Filling of Regular Vacancies. (a) The Employer shall fill regular vacancies within the core group of the bargaining unit, in each seniority block, created as a result of a regular employee's resignation, death, retirement, promotion, transfer, dismissal, regular vacancies created pursuant to (b) below, or any vacancies created as a result of an employee using this article. The Employer agrees to fill the vacancies or new positions within thirty (30) calendar days.
Filling of Regular Vacancies. When a vacancy for a regular position or a new position occurs and is required to be posted pursuant to Article 24.1, it shall be posted within a seniority block for fourteen (14) calendar days and shall be offered to applicants in the following sequence:

The Employer and the Union agree to suspend the provisions of this Article until the number of regular employees reaches forty-one (41), once that number has been attained the provisions of the Article shall be enforced.

(a) When a vacancy for a non-supervisory regular position occurs as a result of a regular employee’s resignation, death, retirement, promotion, transfer, or dismissal and provided the regular complement is below the number defined below, the Employer will post a position and fill it within thirty (30) days. Vacancies noted above will be filled within a classification and in a seniority block of the Employer’s choice. Where the regular position is to be filled, it shall be offered in the following sequence:

Should there be a restructuring of the Employers' operations pursuant to Clause the Parties agree that the obligation to fill regular vacancies affected by any adjustments will be reviewed by the Joint Labour Management Committee. In the event an agreement cannot be reached an arbitrator will be selected from the list in this agreement to make a binding decision.

(d) The next Machine Operator 3 (OPB) vacancy to arise within the Cloverdale seniority block shall be posted, filled and then the position and incumbent will be relocated permanently to the Port Coquitlam seniority block.
