No spare parts, software updates, repairs or updates to the equipment shall be covered by Warranty beyond its initial warranty expiry in accordance with this agreement. 5.3 To the extent permitted by the applicable law, CircoSense Ltd disclaims all other warranties, representations and/or conditions with respect to the equipment, either express or implied, including but not limited to any implied warranties, representations and/or conditions of satisfactory quality or fitness for any particular purpose. 5.4 The customer hereby acknowledges that the terms and conditions of this Contract and, in particular, the limitations of liability contained in appropriate clauses noted are reasonable in all the circumstances and having regard for the purchase by the Customer for the Equipment.
COMPANY STANDARDS. (1) Deutsche Welle shall waive the limitation of the scope of work activity and the amount of the fee according to the “Prognoseregelung” [2]or due to other organisational regulations if a framework contract (Section 18) has been concluded. (4) Within the framework of the right to hearing pursuant to Section 78(3)(3) of the German Personnel Representation Act (BpersVG) for permanent staff, Deutsche Welle shall annually forward to the competent staff representation an overview of the freelancers with whom framework contracts on pursuant to this collective agreement were concluded and terminated during the reporting period, the terms of such agreements and the departments in which the freelancers work or have worked predominantly . The overview will also contain general statistical information on the quantitative extent of the assignment of individuals with employee-like relationships at Deutsche Welle in the reporting period, whereby this information shows, based on cost centres, in which departments the worked predominantly. Within the scope of this right to hearing, Deutsche Welle shall also discuss with the competent staff representation the question of whether activities to be performed on a permanent basis are to be carried out by employees or freelancers.

(b) In the event the Company wishes to discuss the weight of an individual Artist, it must do so in the presence of a mutually agreed upon health professional.
