Xxxx: During current negotiations the parties discussed situations involving employees who resign from the Company on impulse and while suffering from emotional stress, anger, or frustration. The parties further considered appropriate avenues of recourse when such employees subsequently regret their decision to quit and request consideration with respect to reinstatement with full seniority. It was agreed by the parties that requests for reinstatement under such circumstances, if made within three (3) days of the original resignation, will receive due consideration. Such consideration will take into account all attendant circumstances and will apply only in cases where the employee has not engaged in misconduct or failed in employment obligations which might otherwise have resulted in the breaking of seniority pursuant to any subsection of Paragraph (43) of the Collective Agreement. It was agreed by the parties that the employee concerned should meet with the Regional Personnel Manager, or his designate, and the Chairman of the O.U.S.E. and outline reasons why reinstatement should occur. Provided there is mutual agreement between the Regional Manager and the Chairman and provided the conditions outlined in this document have been met, favourable consideration will be given to reinstating the employee with full seniority but with no financial liability to the Company for any period of time subsequent to the employee's resignation and prior to the employee's return to work. It is mutually recognized that the procedures outlined in this document are established without prejudice to either party in the application of any terms of the Collective Agreement and will not be cited or relied upon by an employee, the Union, or Management as a basis for any claim. EMPLOYEE RESIGNATIONS. Employee hereby resigns, effective as of September 18, 2017, as (i) President and Chief Executive Officer of Team, Inc., (ii) as a member of the Board of Directors of Team, Inc., and (iii) as an officer or director of any subsidiary of Team, Inc. and Employee agrees to take any further action reasonably requested by Team, Inc. to effectuate the foregoing. The last day of Employee’s employment with Team will be, and Employee hereby resigns as an Employee of Team, effective as of, December 31, 2017, unless his employment is terminated earlier (the date on which Employee’s employment with Team terminates, the “Last Day of Employment”).

  • Resignation of Employment The Executive confirms his/her resignation of his/her employment and of his/her position as an officer of the Company effective (the “Resignation Date”).   • Employee Release 19.1 Employees with 5 years continuous service with the current employer may apply for a one-off continuous period of unpaid Employee Release for a period of three months up to a maximum of twelve months. Such application shall be considered on a case-by-case basis and granted at the discretion of the employer. All service related provisions/ benefits will be put on hold until resumption of normal duties. 19.2 The notification of the employee’s intent to return to normal duties will be the same as Clause 15.7 (Parental Leave). 19.3 Job protection provisions will be the same as in Clause 15.9.1 19.4 The provisions of this clause are separate from and in addition to normal unpaid leave provisions and it is acknowledged that employees may apply for unpaid leave at any time during their employment.

  • Board/Committee Resignation Upon termination of Executive’s employment for any reason, Executive agrees to resign, as of the date of such termination and to the extent applicable, from the Board (and any committees thereof) and the Board of Directors (and any committees thereof) of any of the Company’s affiliates.
