After Hours HVAC. During the Lease Term, Landlord shall install and maintain HVAC control systems or reasonable replacements of such systems to permit occupants to automatically (without action by any engineer or other person other than Tenant’s designated representatives) to schedule and activate after hours HVAC operation via telephone .
After Hours HVAC. Notwithstanding the foregoing, Landlord ---------------- agrees to make available, subject to interruption for repairs and restorations, after-hours HVAC service to the Premises (at the prevailing rates for the Building, from time to time subject to the provisions below) during the Term of this Lease. Tenant acknowledges that Landlord currently charges a fee per hour for after-hours heat or air-conditioning (the "Hourly Charge") of two hundred Forty-Three and no/100 dollars ($243.00) per hour and that such service is provided for a minimum of two (2) hours. Tenant further acknowledges that such Hourly Charge shall be applicable to any after-hours heat or air-conditioning which Tenant requests and obtains from each Building's heating and air- conditioning system. The Hourly Charge shall not be increased by Landlord except in the event that Landlord's Actual Cost to provide such after-hours HVAC increases above the greater of such amount or Landlord's Actual Cost to provide the same as of the date hereof (whichever is greater), in which event Landlord may increase the Hourly Charge by such actual incremental increase in such Actual Cost. In the event Tenant and/or other tenants request from Landlord use of after-hours HVAC serving the same zone for the same time period, the Tenant's charge hereunder shall be reduced to be its pro-rata share (based upon rentable square feet) of the HVAC service provided to such zone. During the initial Term of this Lease only and not part of a renewal period, the first two hundred forty (240) hours of after-hours HVAC service requested by Tenant and provided by Landlord during any calendar year shall be at no charge.
After Hours HVAC. Tenant shall have the ability to activate the HVAC system for service to the Premises twenty-four (24) hours per day, seven (7) days per week, 365 days per year (except for emergencies and for periodic repairs) which includes, without limitation, during all hours for which Landlord is not obligated to supply such HVAC utilities pursuant to the terms of Section 6.1 (“After-Hours HVAC”). All After-Hours HVAC service shall be provided to Tenant by Landlord, at Tenant’s expense, at the prevailing rate charged at the Building therefor from time to time (which is currently $85.00 per floor per hour); provided that if Tenant is separately charged for After-Hours HVAC in no event shall any charges related to providing After-Hours HVAC be included in Operating Expenses. Amounts payable by Tenant to Landlord for such use of After-Hours HVAC services shall be deemed Additional Rent hereunder and shall be billed on a monthly basis. Notwithstanding anything to the contrary contained herein, Tenant shall not be obligated to pay for a total of 1,720 hours of After Hours HVAC provided to the Premises initially leased hereunder during the initial Lease Term (the “Free HVAC”). The Free HVAC may be allocated to the initial Premises as desired by Tenant over the course of the initial Lease Term, until exhausted.
After Hours HVAC. Landlord and Tenant agree that the After Hours HVAC rate set forth in Section 1(j) of the Lease for calculation of the additional HVAC usage by Tenant for the Premises shall be $25.00 per hour, per floor, with a minimum of two (2) hours per occurrence, provided such usage is based on Tenant operating said HVAC in the Premises on a continuous (24 hour per day) basis. If Tenant does not operate in such manner, the original After Hours/HVAC rate of $35.00 per hour shall apply.
After Hours HVAC. No additional charge will be levied by Landlord for occasional after hour use of HVAC. Tenant will use bypass switches presently installed. In the event additional HVAC is required for an individual area within the Premises, a separate HVAC unit with check meter will be installed to record usage, at the sole expense of Tenant. Tenant will reimburse Landlord at the rate charged by the utility company for this usage.
After Hours HVAC. After hours HVAC is available through contacting the onsite management office. The current charge for this service is $81.00 per hour with a 2-hour minimum. Landlord reserves the right to adjust the charge for this service.
After Hours HVAC. If Tenant requires air-conditioning or heating for hours or days in addition to the hours and days specified in Paragraph 5 of this Lease, Landlord shall make reasonable efforts to provide such additional service after reasonable, prior written request therefor from Tenant, and Tenant shall reimburse Landlord for the cost of such additional service, at the hourly rates established from time to time by Landlord for such services. Such hourly rates shall be based upon Landlord's cost of providing such services, and shall include a component for Landlord's overhead, depreciation, maintenance and labor costs in providing such services. If any of Landlord's other tenants served by the equipment providing such additional service to the Premises request that Landlord simultaneously provide such service to such other tenants, the cost of Landlord providing such additional and concurrent service shall be prorated among all of Landlord's tenants requesting such service, on a reasonable basis, as determined by Landlord. As of the date of this Lease, Landlord's hourly charge for providing after-hours heating or air-conditioning service is $35.00 per hour (or part thereof), per air-handling unit, but such rate is subject to change from time to time based upon Landlord's actual costs (which may include the components set forth above) in providing such after-hours service.
After Hours HVAC. Landlord shall provide heat and air-conditioning at times in addition to those specified in paragraph (5) of subsection (a) at Tenant’s expense, provided Tenant gives Landlord notice prior to 10:00 a.m. on Fridays or the day preceding a holiday (in the case of after-hours service on Saturdays, Sundays, or holidays). Landlord shall initially charge Tenant for after-hours service at the rate of $45.00 per hour (or, if the Leased Premises include more than one HVAC zone on the same floor and such after hours service is provided for portions of the Leased Premises containing more than one HVAC zone, at the rate of $45.00 per hour per HVAC zone). Landlord reserves the right from time to time, in its sole discretion, to increase the hourly charge for said after-hours service, but in no event will the rate per hour charged to Tenant be more than an amount per hour which represents Landlord’s reasonable estimate of its actual cost of providing such after hours service, including labor, cost of electricity and wear and tear on equipment, plus an allowance of ten percent (10%) thereof to cover general overhead as an Additional Charge hereunder. Tenant shall be permitted to include in the Tenant Improvements a Tenant controlled after hours HVAC system provided it adequately provides Landlord a means of accounting for the after hours use by Tenant, as determined by Landlord and in such event any future increases in the charge for after hour use of that portion of the HVAC system that is under the Tenant’s control shall not include a markup to cover general overhead.
After Hours HVAC. Tenant shall pay the cost of supplying the Premises with heat, ventilation and air conditioning services at times outside of Business Hours, at such rates as Landlord shall specify from time to time, to cover all of the estimated costs and expenses incurred by Landlord in connection with supplying the Premises with such services, including, without limitation, the costs of labor and utilities associated with such services and including applicable sales or use taxes thereon, such amounts to be paid by Tenant within ten (10) days after submission by Landlord of a statement to Tenant setting forth the amount due. The current charge for after-hours HVAC services, which is subject to change at any time, is $45.00 per hour. Tenant shall notify Landlord of any heat, ventilation and air conditioning required by Tenant outside of Business Hours by complying with the Building’s after-hours log-in procedures, in accordance with instructions provided by Landlord. “Business Hours” shall mean Monday through Friday from 8:00 a.m. to 6:00 p.m. and on Saturday from 8:00 a.m. to 1:00 p.m., Holidays (defined below) excepted. New Year’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas, or any day set aside to celebrate such holidays are “Holidays” under this Lease.
