proceedings which are brought or threatened against KCOM where the CP is in breach of this Clause. The limitations and exclusions of liability contained in Clause 17 do not apply to this indemnity except in respect of liability relating to property damage to which Clause 17 shall apply.

Access and Site Regulations. 12.1 The Customer shall be deemed to have examined any Site or Facility and BT shall not be liable for any claim from the Customer in relation to its misinterpretation of any Site-related or Facility- related matter, or any other matter in respect of which the Customer could reasonably have satisfied itself by a visit, reference to BT or otherwise. BT will provide such information reasonably required by the Customer in relation to the Site or Facility that it is able to do at the time of the request but BT makes no warranty as to the existence of any easements, wayleaves, agreements, statutory entitlements, or other freedoms of access to Sites or Facilities. 12.2 The Physical Infrastructure remains the property of BT at all times. 12.3 The Customer shall obtain all necessary consents, permission or wayleaves including for example, consents for any necessary alterations to buildings, permission to cross other people’s land or permission to survey, install and maintain Customer Apparatus at the Site and Facility. This includes the Customer being responsible for obtaining all consents and permissions required from local authorities (or any other third party) which may be necessary for the Customer to survey, install and maintain Customer Apparatus at a Site and Facility.
Access and Site Regulations. 2.6.1 BT will provide the Customer and Approved Maintainers with access to the BT Data Centre subject to the production of valid identification and the provisions of paragraphs 2.3 and 5 of this Service Schedule. 2.6.2 The Customer and anyone acting on the Customer’s behalf (including Approved Maintainers) will observe the BT Data Centre regulations as set out in the Customer Handbook. 2.6.3 BT and the Customer will meet each others reasonable requirements for the safety of people on the Site.

The Customer agrees to indemnify CommsFM against all loss, damages, liabilities, costs and expenses arising or incurred in respect of any actions, claims or legal proceedings which are brought or threatened against CommsFM if the Customer is in breach of this sub-clause. The limitation of liability provisions of this Agreement do not apply to this indemnity. 16.4 It is the responsibility of the Customer to carry out any making good or decorator’s work required but CommsFM accepts responsibility for any property damage caused by CommsFM’s negligence, subject to the limitation of liability provisions of this Agreement.
Access and Site Regulations. 7.1 The Customer hereby authorises THREE and/or the Access Provider to install and connect any equipment necessary to provide the Fixed Services or the Mobile Services to the Customer. 7.2 Anyone acting on THREE's behalf will observe the Customer Premises regulations previously advised in writing to THREE. In the event of any conflict between the Customer Premises regulations and the Contract, the Contract will control and prevail. 7.3 THREE may need to access the Customer Premises from time to time (for example, for installation, repairs, maintenance or upgrades or to recover THREE Fixed Services Equipment when this Contract expires or is terminated) and Company agrees not to unreasonably withhold access permissions in this regard. 7.4 The Customer will provide a safe and suitable working environment for THREE personnel and/or anyone acting on THREE's behalf that has a requirement to visit any Customer Premises in furtherance of the subject matter of the Contract.

OUTSOURCE TELECOM agrees to observe the Client’s and the End User’s reasonable Site safety and security requirements. 12.3. The Client agrees to provide and agrees to take reasonable steps to ensure that the End User provides a suitable and safe working environment for OUTSOURCE TELECOM at the Client’s Site and/or the End User’s Site. The Client agrees to indemnify OUTSOURCE TELECOM against all loss, damages, liabilities, costs and expenses arising or incurred in respect of any actions, claims or legal proceedings which are brought or threatened against OUTSOURCE TELECOM if the Client is in breach of this sub-clause. The Customer hereby authorises BT to contact the owner of the Site, if necessary, in order to obtain the owner’s consent to install and connect any equipment necessary to provide telecommunications services to the Customer. The Customer hereby indemnifies and agrees to keep BT indemnified against all costs, damages, losses, proceedings, claims and other liabilities incurred by BT howsoever arising from any such contact whether or not consent is actually granted. 7.2. The Customer will, where necessary, and at all reasonable times, permit access to any Site to BT and anyone acting on BT’s behalf, on production of a valid identity card, to enable BT to carry out its obligations under this Agreement. BT will normally only require such access during the Customer’s usual working hours, however, BT may, on reasonable notice, require the Customer to provide it with access at other times. 7.3. Employees of BT and anyone acting on BT’s behalf will observe reasonable Site regulations of the Customer, copies of which have been previously advised in writing to BT. In the event of any conflict between the Site regulations and these Conditions, these Conditions shall prevail. 7.4. The Customer will provide a suitable and safe working environment for BT employees and anyone acting on BT’s behalf.
Access and Site Regulations. 6.1 The Customer will, upon reasonable notification from BT, allow BT Employees access to the Customers premises or to the Site as may be reasonably necessary for the performance by BT under this Contract, including recovery or removal of any BT Owned Equipment. BT will use reasonable care in removal of BT Owned Equipment and leave the premises or Site in its original condition. 6.2 BT Employees will observe the Customer's reasonable Site regulations previously advised in writing to BT. In the event of any conflict between the Site regulations and this Contract, this Contract will prevail. 6.3 For the purposes of installing the Service, BT will normally only require access during its usual working hours but may, on reasonable notice, require the Customer to provide access at other times. If the Customer asks XX to work outside its usual working hours and BT agrees to do it, the Customer must pay BT’s additional charges for doing so. For the purposes of carrying out repair work, BT will require access during the hours of cover applicable to the level of CPE Maintenance provided under this Contract. 6.4 The Customer will provide a suitable and safe working environment for BT Employees. 6.5 At a reasonable time agreed with BT and to enable BT to carry out its obligations under this Contract, the Customer will use its reasonable endeavours to procure that an End User will provide BT employees and anyone acting on BT's behalf who produces a valid identity card, with access to any Site.
