CITY'S DUTIES AND RESPONSIBILITIES. A. Key City Personnel 1. City hereby appoints the City Attorney, or his or her designee, to represent the City on all matters related to this Agreement; however, any written amendment to this Agreement requiring additional funds shall be conditioned upon the approval of the additional appropriation of said funds by the Board. The City Attorney's Supervising Attorneys shall be Xxxxx Xxxxxx, General Counsel and the Chief Deputy City Attorney. On all matters relating to invoices the City Attorney’s representative shall be the City Attorney’s Chief Financial and Administrative Officer. 2. City Attorney's Supervising Attorneys shall have full authority to act for City on all daily operational matters under this Agreement and shall review and approve Outside Counsel's reports, whether written or verbal, and any change in Outside Counsel's designated Lead Counsel.

CITY'S DUTIES AND RESPONSIBILITIES. City agrees to: (a) Provide a staff person to oversee the Property during the License Periods. (b) Provide staff members to assist with event production and management, as directed by the City’s Parks and Community Services Director. (c) Provide marketing and promotional support in connection with each Fish Fry. (d) Waive the Special Events Permit Fee for each Fish Fry. (e) Waive the costs of providing special event Police Department services for each Fish Fry. (f) Contribute to each year’s Fish Fry as an official Three Day Event Sponsor, or similar level of sponsor if the sponsor levels change, of the event, in an amount to be determined by the City. Notwithstanding the foregoing, City’s annual sponsorship contribution shall not exceed Five Thousand Dollars ($5,000.00). (g) Permit Licensee to use the refrigeration units located in City facilities adjacent to the Licensed Area, if such units are available and the adjacent City facilities are not being utilized for a separate event. (h) Maintain the Licensed Area in a safe and clean condition. (i) Perform any needed maintenance and repairs of the Licensed Area. (j) Provide Licensee with notice as soon as practical of the unavailability of the Licensed Area, unless such unavailability is due to unanticipated emergency or causes beyond Licensor’s control. In the event the Licensed Area becomes unavailable, City will attempt to provide Licensee with an alternative location for the Fish Fry. (k) Allow Licensee to host an annual golf tournament at one of the two public golf courses located at the Costa Mesa Country Club as a fundraiser to benefit the Fish Fry. The City will waive green fees and other related fees for such tournament. The terms and conditions of Licensee’s use shall subject to written agreement of the parties.

Select NPG's per the Municipal Code and require agreements with each NPG and Wholesaler assuring compliance with the Municipal Code and the terms and conditions contained herein. 3. Assist Wholesaler in obtaining City permits.
CITY'S DUTIES AND RESPONSIBILITIES. The City shall provide the following services in connection with operation of the BID and the Contractor's performance under this Agreement: (a) Collecting assessments as provided by the governing body (Tarrant County) and recording the same in a special assessment revenue account; (b) Independently levying and collecting on City owned properties located within the BID, which receive absolute exemption and cannot be assessed. The City Administrator will calculate such assessment in the same manner in which non-tax exempt properties within the BID are assessed, and transfer such funds into a special assessment revenue account; (c) Making payments to Contractor from special assessment revenues and other BID revenues; (d) Maintaining the same level of public services in the BID as that which the City provides in comparable areas of the City; (e) Maintaining complete and detailed records concerning any expenditure of special assessment revenues and other BID revenues, which are made through City departments, boards, or agencies; (f) Retaining and expending revenues from special assessments, penalties, interest, and investment income thereon solely in the BID; (g) Preparing an annual report of delinquent property assessments and liens thereon to be assigned to the City's delinquent tax collection attorney; (h) Making regular reports to Contractor concerning delinquent assessments and making xxxxxxxx thereon as necessary; and (i) Producing an annual assessment roll of property owners and property within the BID. The City shall have no financial obligation to the BID other than levying and collecting the assessments levied by the BID, except as provided in Section 3(c) above, and, pursuant to and in accordance with this Agreement, paying for Improvements and Services that Contractor performs in the BID.
CITY'S DUTIES AND RESPONSIBILITIES. 6.1 City’s Designation of Authorized Representative. The City's Public Works Director or Engineer shall represent the City in all matters concerning this Agreement. The Engineer may designate in writing, from time to time, one or more representatives authorized to act on the City’s behalf with respect to the Project. 6.2 City’s Right to Make Changes and Award Separate Contracts. City has the right to review, check, and inspect any part of the Work at any time. The City reserves the right to order changes in the Work, to perform Work or operations related to the Work with the City’s own forces, and to award separate contracts in connection with the Work Order Package. 6.3 City’s Right to Stop the Work. If the Design-Builder fails to correct defective Work as required herein, or fails to carry out the Work in accordance with the Contract Documents, the City may, in its sole discretion, elect to order the Design-Builder to stop the Work, or any portion thereof, until the City reasonably determines that the cause for such order has been eliminated. The City’s right to stop the Work is in addition to the City’s right to terminate the applicable Work Order Package.

CITY'S DUTIES AND RESPONSIBILITIES. 1. The City agrees to provide the following: a. Banquet/Event Rooms as they currently exist at the CAC. b. Kitchen facilities as they currently exist at the CAC. c. CATERER contact information to all CAC clients needing food or beverage catering. d. Utility costs for the CAC. e. Basic custodial services for set-up and clearing. f. One portable bar per banquet room. g. Tables and chairs for the CAC rooms. h. Ice machine. i. Maintenance and set up support as defined by the City. j. Limited storage areas. k. Facility access and parking for CATERER personnel. 2. The City and CATERER shall be jointly responsible for the financial control of all catered events under this Agreement. a. At the time a reservation for a catered event is made, a CATERER representative will document the details of services required and contact the CAC rental coordinator to confirm the booking. b. A CAC representative will collect all room deposits, room rental fees, and security fees for the CAC. c. The CATERER will collect all catering charges. d. On-sale beverage fees shall be collected and recorded during the event by CATERER employees when each transaction is made at the bar. CATERER representatives shall run tapes to close out and balance each cash register at the end of each event. XXXXXXX will be responsible for the safekeeping of all money from on-sale beverage service. 3. The City agrees to restrict the catering services provided at the CAC to the five CATERERS selected for all events held at the CAC, except for clients exempted by the City as determined by the CAC Manager. The CATERER understands that CAC clients have the discretion to select from any of the contracted caterers for their event. The City has the discretion to select from any of the contracted caterers for any of its events.
