BIDDER’S REPRESENTATIONS. 3.1 In submitting this Bid, Bidder represents that: X. Xxxxxx has examined and carefully studied the Bidding Documents, other related data identified in the Bidding Documents, and the following Addenda, receipt of which is hereby acknowledged: X. Xxxxxx has visited the buildings and become familiar with and is satisfied as to the general, local, and building conditions that may affect cost, progress, and performance of the Work. X. Xxxxxx is familiar with and is satisfied as to all Laws and Regulations that may affect cost, progress, and performance of the Work. X. Xxxxxx has carefully studied all the existing installations. 1. Bidder has considered the information known to Bidder; information commonly known to contractors doing business in the locality of the buildings; information and observations obtained from visits to the buildings; and the Bidding Documents with respect to the effect of such information, observations, and documents on (1) the cost, progress, and performance of the Work; (2) the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, including applying the specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding Documents; and (3) Bidder’s safety precautions and programs. 2. Bidder does not consider that further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of this Bid for performance of the Work at the price(s) bid and within the times required, and in accordance with the other terms and conditions of the Bidding Documents. 3. Xxxxxx is aware of the general nature of work to be performed by Owner and others at that relates to the Work as indicated in the Bidding Documents. 4. Xxxxxx has correlated the information known to Bidder, information and observations from visits to the buildings, reports and drawings identified in the Bidding Documents, and all examinations, investigations, explorations, tests, studies, and data with the Bidding Documents. 5. Bidder has given Owner written notice of all conflicts, errors, ambiguities, or discrepancies that Xxxxxx has discovered in the Bidding Documents, and the written resolution thereof by Owner is acceptable to Bidder. 6. The Bidding Documents are sufficient to indicate and convey understanding of all terms and conditions for the performance of the Work for which this Bid is submitted. 7. BIDDER’S REPRESENTATIONS. 1.19.1 Each bidder, by making their bid, represents that they have read and understand ALL the bidding documents as outlined in the table of contents (Section 00010) and their bid is made in accordance therewith. The bidder, by making their bid represents that they have visited the site and familiarized themselves with the local conditions under which the work is to be performed. The bidder, by making their bid, represents that the bid is based upon the products, systems and equipment described in the bidding documents WITHOUT EXCEPTIONS. 1.19.2 Documents are available as specified herein. Neither the county nor engineer will be responsible for distribution of those documents. CONTRACTOR IS ADVISED TO EXAMINE ALL PORTIONS OF THE DOCUMENTS AS THEY FORM THE CONTRACT. Neither county nor engineer will be responsible for use by the contractor or sub-contractor of partial or incomplete sets of documents.

BIDDER’S REPRESENTATIONS. 2.1 PRE-BID MEETING 2.1.1 A pre-bid meeting for this project will be held at the time and place designated. Attendance at this meeting is a pre-requisite for submitting a Bid, unless this requirement is specifically waived elsewhere in the Bid Documents. 2.2 By submitting a Bid, the Bidder represents that: 2.2.1 The Bidder has read and understands the Bidding Documents and that the Bid is made in accordance therewith. 2.2.2 The Bidder has visited the site, become familiar with existing conditions under which the Work is to be performed, and has correlated the Bidder’s his personal observations with the requirements of the proposed Contract Documents. 2.2.3 The Bid is based upon the materials, equipment, and systems required by the Bidding Documents without exception.

Xxxxxx has carefully studied the reports of explorations and tests of subsurface conditions at or adjacent to the Site and the drawings of physical conditions relating to existing surface or subsurface structures at the Site that have been identified in the Supplementary Conditions, with respect to the Technical Data in such reports and drawings. 5. Xxxxxx has carefully studied the reports and drawings relating to Hazardous Environmental Conditions, if any, at or adjacent to the Site that have been identified in the Supplementary Conditions, with respect to Technical Data in such reports and drawings. 6. Bidder has considered the information known to Bidder itself; information commonly known to contractors doing business in the locality of the Site; information and observations obtained from visits to the Site; the Bidding Documents; and the Technical Data identified in the Supplementary Conditions or by definition, with respect to the effect of such information, observations, and Technical Data on (a) the cost, progress, and performance of the Work; (b) the means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, if selected as Contractor; and

Bidder has given Brookfield Properties Retail written notice of all conflicts, errors, ambiguities, or discrepancies that Bidder has discovered in the Bidding Documents, and the written resolution thereof by Brookfield Properties Retail is acceptable to Bidder. Bidder will submit written evidence of its authority to do business in the state where the Project is located not later than the date of its execution of the Agreement. Xxxxxx proposes and agrees, if this bid is accepted, to enter into an agreement with Brookfield Properties Retail using the attached “Standard Owner Contractor Agreement” and to perform all work as specified or indicated in the contract documents for the prices and within the times indicated in this bid form and in accordance with the other terms and conditions of the contract documents and will commence construction of work immediately after receipt of Notice to Proceed. This Bid is genuine and not made in the interest of or on behalf of any undisclosed individual or entity and is not submitted in conformity with any agreement or rules of any group, association, organization or corporation.
