ASSIGNMENT OF RUNS. Notwithstanding that, under the Mortgages, Borrower or a Guarantor, as applicable, has assigned to Administrative Agent for the ratable benefit of the Banks all of the proceeds of runs accruing to the Mortgaged Properties covered thereby:
(a) Until such time as Administrative Agent shall notify Borrower or Guarantor, as applicable, to the contrary, Borrower or Guarantor, as applicable, shall be entitled to receive from the purchasers or disbursers of production all such proceeds of runs, subject however to the liens created under the Mortgages, which liens are hereby affirmed and ratified. Upon the occurrence and during the continuance of a Default or such other time as Administrative Agent shall in its discretion so elect, Administrative Agent may deliver to the addressees the letters-in-lieu described in Section 4.04 above and may exercise all rights and remedies granted under the Mortgages, including the right to obtain possession of all proceeds of runs then held by Borrower or Guarantor, as applicable, or to receive directly from the purchaser or disburser of production all other proceeds of runs.
(b) In no case shall any failure, whether purposed or inadvertent, by Administrative Agent to collect directly any such proceeds of runs constitute in any way a waiver, remission or release of any of its rights under the Mortgages, nor shall any release of any other proceeds of runs or of any rights of Administrative Agent to collect other proceeds of runs thereafter.
(c) Borrower or Guarantor, as applicable, will upon the instruction of Administrative Agent join with Administrative Agent in notifying in writing and accompanied (if necessary) by certified copies of the Mortgages the purchasers or disbursers of production produced from the Mortgaged Properties of the existence of the Mortgages, and instructing that all proceeds of runs be paid directly to Administrative Agent for the ratable benefit of the Banks.
ASSIGNMENT OF RUNS. Section 1. Regular run assignments and days off shall be picked separately at the same time and according to seniority. Regular run assignments shall be posted fifteen (15) days before the effective date, and run selections must be completed six (6) days before going into effect. Assignment dates will be on or about January 1, University Spring Semester closing, Lincoln Public Schools Spring Semester closing, University Fall Semester opening, or as often as deemed necessary by the City. In the event of a major routing change of more than thirty (30) days duration by the City, a general run assignment will be posted for bidding as provided herein if requested by the Transit Union, provided, however, that such general assignment will not take place less than thirty (30) days prior to the compulsory assignment dates.
Section 2. Operators may call in or leave choice slips indicating their desired selection of work. The choice slips shall be given to the dispatcher. Operators doing so should leave a sufficient number of choices to insure they obtain their selection.
Section 3. Any operator giving up his regular run assignment to go to the extra board may have one option to bid off the board until the next sign up, otherwise he shall work the extra board until such time.
Section 4. A. Bus operators prevented from exercising their seniority in a general assignment of regularly scheduled runs due to their being on vacation or on leave of absence will be permitted to exercise their seniority upon return and select runs and their day off in accordance with their general seniority, and displace any junior bus operator on any other regular run assignment, and so on down the line.

A. The bumping provisions of Sections 4.B and 4.C apply where an employee is on a leave of absence. Where the employee is on vacation, voluntary layoff, or otherwise delays his/her selection of a run assignment, the bumping provisions of Sections 4.B and 4.C only apply where the regular run assignments are posted less than twenty-eight (28) days before the effective date.
B. ASSIGNMENT OF RUNS. All regular school runs shall be assigned at the beginning of the school year according to seniority based upon hours of the runs and size of vehicle. Prior to the closing of the school year, drivers will indicate to the Director of Transportation the size of vehicle they prefer by first, second, and third choice, and their preference for assignment on the basis of hours rather than vehicle. If a driver receives an assignment not satisfactory to him/her, he/she may then appeal to the Director of Transportation. It will be the judgment of the Director of Transportation as to whether a driver has the necessary skill and ability to handle a particular route and to handle the children who will be riding on that route. Regular school runs will be made known to drivers prior to the start of school. The assignment of runs will be made by the Director of Transportation. Xxxxxx notices for drivers will be mailed prior to the drivers’ annual meeting and must be returned within fourteen (14) days from the date of postmark in order for the driver to continue his/her continuous employment. If, during the first semester of the school year, an individual run is assigned an additional 30 minutes or more per run, the run will be posted as a new run.
ASSIGNMENT OF RUNS.
