DOMAIN SERVICES. 3.1 INTRODUCTION By selecting ND(J)L’s Domain Service you have agreed to establish an account with us for such services. When you use your account or permit someone else to use your account to purchase or otherwise acquire access to additional ND(J)L service(s) or to modify or cancel your ND(J)L service(s) (even if we were not notified of such authorization), this Agreement covers any such service or actions.

DOMAIN SERVICES. 5.1.1 We will endeavour to procure the registration of the domain name You request. 5.1.2 You confirm and warrant that You are the owner of any trade mark in any domain name (or have the authority of the owner of any trade mark to use such name) that You have requested be registered. You confirm and warrant that You are the legal owner of any domain name (or have the authority of the legal owner to use such domain name) supplied by You, or otherwise authorised by You, for use as a domain name in connection with any website in relation to which the Hosting Service supplied to You is used. 5.1.3 We will not be liable in the event that the relevant domain name registry refuses to register the domain name You request, or subsequently suspends or revokes any registration for that domain name. 5.1.4 We shall not act as Your agent or on Your behalf in any dealings with the domain name registry. 5.1.5 The registration of the domain name You request and its ongoing use is subject to the relevant domain name registry’s terms and conditions of use which can be found at xxxxx://xxxxxxxxx.xxxxxxxx.xxxx/legal/. You are responsible for ensuring that You are aware of the terms so that You can comply with them.
DOMAIN SERVICES. 3.2.1 We will automatically provide you at no charge with an internet address enabling full access to your website. Additional domain names are available at additional costs. 3.2.2 On payment of the appropriate fee by you we shall apply for registration of the Domain Name requested by you on the Service Agreement. 3.2.3 The registration of the Domain Name shall, at all times, be subject to the terms and conditions from time to time in force of the relevant naming authority or registration agent which terms and conditions are hereby included into these Terms and Conditions. For IE domains please see: xxxxx://xxx.xxxxx.xx/uploads/Registrant-Terms-and-Conditions-IEDR.ie-May-2018.pdf 3.2.4 You agree and acknowledge that we shall not be liable in any way for any acts, omissions, or errors of the naming authority or registration agent in relation to the registration (or non-registration, as the case may be) of the Domain Name. 3.2.5 In the event that the Domain Name requested by you is unavailable, we will offer you an alternative Domain Name and upon your approval, we shall register that alternative Domain Name in accordance with the provisions of this Clause. 3.2.6 At your request we shall host an Existing Domain Name owned by you (the "Existing Domain Name") always provided that you shall be solely responsible for the transfer of the Existing Domain Name to our server on or after the receipt of the Service Agreement and for any fees payable to any third party in relation to such transfer. In order to effect the transfer, you shall request your current ISP or any other relevant third party: 3.2.6.1 in the case of UK TLD's to modify the IPS Tag as required by us; and 3.2.6.2 in the case of international TLD's or IE domains, to provide the authorisation code and change WHOIS details as per our instructions. 3.2.7 You warrant that the Domain Name does not infringe any intellectual property rights of any third party, including but not limited to trade marks registered or otherwise used by any third party. 3.2.8 On termination of this Agreement, you may transfer the Domain Name or any Existing Domain Name to any third party server subject to completion by you of a transfer form and payment by you of the transfer fee set out by your new provider. 3.2.9 We shall not be liable for any delay in such transfer ...
DOMAIN SERVICES. 15.1. All domains are provided via third-party registrar services as “co-location”. 15.2. All domains are provided subject to the third-party’s terms and conditions. Available on request. 15.3. Transfer of domains in currently attracts no fee. Except any renewal fee due on transfer. This is subject to change without notice. 15.4. Transfer of domains out is subject to a transfer fee of £20 per domain. This is subject to change without notice. 15.5. Domain purchase and renewal fees are strictly non-refundable. 15.6. Domains can vary in price dependant on the .tld used, any quotation on price is valid at the time of the quote, for the duration specified.
DOMAIN SERVICES. (a) For 18 months after the Closing, Webiq Domains Solutions Pvt Ltd (“WebIQ”) shall, and Seller shall cause WebIQ to, continue to purchase and/or register domains on behalf of P.D.R. and to sell or transfer such domains to P.D.R. at a price equal to WebIQ’s actual costs incurred in obtaining such domains (without any markup for internal charges), in each case in the same manner (including volume, timing, advance deposits and resources used) and on the same terms as such transactions were conducted during the six months prior to the Closing. The 18 month term shall automatically renew for successive 18 month terms unless earlier terminated in writing by the Buyers. The Buyers may terminate this Section 5.19(a) upon 30 days’ written notice to the Seller. Upon any termination, WebIQ shall return any remaining funds deposited with WebIQ for purposes of purchasing or registering domains on behalf of P.D.R. (b) From the Closing until PDR is accredited with the appropriate registry to purchase or register such domains independently, Seller shall cause Directi Internet Solutions Pvt. Ltd., or such other affiliate of Seller that is accredited with the appropriate registry to purchase or register such domains (“DISPL”) to continue to purchase and/or register domains under the top level domain “.es” on behalf of P.D.R. and to sell or transfer such domains to P.D.R. at a price equal to DISPL’s actual costs incurred in obtaining such domains (without any markup for internal charges), in each case in the same manner (including volume, timing, advance deposits and resources used) and on the same terms as such transactions were conducted during the six months prior to the Closing. The Buyers may terminate this Section 5.19(b) upon 30 days’ written notice to the Seller. Upon any termination, DISPL shall return any remaining funds deposited with DISPL for purposes of purchasing or registering domains on behalf of P.D.R.” (j) Article IX is hereby amended by deleting the definition of the termClosing Cash Payment” in its entirety and replacing it with the following new definition:
DOMAIN SERVICES. Domain Name Services namely, Domain Name Registration, Domain Name Transfer, Domain Name Renewal, Bulk Transfer, Bulk Renewal, and Domain Name Suggestion, are all services, but not limited to, come under “Domain” Service. These services are offered to you by TTML and are available for a price as listed in our website. The price may change from time to time.  The Domain Name registration process does not get completed unless you pay the stipulated fee as mentioned in our website. If, by any reason, the Domain Name does not get registered due to non-payment or non- availability, we should not be held liable for the same.
DOMAIN SERVICES. 3.1. You acknowledge that registration of a Domain is subject to third party terms and conditions including those from the relevant registry for the Domain extension. You confirm that You will at all times and in all respects comply with ICANN’s and any relevant registry’s terms and conditions for domain registration and use. Further, You indemnify both the Service Provider and the applicable registry for a Domain in respect of Your use of the Domain and in respect of Your failure to comply with the terms of this Agreement or any failure to comply with ICANN or the registry’s terms and conditions. 3.2. You acknowledge and accept that domain registration and renewal services are limited to the forwarding by the Service Provider of Your request to register or renew a domain to the relevant registry for that domain. It is at all times Your responsibility to check that a Domain has been registered and/or renewed with the registry as appropriate. 3.3. You warrant that the registration of a domain name requested by You (‘a Domain’) and the manner in which it is to be used, either directly or indirectly: 3.3.1. will not infringe any third-party rights, including third party intellectual property rights; 3.3.2. Is not being made in bad faith or could otherwise be considered to be an abusive registration under the dispute resolution procedures or policies of any relevant registry or of ICANN; and 3.3.3. will at no time be used for an unlawful purpose whatsoever. 3.4. Whilst the Service Provider shall use reasonable endeavours to register a Domain, You accept that the Service Provider is not required to accept any request to register a Domain or to continue with any attempt to register a Domain if the Domain is not capable of registration. 3.5. The Service Provider makes no representations, express of implied, that a particular Domain is available for registration and the Service Provider accepts no liability for failure to register a Domain for any reason. 3.6. The Service Provider may from time to time change the registrar that a Domain is held with, at its discretion and without notice to You. 3.7. You accept and consent to the Service Provider making Your registration details in relation to the Domain available to third parties including ICANN and the applicable registry for the Domain as applicable including to law enforcement and governmental bodies as required by law. 3.8.   • Hosting Services 13.1 If Supplier or its subcontractor, affiliate or any other person or entity providing products or services under the Contract Hosts Customer Data in connection with an Acquisition, the provisions of Appendix 1, attached hereto and incorporated herein, apply to such Acquisition. 13.2 If the Hosting of Customer Data by Supplier or its subcontractor, affiliate or any other person or entity providing products or services under the Contract contributes to or directly causes a Data Breach, Supplier shall be responsible for the obligations set forth in Appendix 1 related to breach reporting requirements and associated costs.   • Beta Services From time to time, We may invite You to try Beta Services at no charge. You may accept or decline any such trial in Your sole discretion. Beta Services will be clearly designated as beta, pilot, limited release, developer preview, non-production, evaluation or by a description of similar import. Beta Services are for evaluation purposes and not for production use, are not considered “Services” under this Agreement, are not supported, and may be subject to additional terms. Unless otherwise stated, any Beta Services trial period will expire upon the earlier of one year from the trial start date or the date that a version of the Beta Services becomes generally available. We may discontinue Beta Services at any time in Our sole discretion and may never make them generally available. We will have no liability for any harm or damage arising out of or in connection with a Beta Service.

  • Internet Services Transfer Agent shall make available to Fund and Shareholders, through its web sites, including but not limited to xxx.xxxxxxxxxxxxx.xxx (collectively, “Web Site”), online access to certain Account and Shareholder information and certain transaction capabilities (“Internet Services”), subject to Transfer Agent’s security procedures and the terms and conditions set forth herein and on the Web Site. Transfer Agent provides Internet Services “as is,” on an “as available” basis, and hereby specifically disclaims any and all representations or warranties, express or implied, regarding such Internet Services, including any implied warranty of merchantability or fitness for a particular purpose and implied warranties arising from course of dealing or course of performance. Transfer Agent shall at all times use reasonable care in performing Internet Services under this Agreement.

  • Online Services Microsoft warrants that each Online Service will perform in accordance with the applicable SLA during Customer’s use. Customer’s remedies for breach of this warranty are described in the SLA.

  • Web Services Our Web Services are designed to enable you to easily establish a presence on the Internet. Our Web Hosting and Design is composed of our Web Hosting and Design Publishing Component and other miscellaneous components. These components may be used independently or in conjunction with each other.

  • Software Services If elected by Customer, the following Software Services will be made available for Customer’s use. 2.1. Core HR Software Service is a system of interactive web pages to assist Customer in its human resource related recordkeeping and reporting. Customer shall ensure the accuracy of its Customer Data. The HR Software Services shall function in accordance with the Documentation, as may be amended from time to time, and provide features to aid Customer with its compliance with federal and state laws and regulations applicable to Human Resources (except as stated otherwise in the Documentation). 2.2. Recruiting Software Service is a system of interactive web pages to assist Customer in posting job requisitions, storing candidates, recording job applications, and the related recordkeeping and reporting. Customer shall ensure the accuracy of its Customer Data. The Recruiting Software Service shall function in accordance with the Documentation which may be amended from time to time.

  • Extra Services District-authorized services outside of the scope in Exhibit “A” or District-authorized reimbursables not included in Architect’s Fee.
