Background and Security Investigations. 7.5.1 Each of Contractor’s staff performing services under this Contract, who is in a designated sensitive position, as determined by County in County's sole discretion, shall undergo and pass a background investigation to the satisfaction of County as a condition of beginning and continuing to perform services under this Contract. Such background investigation must be obtained through fingerprints submitted to the California Department of Justice to include State, local, and federal-level review, which may include, but shall not be limited to, criminal conviction information. The fees associated with the background investigation shall be at the expense of the Contractor, regardless of whether the member of Contractor’s staff passes or fails the background investigation. If a member of Contractor’s staff does not pass the background investigation, County may request that the member of Contractor’s staff be removed immediately from performing services under the Contract. Contractor shall comply with County’s request at any time during the term of the Contract. County will not provide to Contractor or to Contractor’s staff any information obtained through the County’s background investigation. 7.5.2 County, in its sole discretion, may immediately deny or terminate facility access to any member of Contractor’s staff that does not pass such investigation to the satisfaction of the County or whose background or conduct is incompatible with County facility access. 7.5.3 Disqualification of any member of Contractor’s staff pursuant to this Paragraph 7.5 shall not relieve Contractor of its obligation to complete all work in accordance with the terms and conditions of this Contract.

Background and Security Investigations. 8.1 For the safety and welfare of the children to be served under this Contract, CONTRACTOR shall, as permitted by law, ensure that its staff, employees, independent contractors, volunteers or subcontractors who may come in contact with children in the course of their work, undergo and pass a background investigation to the satisfaction of COUNTY as a condition of beginning and continuing to work under this contract. Such background investigation may include, but shall not be limited to criminal conviction information obtained through fingerprints submitted to the California Department of Justice. The fees associated with the background investigation shall be at the expense of the CONTRACTOR, regardless if the member of CONTRACTOR’s staff passes or fails the backgrounds investigation. 8.2 If a member of CONTRACTOR’s staff does not pass the background investigation, COUNTY may request that the member of CONTRACTOR’s staff be immediately removed from performing services under the Contract at any time during the term of the Contract. COUNTY will not provide to CONTRACTOR or to CONTRACTOR’s staff any information obtained through the COUNTY’s background investigation. 8.3 Disqualification of any member of CONTRACTOR’s staff pursuant to this Sub-section shall not relieve CONTRACTOR of its obligation to complete all work in accordance with the terms and conditions of this Contract. 8.4 CONTRACTOR shall immediately notify COUNTY of any arrest and/or subsequent conviction, other than for minor traffic offenses, of any employee, independent contractor, volunteer staff or subcontractor who may come in contact with children while providing services under this Contract when such information becomes known to CONTRACTOR. 8.5 CONTRACTOR agrees not to engage or continue to engage the services of any person convicted of any crime involving harm to children, or any crime involving conduct inimical to the health, morals, welfare or safety of others, including but not limited to the offenses specified in Health and Safety Code, Section 11590 (offenses requiring registration as a controlled substance offender) and those crimes listed in the Penal Code which involve murder, rape, kidnap, abduction, assault and lewd and lascivious acts.

For Work performed under this Subaward, sensitive positions include (but is not limited to) the following: 7.5.1.1 Positions that involve the care, oversight, or protection of persons through direct contact with such persons (e.g., social worker, case manager, etc.). 7.5.1.2 Positions having direct or indirect access to funds or negotiable instruments (e.g., finance manager, accountant, bookkeeper, etc.). 7.5.1.3 Positions that require State and/or professional licensing (e.g., Certified Public Accountant, etc.). 7.5.1.4 Positions that have access to confidential or classified information including criminal conviction information (e.g., human resources manager, etc.). 7.5.1.5 Positions that involve the care, oversight, or protection of County, public, or private property (e.g., property custodian, etc.). 7.5.2 If a member of Subrecipient's staff does not pass the background investigation, County may request that the member of Subrecipient's staff be immediately removed from providing Services under this Subaward. Background and Security Investigations. 7.5.1 At any time prior to or during the term of this Master Agreement, all Contractor staff, non-employee staff, subcontractors, and agents of Contractor (collectively herein "Contractor's staff") performing Services under this Master Agreement must undergo and pass a background investigation to the satisfaction of the County as a condition of beginning and continuing to perform Services under this Master Agreement. Such background investigation may include, but will not be limited to, criminal conviction information obtained through a Driver License check or through fingerprints submitted to the California Department of Justice to include state, local, and federal-level review. 7.5.2 County Project Director will schedule the background investigation with the Department’s Civilian Backgrounds Unit. The fees associated with the background investigation are at the expense of Contractor, regardless if the member of Contractor’s staff passes or fails the background investigation. 7.5.3 If a member of Contractor’s staff does not pass the background investigation, the County may request that the member of Contractor’s staff be immediately removed from performing Services under this Master Agreement at any time during the term of this Master Agreement. The County shall use its discretion in determining the method of background clearance to be used, which may include but is not limited to fingerprinting. The County may perform the background check. 7.5.2 The County may request that the Contractor’s staff be immediately removed from working on the County Master Agreement at any time during the term of this Master Agreement. The County will not provide to the Contractor nor to the Contractor’s staff any information obtained through the County conducted background clearance. 7.5.3 The County may immediately, at the sole discretion of the County, deny or terminate facility access to the Contractor’s staff that do not pass such investigation(s) to the satisfaction of the County whose background or conduct is incompatible with the County facility access. 7.5.4 Disqualification, if any, of the Contractor’s staff, pursuant to this Sub-paragraph 7.5, shall not relieve the Contractor of its obligation to complete all work in accordance with the terms and conditions of this Master Agreement.

County will not provide to the Contractor nor to the Contractor’s staff any information obtained through the County conducted background clearance. 3.4.3 County may immediately, at the sole discretion of the County, deny or terminate facility access to the Contractor’s staff who do not pass such investigation(s) to the satisfaction of the County whose background or conduct is incompatible with County facility access. 3.4.4 Disqualification, if any, of the Contractor’s staff, pursuant to this Paragraph 3.4, shall not relieve the Contractor of its obligation to complete all work in accordance with the terms and conditions of this Agreement.

Background and Security Investigations. 7.7.1 Each of Contractor’s staff performing work under this Contract who is in a designated sensitive position, as determined by the County in the County’s sole discretion, shall undergo and pass, to the satisfaction of the County, a background investigation as a condition of beginning and continuing to work under this Contract. Such background investigation must be obtained through fingerprints submitted to the California Department of Justice (“DOJ”) to include state, local, and federal level review which may include, but not limited to, criminal conviction information. At the County's sole and absolute discretion it may accept other completed background checks of equivalent scope as those done using Live Scans through the CA DOJ for non- California residents. Examples of disqualifying factors include, but are not limited to, bribery, robbery, theft, fraud, embezzlement, forgery, extortion and perjury, or possession, sale or attempt to sell a controlled substance, and possession, sale or attempt to sell stolen property, or any felony conviction or conviction of a misdemeanor involving moral turpitude, and job-related misdemeanor convictions. The fees associated with the background investigation shall be at the expense of the Contractor, regardless if the member of the Contractor’s staff passes or fails the background investigation. 7.7.2 A member of Contractor’s staff shall not begin to perform services under the Contract until he/she has successfully passed a background investigation to the satisfaction of the County. 7.7.3 During the Contract Term, if the County becomes aware of a subsequent disqualifying factor for a member of the Contractor’s staff, the County shall request that the member of the Contractor’s staff be immediately removed from performing services under the Contract. Contractor shall comply with County’s request. 7.7.4 The Contractor shall advise any Contractor staff member who did not pass the background investigation or who received a subsequent disqualifying factor to contact the County immediately to receive a copy of the Criminal Offender Record Information obtained from the DOJ through the County’s background investigation. 7.7.5 The County may request that Contractor’s staff be immediately removed from working on this Contract at any time during the Contract Term. 7.7.6 The County, in its sole discretion, may immediately deny or terminate facility access to any member of the Contractor’s staff that does not pass an investigation...
