Contract Waivers. Waiver proposals must be developed with knowledge and opportunity for participation of all SEA-represented employees and administrators assigned to the building/program submitting the proposal. 1. The requests must be for the purpose of implementing strategies for increasing academic achievement and tied to the building’s/program’s CSIP. 2. The requests must include: (See Appendix R SEA/SPS Contract Waiver Request Form) a. Reference to the specific provisions of the Agreement requested to be waived; b. Evidence of both employee and administrator participation in the decision-making process leading up to the request (2/3 of the SEA-represented staff must vote to support the request); c. Rationale for the waiver: Specifically, how will the waiver assist in increasing academic achievement, how will the building or program staff evaluate the effectiveness of the change and how will any negative impact on SEA members or other effected staff be mitigated or addressed; d. Duration of Waiver: Waiver requests may be for up to three years. Schools must review the waiver each year, and if the SEA-represented staff determine they wish to continue the waiver, they will notify the SEA and Regional Executive Director. If the SEA-represented staff wishes to modify or extend the waiver beyond the duration originally approved, they must submit a new application. Any request or documentation will be forwarded to the Assistant Superintendent for Human Resources. e. Costs (if applicable); f. Effect of waiver on other areas of the Agreement, other bargaining units’ contracts, or other programs/buildings; g. After the building has conducted its process, the Waiver Request Form must be signed by the SEA representative and the building principal. The Waiver Request must be submitted to the Regional Executive Director and SEA concurrently and by the first working day of each month, so the respective committees can process and make recommendations to their appropriate decision-making bodies. Contract Waivers. 4.16.1 School site improvement, restructuring or reform plans shall not contain any provisions contrary to, or in conflict with any article or section of this Agreement, unless specific waivers to such Agreement articles and sections are agreed to by the Association and the District. 4.16.2 The following Articles in this Agreement shall not be eligible for contract waivers: Recognition, Association Rights and Privileges, Grievance Procedure, Non-Discrimination. 4.16.3 In the event that unit members at a school/site wish to implement a restructuring and/or site- based decision-making proposal that would require the waiving of any provisions of the collective bargaining agreement between the Association and the District, the following steps shall be taken. 4.16.3.1 The Association Building Representative(s) at the school/site shall send a letter to the Association President outlining the restructuring/site-based decision-making plan, and indicating which provisions of the collective bargaining agreement may need to be waived in order to implement the plan. The President shall refer the letter to the Association bargaining unit team for review. 4.16.3.2 The Association bargaining team shall review the letter from the school/site to determine if collective bargaining agreement waivers are necessary to implement the restructuring/site-based decision-making plan, and report their findings to the Association Executive Board. 4.16.3.3 If the Association Executive Board determines that one or more provisions of the collective bargaining agreement needs to be waived in order to implement the school/site plan, the Association Representative Council shall be informed, and a waiver election shall be conducted by the Association at the school/site as follows: 4.16.3.3.1 Only unit members at the affected school/site shall be eligible to vote in the waiver election. Eligible unit members shall be defined as any bargaining unit member working at the school/site for any part of her/his job description, and who is a member of the Association. 4.16.3.3.2 The election shall be conducted at the school/site according to the election procedures established in the CUEA Bylaws/Standing Rules. 4.16.3.3.3 The Association shall prepare a ballot indicating specifically which section(s) of the collective bargaining agreement need to be waived in order to implement the school/site plan, the length of the waiver period, which shall not exceed one school year, and asking each eligible memb...

Contract Waivers. Recognizing that education reform activity may require collective bargaining flexibility on a continuing basis, the District and the Association adopt the following guidelines to assist in the implementation of the joint commitment. 24.3.1. The District and the Association recognize the need for flexibility in education reform and will, where appropriate, consider waiving or modifying any contract provisions. Contract waivers must be submitted on or before the 15th of April prior to the school year the waiver is to take effect. Approved contract waivers must be renewed on an annual basis. 24.3.2. Contract Waivers. The Association and the District recognize that the pursuance of best practices may result in the seeking of waivers to the collective bargaining agreement. The Association shall determine if a waiver will go forward for a vote. Waiver proposals must include the purpose, impact on instructional program, impact on teachers, and/or the specific contract language or practice that is to be waived. Waivers to this contract will be granted when a vote conducted through secret ballot by the Association, shows seventy percent (70%) of the site members participating in the vote support the proposed waiver. Contract Waivers. Any school leadership team that desires to waive a portion or section of this collective bargaining agreement shall first meet with the MCEA President or his/her designee and the appropriate Associate Superintendent from the Office of School Support and Improvement to discuss what the interest is in requesting such a waiver. Following this meeting, if the leadership team is still interested in pursuing a waiver, it is expected to follow an interest-based decision-making process to discuss the waiver request:
