The software is an operating system for embedded and mobile devices based on the Android Open Source Project. 2.2. emteria shall provide additional connected services, offered through xxxxxxx.xxx, xxx.xxxxxxx.xxx, or other web sites, associated links and/or any other online communication method (hereafter referred to as “Portal”) or offline software components (hereafter jointly referred to as “Connected Services”). The software and the connected services are not free and must be licensed for each device separately. The user acknowledges that the software may contain Open Source Software (hereinafter referred to as "OSS") or OSS components, which may be subject to separate license terms. emteria provides the user with a copy of relevant license terms either as part of software or as part of the documentation. 2.5. The software and connected services may only be used by the user to the extent of the rights of use acquired in accordance with Section 3 of this XXXX under the terms and conditions agreed to in this XXXX. Without prejudice to obligations of emteria resulting from OSS licenses, the user does not acquire any rights to the source code of the software. 2.6. The software is intended to be pre-installed on hardware products (hereinafter referred to as "Product Solution") by a hardware vendor with a prior written consent of emteria (hereinafter referred to as “Contractual Partner”). The user may also install the software on his end device himself in accordance with Section 7 of this XXXX. 2.7. Unless expressly designated as such, representations on the emteria website do not constitute a guarantee of quality.

Where applicable, any consulting services to be rendered shall also include application consulting and application support and must be separately compensated by the Customer in accordance with the condi- tions which are respectively valid at the point in time when services are rendered. 1.7 Adjustment of and/or changes to the software by deviceTRUST shall be owed only insofar as they are required for the maintenance and/or repair of the leased object and/or for the en- suring of contractual usage. Otherwise, de- viceTRUST shall be obliged to make adjust- ments and/or changes only if this has been expressly agreed: Where applicable, corre- sponding services must be compensated by the Customer upon a separate basis at condi- tions which are appropriate and customary for the market.

All domains under the .it top level domains must be registered with the registry operator Registro .it , Istituto di Informatica e Telematica del CNR , CNR - Area della Ricerca , Xxx Xxxxxxxx Xxxxxxx, 1, I-56124 Pisa, Italy. In accordane with the Procurement Rules for these TLDs, domain owners not established the European Union or other countries named above must appoint an admin-contact based in the European Union. This trust agreement can only be concluded with domain owners who would like to or have already register their domain name with one of Trustee´s partner registrars. The following general terms and conditions determine the rights and obligations of both the administrative contact / trustee and the registrant.

Contractual object. 1.1 The user is entitled to use the rental object in return for payment as stated in the order. If both hardware and software are transferred to the user, this shall involve separate agreements which are indepen- dent with regard to execution and legal status. 1.2 The user is not entitled to dispose of the objects transferred without the prior written consent of CGM XXXXX. In particular, the user is not entitled to transfer use to third parties and is not entitled to use the rental objects either in whole or in part at a place different to the place agreed or at additional workstations. The provisions sta- xxx in Clause 2 of the contractual conditions for software purchase apply accordingly with regard to use of the software. 1.3 Within the scope of rental agreements, CGM XXXXX under-takes to maintain the rental objects in accordance with the statu-tory stipulations.

Contractual object. The customer receives the non-exclusive and non-transferable usage rights for the program system in accordance with the accepted offer or a written order. The program system corresponds to the specifications in the service description (software, add-ons, accompanying documentation (hard copy or online) services and any data centre services). The software, the add-ons and documentation are protected by copyright and subject to copyright protection. As soon as the customer uses the program system, he accepts the contents of this agreement. The customer is not authorised to make this program system available for use, at a charge or no charge, by third parties. The customer is therefore expressly forbidden from undertaking any subleasing. The customer may only copy and use the software, insofar as this is covered by the intended use of the software as given in the current performance description. The necessary copying of the software includes loading the software into random access memory (RAM), however not even the temporary installation or storage of the software on the data carriers (hard disks or similar) of hardware used by the customer.
