Customer’s Use. 2.6.1 Subject to the terms of an Order Form, Customer agrees that access to the Licensed Products under the User Licence Model shall be restricted to Customer employees or authorized agents. Customer shall use commercially reasonable efforts to protect User IDs and passwords. Customer agrees that authorized AUTOADDRESS support personnel may access as required to diagnose and resolve technical issues.
Customer’s Use. Customer may use the LoanSafe Application to create reports (“Customer’s Product”), which Customer may resell to RELS Reporting Services, LLC (“RELS”) who may then resell or redistribute to only the following End User for a permissible purpose under the FCRA or fraud or risk management purposes: Xxxxx Fargo Bank, N.A., a National Bank and its affiliated companies (collectively, “Xxxxx Fargo”) located at 1 Home Campus, MAC X2410-06T, Xxx Xxxxxx, XX 00000-0000. Customer may share reports generated by the Loan Safe Application with Xxxxx Fargo’s customers or prospective customers that are subject to an “adverse actionby Xxxxx Fargo as defined by the FCRA or as permitted by the FCRA or state credit reporting laws. Customer shall not use, relicense or redistribute the Services, except as expressly authorized in this Section A (Customer’s Use).
Customer’s Use. Customer hereby agrees that Customer shall use and require all persons operating the Supplies to use any and all proper, safe operating procedures set forth in operator’s manuals, American National Safety Standards, OSHA Regulations, and instruction sheets relating to the goods, and any and all available feasible, and practical point of operation safety devices consistent with Customer’s use of the goods, and Customer shall not remove or modify any device, warning sign, operator’s manual or work handling tools installed thereon or attached thereto.
Customer’s Use. Point Sigma does not represent or warrant to customer that: (a) Customer’s use of the Services will meet Customer’s requirements, (b) Customer’s use of the Services will be uninterrupted, timely, secure or free from error, and (c) data and insights provided through the Services will be accurate.
Customer’s Use. Customer and Permitted Affiliates may use the Services or any part thereof to design, develop, test or have designed, developed or tested the Algorithms (defined below), create property analysis reports, including using the Algorithms (collectively, “Customer’s Products”), which Customer or Permitted Affiliates may provide to End Users via Customer’s secure, password protected Internet site: wxx.xxxxxxxxx.xxx or any other website owned and controlled by the Customer or Permitted Affiliates (“Customer’s Websites”). Additionally, Customer may make available Customer's Products, on a limited basis for up to a maximum of five reports/properties, to market or sell Customer's Products to third parties that Customer considers potential End Users, subject to the restrictions set forth in Section III.B (End Users’ Use) below. Customer or Permitted Processors may co-mingle CoreLogic’s Services with the data obtained from other sources, provided that Customer can at all times comply with its obligations under Section 10.5 (Return or Destruction of Materials) of the Agreement. A sample copy of Customer’s Product will be provided to CoreLogic upon completion of the creation and development of the Algorithms and Customer’s Products. Upon review of the Algorithms and Customer Products, CoreLogic reserves the right to withdraw its consent for a particular Algorithm or Customer’s Product if such Algorithm or Customer’s Product is materially different from the descriptions set forth in this Section A (Customer’s Use). For purposes of clarification, all Algorithms and Customer’s Products shall be used by third party real estate investors, either individual or consumer or legal/corporate entities, which shall not include any institution primarily in the lending business as further described in Section 1.1 of the D&A Addendum. Any material changes to Customer’s Product or Algorithms that use, access or rely on the Services, require CoreLogic’s prior written approval of the continued use of the Services in connection with such product. Customer shall not deliver the Customer’s Product to End Users via any other website, domain, subdomain or other delivery mechanism (including via inline framing) without CoreLogic’s prior written approval. Customer’s Use. Subject to and conditioned upon payment of the Fees and Customer's compliance with all other provisions of this Agreement, Workspacify hereby grants Customer a limited, non-exclusive, non-transferable (except as provided in Section 10.3 ("Assignment") right to access and use the applicable Products during the term of the applicable Subscription Schedule or the applicable Statement of Work pursuant to the Agreement. Customer agrees to provide only Customer Content that it knows to be truthful and that relates to its own business. The Customer or its Consultants shall be solely responsible for all use of the Products by Customer, its Consultants, its Distributors, its Franchisees and by third parties acting on behalf of the Customer or Customer's Consultants. The Customer agrees to take commercially reasonable measures (at least as stringent as those it uses to protect comparable information of its own) to protect all information related to access and use of the Products. This includes, but is not limited to, login credentials, account passwords, and API keys (if any). If the Customer becomes aware of any unauthorized access to any of its accounts, Customer will promptly notify Workspacify in writing and work with Workspacify to resolve any issues related to unauthorized access. 2.1 Nutzung durch den Auftraggeber. Customer’s Use. In using the Service, Customer will:  comply with all laws;  comply with any codes of conduct or other notices provided by Aurigo;  keep its password secret, and  promptly notify Aurigo if it learns of a security breach or unauthorized access related to the Service. o Customer may not:  use the Service in any way that xxxxx Aurigo or its Affiliates, resellers, distributors and/or vendors (collectively, the “Aurigo parties”), or any customer of a Aurigo party or the Service or other Users;  engage in, facilitate, or further unlawful conduct;  damage, disable, overburden or impair the Service (or the networks connected to the Service) or interfere with anyone’s use and enjoyment of the Service; resell or redistribute the Service, or any part of the Service, unless Customer has a contract with Aurigo that permits it to do so;  use any portion of the Service as a destination linked from any unsolicited bulk messages or unsolicited commercial messages (“spam”);  use any unauthorized automated process or service to access and/or use the Service (such as a BOT, a spider, periodic caching of information stored by Aurigo or “meta-searching”), however, periodic automated access to the Service for report creation or scheduling is permitted;  use any unauthorized means to modify or reroute, or attempt to modify or reroute, the Service or work around any of the technical limitations in the Service;  modify, create derivative works from, reverse engineer, decompile or disassemble or otherwise attempt to discover any trade secret contained in the Service or in any technology, or system used by Aurigo in connection with providing the Service, except and only to the extent that applicable law expressly permits Customer to do so despite this limitation;  create Internet "links" to the Service or "frame" or "mirror" any content of the Service to give the impression that Customer is offering all of the functionality of the Service as its service located on its own servers;  build a product or service using similar ideas, features, functions or graphics of the Service;  copy any ideas, features, functions or graphics of the Service.
