Mobile Services i. Your use of the Service may include access to some products and services through a mobile device, web-browser or a mobile app ("Mobile Services"). By using the Mobile Services, you agree to the following terms. You agree that we may send you information relative to Mobile Services through your communication service provider in order to deliver them to you and that your communication service provider is acting as your agent in this capacity. You agree to provide a valid phone number, e-mail address or other delivery location so that we may send you certain information about your applicable account or otherwise related to the Mobile Services. You will immediately notify us if any phone number you have registered is (i) surrendered by you, or (ii) changed by you. ii. Additionally, you agree to indemnify, defend and hold us harmless from and against any and all claims, losses, liability, cost and expenses (including reasonable attorneys' fees) arising from your provision, whether directly or indirectly (such as through our use, to the extent agreed to by you from time to time, of any tool or technology) of a phone number, e-mail address, information and photographs associated with recipients contained in your mobile device Contacts, or other delivery location that is not your own, or your violation of applicable federal, state or local law, regulation or ordinance. Your obligation under this paragraph shall survive termination of the Agreement. iii. You understand and agree that these services may not be encrypted and may include personal or confidential information about you such as your account activity or status. Delivery and receipt of information, including instructions for payment, transfer and other move money transactions, through the Mobile Services may be delayed or impacted by factor(s) pertaining to your Internet service provider(s), phone carriers, other parties, or because of other reasons outside of our control. We will not be liable for losses or damages arising from any disclosure of account information to third parties, non-delivery, delayed delivery, misdirected delivery or mishandling of, or inaccurate content in, information and instructions sent through the Mobile Services. Additionally, not all of the products, services or functionality described on the Site(s) and the Agreement are available when you use the Mobile Services. Mobile Services. The Mobile Banking Service allows you to access the following features through the Mobile App: (a) account access; (b) account alerts; (c) bill payment; (d) transfer money; (e) approve ACH and Wire transactions; (f) mobile remote deposit capture; (g) decision Positive Pay exception items; and (h) locate an office or ATM. We may add or delete functions in the future. You acknowledge that we use one or more third-party licensor’s mobile technology to provide the Mobile Banking Service. The Mobile Banking Service, as well as the content and materials you may receive or access through your use of the Mobile Banking Service, are proprietary to us or our licensors, and are for your use only. You agree we are not responsible or liable for the acts, omissions, systems, or services provided by any licensor. You bear the risk of using the Mobile Banking Services, including the risk of erroneous and fraudulent transactions and the risk of all transactions using your user ID and password, and your liability for any such transactions is unlimited. Unless otherwise required by applicable law, we are responsible only for performing the services as delineated in this Agreement. We will not be liable to you for failure to make a requested transfer or otherwise in the instances set forth, above. If the transaction is made using your user ID and password, or using your mobile tablet or device, the transfer will be treated as your authorized transaction. You agree to keep your password secure and strictly confidential, instruct each Primary Administrator or User with whom you give your password that he or she is not to disclose it to any unauthorized person, and immediately notify Bank and select a new password if you believe your password may have become known by an unauthorized person. Bank will not be liable to you for any unauthorized payment or transfer made using your password, tablet, or device that occurs before you have notified us of unauthorized use and Bank have had a reasonable opportunity to act. Bank has the right to suspend or cancel your username or password even without receiving such notice from you, if Bank suspects that your information, tablet, or device is being used in an unauthorized, fraudulent, or illegal way. You agree that Bank may send notices and other communications, including passcode confirmations, to the current address or email address shown in Bank’s records, whether or not that address includes a designation for delivery to the attention ...
Mobile Services. Service standards 2.1.1 You acknowledge that We are entirely dependent upon Our suppliers and the Network Operator in relation to the quality of Airtime, in terms of line clarity, and call interference and the geographic extent of Airtime coverage and local geography, topography and/or atmospheric conditions and/or other causes of physical or electromagnetic interference that may from time to time adversely affect the provision of Airtime. 2.1.2 Our “Pay-As-You-Go” service is not part of these terms and conditions and is covered by Our separate terms and conditions available on Our Website. Provision of and Use of the Mobile Services 2.1.3 On acceptance of an application by You, We agree and undertake to use reasonable endeavours to provide the Mobile Service on the following terms: (a) We will provide the Mobile Services by a date which We will specify. If You request any change to Your Application Form then We may need to determine a new date for provision of the Mobile Services. All dates for provision are estimates only. We accept no liability for failure to meet any estimated date for provision. (b) We will operate a fault reporting service in respect of the Mobile Services but not if Your Handset has not been purchased from Us. You should report any faults in the Mobile Services to the Business Services Team. (c) We will provide the Airtime to You and will use reasonable endeavours to procure the Mobile Service from the Network Operator on a 24 hour a day 365 days per year basis and connect and activate each SIM Card on to the Airtime and to allocate numbers appropriately to each SIM Card. (d) You agree not to use SMS for the purpose of marketing or advertising. (e) You agree that We are acting as a mobile virtual network operator and as such have no knowledge of, involvement with, or liability for the specific content of any SMS text messages sent to You. (f) You agree not to use Your SIM card in, or connected to, any device that is not Your Handset or Dongle. (g) You agree not to use the Mobile Service in any way that adversely impacts the Service to Our customers. (h) The SIM card provided by Us may have been programmed so that You will not be able to use overseas networks or to make international or premium rate calls. Mobile Services. You acknowledge that PopPay, or other portions of the Site, may be available via a mobile device (“Mobile Services”), including the ability to upload content to, or browse and other wise access, the Service or certain features thereof. You further acknowledge and agree that: (a) to the extent you access the Mobile Services, your service carrier’s standard charges, data rates, and other fees may apply; (b) by using the Mobile Services, we, a Third Party and/or your mobile provider may communicate with you by automated SMS, MMS, text message, or other electronic means to your mobile device and that information about Your usage of the Mobile Services may be communicated to us; (c) in the event you change or deactivate your mobile telephone number, you must promptly update Your Account; (d) you will only access the Mobile Services on a mobile device number legally assigned to you by a service carrier; (e) you will be sent SMS messages from time to time as part of our provision of the Mobile Services and the frequency of the same depends, in part, on Your use of the Service.
