Limitations/Restrictions. Full-time employees may apply to use leave from this sick leave bank subject to the following conditions and limitations. Additional limitations and restrictions may be jointly developed by the administrators of the sick leave bank:
1. Leave may only be requested for one of the following reasons:
a. The employee has a catastrophic illness/injury that renders him/her unable to work; or,
b. The employee needs time off to care for an immediate family member with a catastrophic illness/injury who is unable to care for him/herself; and,
2. The employee must have exhausted all available and appropriate leaves available to him/her under Article 9; and,
3. The employee provides acceptable medical certification to support the duration of time being requested; and,
4. The employee does not qualify for workers’ compensation disability benefits as provided under this Agreement or any other disability benefits for the period of leave being requested; and,
5. The employee has an acceptable attendance record (e.g., does not have a history of exhausting all available sick and/or personal leave absent a qualifying condition under FMLA/VPFL); and,
6. The duration of leave being requested does not exceed the following:
a. For leave related to the employee’s disability, the paid leave being requested cannot exceed a total of thirty (30) days. The paid leave being requested also cannot exceed 150 days when combined with the employee’s own sick leave use (as defined under Article 9.2).
b. For leave related to the catastrophic illness/injury of the employee’s immediate family member, the leave being requested cannot exceed thirty (30) days total when combined with the employee’s own sick leave use as defined under Article 9.2.
c. Employees may not use more than sixty (60) days from the sick leave bank over a five-year period.
7. The sick leave bank cannot be used for the following:
a. Voluntary procedures;
b. Procedures that are voluntarily scheduled during the school year (for school-year staff);
c. Procedures that are cosmetic in nature.
8. The sick leave bank shall generally be available to employees on a first come-first serve basis.
9. The number of hours that the bank may issue in any school year shall be no more than one- thousand seven-hundred (1700) hours.
10. The sick leave bank shall be capped at a total of 4200 hours.
Limitations/Restrictions. Any unauthorized modification of Company’s website themes (“Theme”) shall be a material breach of this Agreement. Except as specified in this Agreement, Customer is prohibited from: (i) Distributing, transferring possession, integrating into other programs or software, copying, lending, renting, leasing, transmitting or otherwise making copies of or use of the Theme or the database to any third party; (ii) Modifying, adapting, or creating derivative works of the Theme or the database; (iii) Disabling any password or other protective device incorporated into the Theme; (iv) Attempting in any way to obliterate or destroy the copyright notices, trademarks, service marks of Company in or on the Theme, or any watermarks; or (v) Using the Theme or database in any way past the expiration of the Term.
Limitations/Restrictions. The warranties referenced in this section do not apply if the Products (a) have been serviced, reconstructed, repaired, altered or modified (including any cosmetic alterations), except by Kymeta, (b) have not been installed, operated, repaired, used or maintained in accordance with instructions made available by Kymeta, (c) have been subjected to abuse, misuse, neglect, accident, improper testing, improper installation, improper storage,, improper handling, abnormal or unusual physical or electrical stress or environmental conditions, or use contrary to any instructions issued by Kymeta ; (d) are acquired by Customer for beta, evaluation, testing, demonstration purposes or other circumstances for which Kymeta does not receive a payment of a purchase price or license fee; or (e) have been used with any software, hardware, or product that has not been previously approved in writing by Kymeta. Furthermore, the warranties referenced in this section will be immediately voided in the event of any violation of Section 2.0 or 7.3 of these Terms of Sale.
Limitations/Restrictions. Subscriber may not transfer or provide access to SCM to an unaffiliated third party. Subscriber shall access SCM only by connecting remotely over the Internet. Subscriber shall not attempt to copy, reproduce, reverse engineer, disassemble, decompile, customize, translate, or alter SCM or attempt to unlock or by-pass any access prevention device in SCM or have anyone else do so. Subscriber may incorporate APIs included in SCM into its own software, provided that such software is not provided to any third party. Subscriber shall not alter, obscure, amend, or interfere with Certificate agreements presented through SCM. These limitations survive termination of the Agreement.
Limitations/Restrictions. 4.1. Each Party hereto shall endeavour to keep to a minimum the amount of Confidential Information that is furnished to the other upon which restrictions are imposed.
4.2. Each party acknowledges that the providing of Confidential Information or other information hereunder in no way constitutes or gives rise to or will be deemed to constitute or give rise to any representation or warranty as to the accuracy or completeness thereof.
4.3. Nothing contained herein shall be construed as granting or conferring any rights by license, copyright, or similar right with respect to any of the Confidential Information or any other information provided by either Party to the other Party hereunder.
4.4. Except upon mutual written agreement, or as may be required by law, neither Party shall in any way or in any form disclose the discussions that gave rise to this Agreement or the fact that there have been or will be discussions or negotiations covered by this Agreement. Neither Party will disclose to Third parties that either Party has expressed an interest in the proposed Project without prior consultation and without consent of the other. Limitations/Restrictions. You have no right to use the Software except for the purpose stated above. You have no right to reproduce the Software except for backup or archive purposes and no right to distribute the Software. Except as otherwise provided herein, you may not use the Software on more than one item of computer equipment or permit use by more than one user at one time, including any such use on multiple items of equipment associated in a network or similar configuration.
