Acting in a Higher Position. (a) Subject to the provisions of sub-clauses (b) and (c) of this clause, a tenured lecturer who relieves for another lecturer holding a position to which a higher salary is payable, shall be paid for the period which the lecturer is so relieving at a rate agreed between the employer and the lecturer. (b) The lecturer must perform the extra duties and undertake the responsibilities of the higher position for a period of at least ten consecutive days. Where more than one person fulfils the higher duties, the allowance is pro-rated for the duration of that period. (c) Leave periods including special leave shall not be counted as part of or deemed to interrupt the qualifying period specified in sub-clause (b) of this clause if the lecturer continues in the higher position immediately after the period of leave. (d) A lecturer who does not resume in the higher position immediately after the leave and who is being paid additional salary in a relieving position on the day preceding the leave is to be paid the additional salary during the leave for a period equal to one-fourth of the period of employment in the higher position or until the end of the leave period, whichever is the shorter period.

Acting in a Higher Position. When an absence occurs in the positions of Sergeant, Lieutenant, Captain, Deputy Chief or Assistant Chief, and said absence continues from day to day for a period in excess of seven (7) calendar days, the Chief shall assign an Officer to act in the capacity of the absent position. If it is determined that an absence will continue in excess of seven (7) calendar days, and said position is determined by the Chief to be of critical importance, he may, at his sole discretion, fill said absence by appointing from the first day of absence. If another Officer of the equivalent or higher rank is in a position to assume the responsibilities of the absent Officer’s position, then the Chief is not required to assign an officer to such position. During service in the acting capacity, the Officer so assigned shall be compensated at the base salary of the higher position, plus his or her own longevity or seniority pay beginning on the rate of such acting assignment by the Chief. Excepted from this provision is any absence created by operation of Article 3 of this agreement. If a vacancy is not filled within thirty (30) calendar days in the rank of Sergeant, Lieutenant, Captain, Deputy Chief or Assistant Chief, and the position is not eliminated, then the Chief shall appoint temporarily from the next lower rank some Officer to fill that position until a permanent officer is assigned to fill said vacancy.

  • Not Acting in Individual Capacity Except as provided in this Article VI, in accepting the trusts hereby created Wilmington Trust Company acts solely as Owner Trustee hereunder and not in its individual capacity, and all Persons having any claim against the Owner Trustee by reason of the transactions contemplated by this Trust Agreement or any Basic Document shall look only to the Owner Trust Estate for payment or satisfaction thereof.

The SUBRECIPIENT must utilize CDBG-DR funds, as prescribed under 24 CFR 570 Subpart C – Eligible Activities, and for alternative requirements and waivers as prescribed within the Federal Register Guidance. Furthermore, the SUBRECIPIENT shall conduct its project to align with the approved eligible activity(ies) found under the most-recent approved Action Plan for the COUNTY’S CDBG-DR Recovery and Resiliency Planning Program.

  • Project Personnel It is understood and agreed that the Project Director identified at Item 3, Page One of this Agreement shall be responsible for the overall supervision and conduct of the Work on behalf of the Contractor and that the persons described in the Statement of Work shall serve in the capacities described therein. Any change of Project Director by the Contractor shall be subject to the prior written approval of NYSERDA. Such approval shall not be unreasonably withheld, and, in the event that notice of approval or disapproval is not received by the Contractor within thirty (30) days after receipt of request for approval by NYSERDA, the requested change in Project Director shall be considered approved. In the event that NYSERDA requires additional time for considering approval, NYSERDA shall notify the Contractor within thirty (30) days of receipt of the request for approval that additional time is required and shall specify the additional amount of time necessary up to thirty (30) days.
