Crossing of Picket Lines. Employees shall not be required to cross any picket line legally established and maintained under the statutes of British Columbia. The Union agrees to seriously attempt to get permits from the picketing Union to allow School Board employees to carry out normal functions.

Crossing of Picket Lines. In the event that any other employees of the Employer engage in a strike or where employees in a labour dispute engage in a strike and maintain picket lines, the employees covered by this Agreement shall have the right to refuse to cross such picket lines. Such refusal shall not be grounds for disciplinary action. Employees shall not receive pay for time spent in exercising these rights and the Union shall reimburse the University for the premium costs associated with the continuation of group benefits.

Subject to its other rights in such circumstances, the Employer agrees that it shall not take disciplinary action against an employee for refusing to cross a legal picket line of persons employed in other Bargaining Units at NSCAD University.

Crossing of Picket Lines. The Employer agrees that no employee shall be subject to discipline or dismissal for refusing to cross a picket line within the meaning of the Labour Code of British Columbia. However, if such refusal results in the employee not being able to perform the employee’s duties, they may immediately be taken off the payroll until once again able to perform the normal duties of the position.
