Land Management. In accordance with their respective Land Code and First Nation laws, a First Nation has jurisdiction over decision making in relation to the First Nation Land and natural resources, including leasing, developing, managing revenues and authorizing expenditures. However, First Nation Land cannot be sold or surrendered for sale. In keeping with the principle that First Nation land will not be reduced in area or quality, there is a procedure for exchanging lands if the First Nation regards such an exchange as advantageous.
Land Management. The Framework Agreement provides the First Nation with all the powers of an owner in relation to its First Nation Land, except for control over title or the power to sell it. The First Nation’s Council can manage land and resources, as well as revenues from the land and resources, in accordance with its Land Code.
Land Management. The Operator must consider the impact of the operation on land contamination. In doing so, all practicable control measures to prevent the contamination of land should be undertaken. The requirements of Clause 9.5 of the Agreement shall be a minimum. Contamination levels refer to those investigation threshold levels detailed in the guidelines for the Assessment of Contaminated land (Chem Unit 1991) or by other standards considered acceptable by the relevant Authorities. The Operator must consider the impact of the operation on flora and fauna. The Operator must review existing Queensland government regional ecosystem information relevant to the route of operation and identify any locations within 100 metres of the rail corridor that are listed as rare or vulnerable or endangered regional ecosystems. Land Management. (a) Before purchasing land, does the company consult with all affected parties, including both legal and customary owners, in order to seek their prior informed consent?
(b) Does the company ensure that it does not participate in or benefit from improper forced relocations, that due process was followed in accordance with the laws of the host country, and adequately compensates inhabitants respecting involuntary relocations?
(c) Does the company honor the land, passage, and usage rights of local or indigenous peoples on company-controlled land?
(d) Does the company consult with the local inhabitants and take measures to address and mitigate any disruptive effects that its operations may have on company land, the local community, and the natural resources in the area?
(e) To the extent that projects may affect access to water, does the company undertake to assure alternative access?

Land Management. The Framework Agreement provides the Treaty One First Nations with all the powers of an owner in relation to its Treaty One Lands, except for control over title or the power to sell it. Treaty One First Nations can manage land and resources, as well as revenues from the land and resources, in accordance with the Treaty One Joint Reserve Land Codes and the Governance and Management Agreement. Interests in the Treaty One Lands held by third parties, or by Canada, will continue in effect according to their terms and conditions under the Treaty One Joint Reserve Land Codes. No new interests or licences may be acquired or granted except in accordance with the Treaty One Joint Reserve Land Codes.
Land Management. The LANDOWNERS may request, for the purpose of long-term protection of the easement area, authorization for timber harvest, periodic grazing or other management techniques identified in the applicable Conservation Plan. Authorizations will only be made if, upon a determination by the COUNTY, the proposed use is consistent with the long-term protection of the easement area. The COUNTY shall prescribe the allowable amount, method, timing, intensity and duration of the compatible use(s) in a revised Conservation Plan. The LANDOWNERS release the COUNTY from any claims of damages that may arise as a result of floods and flash floods on the premises. The LANDOWNERS shall neither lease nor convey any other easement in any way affecting the use and enjoyment of this easement without the prior written permission of the COUNTY. Any ambiguities in this easement shall be construed in a manner which best effectuates conservation and enhancement of water quality and habitat for fish and wildlife.
Land Management. It is BLM policy to manage or conserve all known special plant and animal species not yet listed as threatened or endangered to minimize the need for listing those species by either Federal or state governments in the future. The San Xxxx Resource Area Management Plan identifies resource and land use objectives and management actions for activities and lands administered by the BLM. Resource objectives include managing streams to maintain fisheries and to enhance, recover, or re-establish special status plants and animals.
Land Management. 1. Make a one-time, assessment of land conserved in fee by FLT and the Town, grouping together abutting and/or close by parcels into Conservation Management Units (CMUs) where sensible. This will streamline management, although external reporting may still need to be done according to historical parcel boundaries in some cases. This assessment, including a map showing CMUs, will be completed by June 30, 2023.
2. Develop or update a proposed written land management plan for each CMU by the end of the Term, Said plans shall:
a. Identify the conservation values, including any significant cultural and natural features or those that have significant community value.
b. Identify the overall management goals.
c. Identify activities to achieve the goals and to reduce risks or threats to the conservation values.
d. Specify the uses that are appropriate, in keeping with the conservation values, plus any restrictions and donor or funder requirements.
e. Provide public access opportunities as appropriate.
f. The Town shall have the right to approve, to amend, or to reject proposed plans and substitute its own plans. The proposed land management plans are not intended to serve as forest management plans, and any such forest management activities shall remain the responsibility of the Town in accordance with Section.4.
3. Manage each CMU in accordance with its management plan, and review and update the plan at least every five years, provided the term of the agreement has been extended
4. Provide electronic copies of all management plans which include Town-Owned Properties to the Town, with the understanding that such plans are subject to freedom of access requests.
5. Monitor all CMUs, either aerially or on foot, on a frequency and scope comparable to FLT fee properties, to document the status of conservation values, prevent misuse, and identify any issues of encroachment.
6. Endeavor to improve the health and resilience of CMUs over time and, as appropriate, apply to grant-making bodies for additional funds to do so (e.g. invasive plant removal and native species planting).
7. Check boundary signs annually and replace them as needed. (Town will separately reimburse FLT for the expense of new signs).
8. Facilitate and manage any town, state and federal application and permit requirements for site improvements of CMUs which include Town properties (Town will separately reimburse FLT for the expense of applicable fees).
