Breaking of Seniority. Seniority shall only be broken by discharge for just cause and voluntary quit.
Breaking of Seniority. A Professional Staff Member on approved leave of absence will not be considered to have broken seniority during the time they were not on active working status. A layoff and time spent on disability retirement shall not be a break in seniority. An employee's seniority shall be broken upon resignation, permanent retirement or discharge.
Breaking of Seniority a. A layoff that does not exceed twenty-four (24) months and time spent on disability retirement, or any Board- approved leave of absence, shall neither be construed to constitute a break in seniority nor to constitute years of service credit for salary purposes.
b. An employee shall break his seniority:

If a reduction in force is in effect, the Employee shall retain seniority for recall purposes. However, seniority shall not accrue while an Employee is not working as a result of a reduction in force. When an Employee moves into a different category of position, she/he will not carry her/his seniority to the new category of positions, however, she/he will retain but not accrue seniority in the previous category of position.

A layoff and time spent on disability, retirement, or any Board- approved leave of absence shall not be construed to constitute a break in seniority; however, an employee's seniority shall be broken upon resignation, permanent retirement, or discharge in accordance with the provisions of this Agreement. In the event that two or more employees in the same area of certification/licensure share the same seniority by first day worked, they shall be placed on the seniority list in accordance with Board action. If a tie still exists, the employees shall be placed on the seniority list in accordance with the date of their application for employment with the Board.
Breaking of Seniority. An employee shall lose his seniority:
A. Upon resignation.
B. Upon discharge for just cause.
C. Upon failure to report from layoff within the designated time period.
D. Upon overstaying a leave of absence unless prior to the expiration of such leave he/she requests and obtains an extension which is then confirmed in writing.

(c) Layoff for a period of equal to the employee’s seniority or for two (2) years, whichever is less. To retain seniority, however, an employee must register with the Company by certified mail or in person to Human Resources at least once each one hundred and eighty (180) calendar days following his/her layoff. If not registered, his/her seniority shall terminate.
(d) Failure to notify the Company within ten (10) working days after a recall notice has been sent by certified return receipt mail, or failure to report to work within five (5) working days of such notice.
(e) Refusal of reinstatement to the highest classification to which an employee has recall rights or to another classification at a rate of pay which is a least eighty percent (80%) of the rate of pay the employee was receiving while in the highest classification.
(f) If the employee engages in other gainful employment without Company approval while on approved leave of absence.
(g) Failure to report to work within five (5) working days following expiration of an approved leave of absence.
(h) Settlement is reached with employee for total disability.
(i) The employee retires, is retired or dies.
(j) If the employee is absent from work, fails to report his/her absence from work; or overstays a vacation for three (3) consecutive working days, except for good cause.
(k) If the employee fails to supply the Company with justification for the need of a Medical Leave of Absence within five (5) working days after the last days worked, except for good cause.
(l) The employee is unable to return by the end of the reinstatement period as referenced in Article 20, Section (paragraph) 20.04 (Medical Leave).
(m) Failure to obtain or retain a security clearance, as may be required for their position.
Breaking of Seniority. A Certified School Psychologist on approved leave of absence will not be considered to have broken seniority during the time they were not on active working status. A layoff and time spent on disability retirement shall not be a break in seniority. An employee's seniority shall be broken upon resignation, permanent retirement or discharge.
Breaking of Seniority. A. Time spent in layoff status, on disability retirement, or during any Board-approved leave of absence shall not be construed to constitute a break in seniority unless otherwise stated elsewhere in this Agreement. However, an employee's seniority shall be broken upon resignation, retirement, or permanent dismissal.
B. An employee who leaves the bargaining unit for any position with the Board for one (1) year or less shall return to the bargaining unit with uninterrupted seniority. If such an employee returns to the bargaining unit after one (1) year, seniority earned as an employee is retained and the accumulation of seniority resumes.
Breaking of Seniority. Seniority shall be broken and the employment relation between the Hospital and the employee shall be terminated by:
a. Resignation
b. Discharge
