In addition to complying with the terms and obligations set forth in this Lake Xxxxxx Independent School District Facility Use Agreement (“Agreement”) and policy GKD, the Applicant/Lessee must also comply with all other applicable laws, board policies, regulations, and guidelines. All laws (federal, state, local) and Lake Xxxxxx ISD policies are in effect 24 hours per day, including the times a facility is rented. An organization’s failure to follow applicable laws, board policies, regulations, or guidelines will result in the District denying use of the District’s facilities to the organization. Nondiscrimination Statement No school facility shall be used by any group or individual who is not in compliance with the requirements of all Federal or State statutes, regulations, and rules prohibiting discrimination on the basis of race, religion, color, sex, national origin, disability, age, or other legally protected classifications. No school facility shall be used by any group or individual who is not in compliance with the requirements of all Federal or State statutes, regulations and rules prohibiting discrimination on the basis of race, religion, color, sex, national origin, handicapping conditions, age or other classification. State law prohibits the use of alcohol on school property. All laws (federal, state, local) and Xxxxxx ISD policies are in effect 24 hours per day, including the times a facility is rented. Contraband shall include, but not be limited to drugs, drug paraphernalia, weapons, and alcohol. District police officers, or any other law enforcement officer, shall enforce the law and arrest individuals for the violation of any law including but not limited to possession or consumption of alcohol on school property, drug law violations, weapon law violations, disruptions, trespassing, and the violation of any traffic law. The District “Tobacco Free Policy” prohibits the use of Tobacco products; cigarettes; e-cigarettes; vapes; and any component, part, or accessory for an e-cigarette device, in or on any District property or any location leased by the District where a user group is being held. The policy includes, but is not limited to, all buildings and grounds, vehicles, property (outdoor or indoor), and all staff, students, parents, visitors, and patrons. These mandates include, but are not limited to, the California Environmental Quality Act (CEQA/ PRC §21074), the Memorandum of Understanding between California State Parks and the Office of Historic Preservation Executive Orders W-26-92 and B-10-11, Departmental Notice 2004-02, PRC §5024, §5024.5, and §5097 et seq., the Native American Xxxxxx Protection and Repatriation Act (NAGPRA) (PL 101-601, 25 U.S.C 3001 et seq., 104 stat. 3048) the Secretary of the Interior’s Standards for the Treatment of Historic Properties with Guidelines for Preserving Rehabilitating, Restoring & Reconstructing Historic Buildings, the California Endangered Species Act, the Federal Endangered Species Act, the Clean Air Act, the Clean Water Act, and the Xxxxxx Cologne Water Quality Act. When underrating has a Federal nexus, the National Historic Preservation Act (NHPA)- Section 106 (36 CFR Part 800.1 to 800.16) and the National Environmental Policy Act (42 U.S.C. §4321) will be required as well. The California State Parks Departmental Operations Manual (DOM 300, 400, and 2000) for natural and cultural resources shall also be complied with for projects with the potential to affect resources.
