Layoff and Rehiring Procedure. Both parties recognize that job security should increase in proportion to length of service. Therefore, in the event of a layoff, employees shall be laid off in the reverse order of their seniority provided that they are competent and qualified to do the job. Employees shall be recalled in the order of their seniority provided they are competent and qualified to do the work.

If a laid off seasonal employee is not qualified or able to bump within his/her department, the seasonal employee may then bump a junior seasonal employee elsewhere in the bargaining unit in the organization, providing the seasonal employee has the qualifications and ability to perform the work.
d) A regular part-time, seasonal, or casual employee cannot exercise their right to bump into a regular full-time position. An employee wishing to exercise their seniority under (b) and, or (c), must submit their request in writing to their immediate supervisor within five (5) working days of receiving the layoff notice. The written request shall include the request to bump and the position(s)to be bumped.
e) Bumped or laid off employee(s) shall be entitled to regular layoff notice as per section 16.03 of the contract and will be entitled to exercise their right under paragraph (b) and (c).
f) A laid off or bumped employee who has the required qualifications and ability to perform the work for the position they wish to bump into, shall receive a trial period as per Article 15.05.
g) Article 16.03 does not apply to casual employees.

(b) In the event a layoff appears to be for a period greater than thirty (30) working days, the employees in the bargaining unit having the most seniority shall be retained at work providing such employee(s) are reasonably competent to do the work. Employees shall be recalled in the order of their seniority provided that they are reasonably competent to do the work.
(c) In the event of the elimination of any job in the bargaining unit, the employee(s) affected shall first exercise his seniority in his classification, then in the bargaining unit, in that order respectively.
Layoff and Rehiring Procedure. For temporary reductions in production not exceeding four weeks, the work week may be reduced before any employees are laid off, unless otherwise extended by local plant agreement.

In the event there is lack of work in any job title in any work location for employees covered by this Agreement, the Company shall decide the necessity for and the extent of the force adjustment, and the following shall be the layoff and rehiring procedure, subject to provisions set forth in other Sections of this Agreement:
(a) If the Company deems it appropriate and in the exercise of its sole discretion, employees in the affected job titles and work locations may elect, in the order of seniority, and to the extent necessary to relieve the surplus, to leave the service of the Company and receive Voluntary Termination benefits under the terms and conditions as described in Article 3, Section 3.1.
(b) It may be jointly determined by the Company and the Union that those employees remaining shall remain at work until there is insufficient work to be provided them with a work week of a minimum of thirty- two (32) hours.

Layoffs, under the provisions of this Collective Agreement shall include the reduction of daily or biweekly hours of any full-time or part-time employee. In the event of a proposed layoff of a permanent or long-term nature of thirteen (13) calendar weeks or more, the Employer will:
(a) Provide the Union with at least six (6) weeks notice prior to its implementation. This notice is not in addition to required notice for individual employees.
(b) Provide affected employees with notice in accordance with the Employment Standards Act. However, the Act will be deemed to be amended to provide notice to the affected employee as follows: - if his/her service is greater than 9 years - 9 weeks’ notice - if his/her service is greater than 10 years - 10 weeks’ notice - if his/her service is greater than 11 years - 11 weeks’ notice - if his/her service is greater than 12 years - 12 weeks’ notice
(c) meet with the Union through the Labour Management committee to review the reasons and expected duration of the layoff, any realignment of service or staff and its effect on employees in the bargaining unit. Any agreement between the Employer and the Union resulting from the above process concerning the method, timing and implementation will take precedence over other terms of layoff and related provisions in this Collective Agreement.

(b) An employee who is to be affected by a layoff in his department and unable to retain a position in that department through the exercise of his seniority, will be entitled to claim the job of another employee in any other department subject to the following conditions:
(i) that such other job is held by an employee with less seniority; and
(ii) that such employee claiming the job has the required qualifications, skill, and ability to satisfactorily perform the job.
(i) Employees affected by a layoff shall be recalled in the order of their seniority, provided that the employees to be recalled have the required qualifications, skill, and ability to satisfactorily perform the available work.
(a) A full-time employee may be recalled to a full or part-time position. If recalled to a part-time position the employee shall retain recall rights to a full-time position not to exceed eighteen
