FINGERPRINTING AND CRIMINAL RECORDS CHECK. Provider and City shall comply with the provisions of Education Code Section 45125.1 regarding the submission of employee fingerprints with the California Department of Justice and the completion of criminal background investigations of its employees. Provider and City shall not permit any of its applicable employees to have any contact with District pupils until such time as Provider or City has verified in writing to the governing board of District such employee has not been convicted of a felony as defined in Education code 45125.1. Provider and City’s responsibility shall extend to all employees, subcontractors and employees of subcontractors regardless of whether such individuals are paid or unpaid, concurrently employed by the district and/or acting as independent providers of Provider or City. Verification of compliance with this section shall be provided in writing to District prior to the commencement of participation in the agreed project and contact with students.

FINGERPRINTING AND CRIMINAL RECORDS CHECK. The Fingerprinting/Criminal Background Investigation Certification must be completed and attached to this Agreement prior to the VENDOR performing any of the services as listed in Item 12 of this Agreement. DISTRICT retains authority to remove any VENDOR employee from DISTRICT site upon the determination that he/she has not complied with this fingerprinting and background check requirement, or has been convicted of a violent or serious felony, as defined in Education Code §45122.1. VENDOR must notify the DISTRICT and remove any employee immediately should the VENDOR learn that an employee working on a DISTRICT site has been convicted of a serious or violent felony, or sex offense. Failure to provide notice as required above may result in cancellation of this Agreement by DISTRICT and further legal action by the DISTRICT where applicable.
FINGERPRINTING AND CRIMINAL RECORDS CHECK. DISTRICT requires any VENDOR employee who may come into contact with students to be fingerprinted and be subject to a background check by the California Department of Justice (“DOJ”) in accordance with Education Code §45125.1. All employees of VENDOR who may come into contact with students must be fingerprinted by DISTRICT’s designated fingerprint provider, the identification and specifics of which shall be provided to VENDOR by the DISTRICT’s Associate Superintendent of Business & Operations or his/her designee. VENDOR shall comply with the provisions of Education Code §45125.1 regarding the submission of fingerprints to the DOJ and the completion of criminal background investigations of the VENDOR and/or its employees and must provide written verification of fingerprint clearance from the DOJ to the DISTRICT’s Board of Education. No employee of VENDOR is permitted to enter onto a DISTRICT site where he/she may come into contact with students until such employee has been subject to fingerprinting and background check by the DOJ and VENDOR has verified in writing that such employee(s) has not been convicted of a serious or violent felony, as defined in Education Code §45122.1, or sex offense, as defined in Education Code §45123, or DISTRICT has indicated on Page 2 of this Agreement that VENDOR is exempt from compliance. All personnel employed by VENDOR who do not have fingerprint clearance must supervised by the VENDOR while on a school site and must be accompanied by a certificated employee of the DISTRICT at all times when in contact with students. VENDOR shall not permit employees to work on DISTRICT sites until they have been fingerprinted and completed a background check, unless the employee complies with the requirement to be supervised by VENDOR and accompanied by a DISTRICT certificated employee when in contract with students at all times while on DISTRICT sites. All VENDOR personnel must check in at school office prior to delivery of services and check out at school office when delivery of services is concluded. DISTRICT retains authority to remove any VENDOR employee from DISTIRCT site upon the determination that he/she has not complied with this fingerprinting and background check requirement, or has been convicted of a violent or serious felony, as defined in Education Code §45122.1. The DISTRICT will determine if CONTRACTOR will be required to undergo fingerprinting and certification.

This section may be waived (site administrator initial to waive ) if the DISTRICT determines that CONSULTANT and/or its employees will have no contact with DISTRICT pupils; or if CONSULTANT and /or its employees will be supervised at all times by DISTRICT employees or pupil’s parent/guardian.

FINGERPRINTING AND CRIMINAL RECORDS CHECK. Contractor shall comply withthe provisions of Education Code Section 45125.1 regarding the submission of employee fingerprints to the California DOJ and the completion of criminal background investigations of its employees. Contractor shall not permit any employee to have any contact with CVUSD pupils until such time as Contractor has certified in writing to CVUSD that such employee has not been convicted of a felony or does not have a pending criminal proceeding for a felony, as defined in Education Code 45122.1. Contractor’s responsibility shall extend to all employees of Contractor. A Criminal Background Investigation/Fingerprinting Certification is included as part of the Contract Documents. Contractor is responsible for completing and submitting to CVUSD the Criminal Background Investigation/Fingerprinting Certification prior to commencement of the Contract, and for ensuring continued compliance with this provision throughout the entire duration thereof. If Contractor becomes aware that any person employed by Contractor in connection with the Contract has been arrested or convicted of a felony, then Contractor must immediately remove said employee from the performance of the services under the Contract, prevent the employee from interacting with CVUSD students, and notify CVUSD. CVUSD retains the right to prohibit any such employee from performing services under the Contract and otherwise having access to CVUSD students.
