FEASIBILITY REPORT. 13.1 Except as provided in paragraph 13.2, a Feasibility Report will only be prepared with the approval of:
(a) the Optionee if it will be funding the Feasibility Report as part of the Expenditure Costs, before the Operative Date, or
(b) the Management Committee, after the Operative Date. After the Operative Date, the costs for the Feasibility Report will be shared pro-rata in proportion with their Proportionate Shares.
13.2 The Operator will provide copies of the completed Feasibility Report to each of the Parties forthwith upon receipt, together with copies of all of the latest technical data and information generated or received by the Operator from any Programs which is not contained in the Feasibility Report.
13.3 Notwithstanding the provisions of paragraph 13.1, if a Party (the “Proponent”) is of the view that a Feasibility Report should be prepared, such Party will give notice thereof to the Operator and the Operator will call a Management Committee meeting to consider the matter. If the Management Committee fails to approve the preparation of the Feasibility Report supported by the Proponent, the Proponent may, either alone or with other Parties, at its or their sole cost, prepare a Feasibility Report. If such Feasibility Report indicates that production from the Property would be profitable to the Proponent, the Proponent will deliver the Feasibility Report to the Operator who will then call a Management Committee meeting to consider the Proponent’s Feasibility Report. If the Management Committee adopts the Feasibility Report it will become a Feasibility Report for all purposes, and the non-contributing Parties may either pay the Proponent an amount equal to 150% of their respective proportionate costs of the preparation of the Feasibility Report, or will suffer reduction of their respective Interests pursuant to paragraph 15.3.

9.3 If the Operator has not provided copies of a completed Feasibility Report to each of the Parties with an Interest by the fifth anniversary of this Agreement, any Party whose Interest is not less than 20% and if there is more than one, the Party with the greatest Interest, may prepare a Feasibility Report at its own expense (the "Non-Operator's Feasibility Report") and submit it to the Management Committee.
FEASIBILITY REPORT. The Feasibility report for Highway-3 is provided in soft copy is for purpose of reference only. The Authority makes no representation whatsoever, express, implicit or otherwise, regarding the accuracy, adequacy, correctness, reliability and completeness of any assessment, assumptions, statement or information provided by it and the Concessionaire confirms that it shall have no claim whatsoever against the Authority in this regard.

FEASIBILITY REPORT. The Licensor shall at its own expense perform a feasibility study and produce a report thereon on a site by site basis.
(a) The Licensee, or any of its Related Companies, Affiliates, sublicensees, site operators or the engineering contractor shall provide all relevant information for each site reasonably required by the Licensor to perform the initial feasibility study, including but not limited to samples, process descriptions, engineering drawings and schematics, precise quantity, flow and throughput figures, and, if travel to any site is for any reason impracticable, a video recording of the site. --------------------------------------------------------------------------------
FEASIBILITY REPORT. 5.1. A Feasibility Report shall only be prepared with the approval of Sunburst de Mexico. The Operator shall provide copies of the completed Feasibility Report to Sunburst de Mexico forthwith upon receipt, together with copies of all of the latest technical data and information generated or received by the Operator from the immediately preceding Program and not contained in the Feasibility Report.
5.2. Notwithstanding the provisions of paragraph 5.1., if Sunburst de Mexico is of the view that a Feasibility Report should be prepared, Sunburst de Mexico shall give notice thereafter to the Operator and the Operator shall prepare the Feasibility Report.
5.3. Sunburst de Mexico and the Operator shall meet at reasonable intervals and times to review the Feasibility Report and discuss whether the establishing and bringing of a Mine into commercial production in conformity, with the Feasibility Report is feasible or desirable.
FEASIBILITY REPORT. 8.1 Upon the completion of a Feasibility Report which recommends commencement of Commercial Production, the Operator shall present the Feasibility Report to the Participants. A meeting of the Management Committee shall be convened to approve the Program and budget based on the Feasibility Report (the “FR Program and Budget”). At least sixty (60) days prior to such meeting of the Management Committee, the proposed FR Program and Budget shall be prepared by the Operator and submitted to the Participants. Within thirty (30) days of receipt of the FR Program and Budget, the Participants may submit written comments to the Operator detailing revisions or modifications that they would like to have made to the FR Program and Budget. If such written comments are received, the Operator, working with the other Participant and the authors of the Feasibility Report, shall seek for a period of time not to exceed twenty (20) days, to develop a revised FR Program and Budget acceptable to both Participants. The Operator shall submit any revised FR Program and Budget to the Participants at least ten (10) days prior to the meeting of the Management Committee to consider the proposed FR Program and Budget. The adoption of the FR Program and Budget shall require a vote of at least sixty percent (60%) approval.
FEASIBILITY REPORT. Pursuant to a feasibility study performed by the Company as set forth in Section 2.2, the Company shall recommend ECOs for implementation at the Service Location(s) surveyed based on a life-cycle cost analysis and estimated energy savings for each ECO. The Company shall prepare and submit to the Customer a written report (a "Feasibility Report") specifying each recommended ECO and providing for each an estimate of (a) the expected implementation cost, (b) the anticipated life-cycle cost savings, and (c) the estimated timing for implementation, all of which shall be estimates only, based on the Company's reasonable assumptions. In the case of each ECO examined in a Feasibility Report, the Company shall provide sufficient information to determine whether the Customer's payback criteria described in Schedule C (Agreement for Feasibility Study) of the Supplemental Agreement are expected to be met based on the Company's estimates. Subject to the provisions of Schedule C, if the Feasibility Report submitted by the Company does not identify at least one potential ECO which meets the Customer's agreed upon payback criteria, the Customer shall be under no obligation to pay the Company for the Feasibility Report.
FEASIBILITY REPORT. NCE will conduct a feasibility analysis using the information gathered during the feasibility field walk, the information presented in the geotechnical and structural memoranda, and the challenges discussed during the feasibility meeting. The analysis will involve preparing a feasibility matrix and preliminary engineering analysis to determine the feasibility of the proposed trail alignment and localized variations from this alignment, the Xxxxxx Creek crossing location, and potential alternatives, and SEZ restoration options. The feasibility analysis will include a simple table that considers various inputs (evaluation criteria) including resource impacts, preliminary engineering, geotechnical and structural considerations, private property considerations, preliminary cost estimates, access, and constructability. The evaluation criteria will be used to score and rank the alignment options and Xxxxxx Creek crossing locations. The scoring and ranking will be evaluated by NCE and the County to select the preferred trail alignment, Xxxxxx Creek crossing location, and crossing type. A formal feasibility analysis will not be conducted for the water quality or SEZ restoration component of the project. Water quality improvement options will be presented to address the existing source control issues and the need to capture and treat stormwater runoff. NCE will prepare the draft Feasibility Report of the proposed alternatives and submit it to the County for review. Comments will be incorporated, as applicable, and a final report prepared. • County will provide available existing conditions information including but not necessarily limited to topographic base map in AutoCAD format, existing records, reports, as-builts, and inspection reports for improvements within the Project area. • NCE assumes that up to three (3) trail alignments, focused on variants of the Xxxxxx Creek crossing, will be analyzed. • NCE does not anticipate, nor have we included budget, to evaluate three (3) trail alignment options that cover the entire length of the project.
