Regular Vacancies. A vacancy shall be defined as a position that is open, for which there is no bargaining unit member with recall rights. All regular vacancies shall be posted in a conspicuous place in each building of the district for a period of five (5) workdays, and a copy sent to the MESPA President. Such posting shall contain the following information: 1. Type of Work 5. Rate of Pay 2. Location of Work 6. Hours to be Worked 3. Classification 7. Starting Date 4. Division 8. Minimum Requirements Determination of who will fill regular vacancies shall be made in accordance with Article V, Sections A, B, and C.

Regular Vacancies. Vacancy Defined - A vacancy shall be defined as a newly created position or present position that is not filled that the Board wishes to fill. All vacancies shall be posted in a conspicuous place in each building of the district for a period of ten (10) workdays. Such posting shall contain the following information: A copy of such posting shall be given to the president of the ESP Association. Regular Vacancies. The Employer shall fill terminal office job vacancies that fall within the scope of this Agreement from within the terminal office before hiring new Employees, providing there are Employees available with the necessary qualifications and ability to fill the vacant position. Each such vacancy shall be posted on the Bulletin Board on the Employer's premises for three (3) working days for bids, with a copy to the Local Union Office outlining the Terminal, the Job Title and Pay Group and shift starting time. Bids will be accepted by the Employer only during those days that such vacancy is posted, except that when there may be Employees on layoff, such Employees will be advised of the posting by telephone, email and/or courier and will have three
Regular Vacancies. Promotions to regular rank position vacancies shall be made on a competitive basis. To be considered for promotion an employee shall possess the minimum qualifications, experience, knowledge and ability to perform all duties and responsibilities of the position. Promotion determinations shall also be made with consideration given to the employee’s written examination results, oral board interview, seniority, and employee performance. . The Sheriff shall make his selection from the top five (5) qualified candidates. The Sheriff will fill position vacancies within sixty (60) days of posting. Extensions beyond sixty (60) days shall be subject to the approval of the Association, which approval shall not be unreasonably withheld.
Regular Vacancies. (a) A laid off employee at the time of notice pursuant to Article 23.01 shall be offered a regular vacant position in any classification for which they are qualified and capable (as per Article 23.11) within that Centre/satellite site, in the bargaining unit. (b) Pursuant to Article 23.07 (a), an Employee who accepts a position in a classification with a lower pay scale, shall be placed on the step in the lower pay scale that is equivalent to their basic hourly rate of pay at the time of their layoff or, on the next higher step in the pay scale if no equivalent hourly rate is found. If such placement on the new scale is not possible, the Employee shall be placed on the last step of the new scale. The Employee’s increment date will be adjusted by the same amount of time as the layoff and the new increment date will prevail after that. (c) An Employee who accepts a position under (a) above shall maintain residual right of recall to their pre-lay off classification and FTE during the recall period.
Regular Vacancies. Whenever a vacancy shall occur in the S&M bargaining unit that the Employer intends to fill, the Employer shall publicize the same by giving written notice of such vacancy to the Union and by providing for posting in the Office of Human Resources and other appropriate locations. No such vacancy shall be filled, except on a temporary basis, until it has been advertised for at least ten (10) working days. Vacancies may be filled on a temporary basis in accordance with Article 12, Section 4(D) or at the Employer’s discretion using current bargaining unit members.

Regular Vacancies. (a) A laid off Employee may apply for a regular vacant position in any classification within that Centre, in the bargaining unit subject to the provisions of Article 12. (b) Pursuant to Article 24.06 (a), an Employee who accepts a position in a classification with a lower pay scale, shall be placed on the step in the lower pay scale that is equivalent to their basic hourly rate of pay at the time of their layoff or, on the next higher step in the pay scale if no equivalent hourly rate is found. If such placement on the new scale is not possible, the Employee shall be placed on the last step of the new scale. (c) An Employee who accepts a position under (a) above shall not be considered to be on layoff and the provisions of Article 24 will no longer apply to such Employee.

Bids will be accepted by the Employer only during those days that such vacancy is posted, except that when there may be Employees on layoff, such Employees will be advised of the posting by Double Registered Mail and will have three (3) days from the date of receipt of the mailed posting to enter a bid. In the event an Employee bids and is awarded a job in a lower classification such Employee will be paid at the Wage Rate Step which is in accordance with such Employee's length of service with the Employer as an office Employee. In all bids referred to in this Article, the Employer shall designate the successful bidder or the results of the bidding process within two (2) work days of the bid closure date. Employees that are prevented from bidding due to being on vacation or on days off will be offered the opportunity to bid upon return to duty. In the event there are no applicants, or in the event the job is not awarded to an applicant from within the bargaining unit, a notice to that effect will be posted. Where such vacancy has not been filled from within the bargaining unit or from the recall list, the Union will have the right to refer personnel as potential Employees to the Employer. Employees desirous of employment at another terminal office will so advise their Supervisor in writing with a copy to the Personnel Department at the employer's head office.
