Distributor Price. For each Customer Transaction involving a Qualifying Movie in HD, Apple shall pay to CDD the Distributor Price based on the tier selected for such Qualifying Movie in HD by CDD, as set forth below.

However, in the event of changes in the price basis of considerable impact on the price structure, price regulation may take place at any time of the year. Notice of any adjustment to the Distributor Price for a Feature Film (“Repricing”) shall be set forth in a written notice to Licensee not less than 15 days prior to the effective date of such Repricing. The price charged to a Customer by Licensee (“Customer Price”) for each Customer Transaction shall be established by Licensee in its sole discretion. Licensor’s “Suggested Customer Price” or “SCP,” if any, for each Included Program or pricing tier may be set forth in the Availability Notice or Repricing notice for such program or pricing tier.
Distributor Price. The following shall be added to Exhibit B to the Agreement: Latin America. Apple shall pay CDD in United States dollars (US$) the following Distributor Price for each Movie distributed under the Agreement in Latin America, as applicable:

Xxxxxxxx'x facilities, and Distributor shall bear all costs, insurance premiums, freight and all other charges and expenses incurred after Xxxxxxxx has placed the Products in the custody of the carrier at the place of shipment to Distributor.

Distributor Price. For each Customer Transaction involving a Qualifying Movie in HD, ITUNES shall pay to SPHE the Distributor Price based on the tier selected for such Qualifying Movie in HD by SPHE, as set forth below.
Distributor Price. The price Distributor charges the Purchaser for the products shall be established solely by the Distributor and under its sole and complete control. Should Company provide “suggested resale” prices or any other form of suggestion as to resale prices level, the Distributor is not required to observe those suggestions.
