LOSS/THEFT/DAMAGE. The University shall not be held liable for any damages to or loss of personal property in rooms, outdoor areas and storage facilities. Students are not permitted to make any alteration or tamper with the installed plumbing, heating, air-conditioning, and ventilation, electrical or other building systems. This also includes the floor, walls, furnishings, ceilings, doors and door locks. Painting or structural repairs are also prohibited. Students are jointly liable for all damage which is caused to the room(s) or any furniture furnishing/fixture therein. Students are liable for the cost of repairing damage to the room(s) and its contents. Removal of furniture, equipment or fixtures is forbidden. Charges for missing or damaged items will be assessed at the replacement cost including necessary labor. There is a $50 replacement fee for a lost key.
LOSS/THEFT/DAMAGE. The undersigned agrees that neither the Owner nor its members, managers, officers, employees or agents are responsible or liable to the undersigned for articles damaged, lost or stolen in or about the fitness facilities. The undersigned agrees not to store any valuable items in lockers and to use the lockers solely for temporary clothing storage. The Owner and its members, managers, employees and agents are not bailees and are not responsible for protecting the valuables of the undersigned.

Students are advised to confirm the availability of insurance coverage for their personal property under their parents’ homeowner’s insurance and, if appropriate, to obtain Renter’s Insurance.
2. No student shall permit: a) the removal from or unauthorized addition to the rooms or any furniture, equipment, or property belonging to the Fraternity/Sorority or University; b) any alterations to or tampering with the installed plumbing, heating, or electrical systems; or c) any alterations to the floor, walls, ceilings, doors, or door locks of the house/rooms, without the permission of the Chapter President/House Manager and the Office of Student Affairs/ Fraternity Sorority Life including painting or making structural repairs or modifications (partitions). Charges for missing or damaged items will be assessed at replacement cost, including any necessary labor. The use of Chapter House common property in private rooms or apartments is strictly forbidden. No structure is allowed that would impede the proper operation of the building’s sprinkler system (including, but not limited to custom built or immov- able lofts).
3. When feasible or appropriate, the University will attempt to identify the student(s) responsible for damage caused to the chapter house and will hold those students financially responsible, however, all students are jointly and severally liable for all damage which is caused to the chapter house as well as their own room(s) and any furniture/ fixtures therein. Students are liable for the cost of repairing structural damage to the rooms in case of fire, smoke, etc. if caused by a violation of this agreement. Misuses of common area furniture, equipment or fixtures is a xxxxx- tion of this Agreement and may result in the imposition of fines or other penalties as provided in this Agreement.
4. Tampering with safety system equipment is a violation of this Agreement and may result in the imposition of fines or other penalties as provided in this Agreement. Such penalties may include payment of costs associated with repair to the damage caused and/or expulsion from the Chapter House.

LOSS/THEFT/DAMAGE. Student is responsible for ensuring that the Personal Helmet is kept safe and secure at all times while it is in Student’s possession or under the Student’s control. Under no circumstances will Student leave the Personal Helmet unattended at any location, unless it is safely secured with School Helmets. While Personal Helmet is stored with School Helmets, School shall take reasonable steps to ensure the safe-keeping of Personal Helmet. If the Personal Helmet is lost or stolen, the Student will immediately report the problem to the School’s head football coach. The Student and Parent acknowledge that they generally must bear the risk for the possibility that the Personal Helmet may be lost, damaged, or stolen during the Current Football Season. If for any reason the Personal Helmet is lost, stolen, damaged, or malfunctioning regardless of whether the Student is at fault, the Student and Parents shall be responsible for the cost of replacing or repairing Personal Helmet, unless Parents and Student can show willful misconduct or gross negligence on the part of WCPSS and the Wake County Board of Education, or the individual members, agents, employees and representatives thereof, including head coach(es), assistant coach(es), and volunteer coach(es). Unless and until a lost, stolen, or damaged Personal Helmet is repaired or replaced with another Personal Helmet which meets the standards outlined above, Student shall use a School Helmet for all practices, scrimmages, and games.
LOSS/THEFT/DAMAGE. In the event of loss, theft or damage to the DGD Vehicles in whole or in part, MTI shall promptly so notify DGD and, at DGD's option, shall:
(a) restore such DGD Vehicles to good condition and working order; or
(b) if any item of DGD Vehicles is beyond repair, pay to DGD, within ten (10) days of such notification, the loss value thereof which shall be an amount equal to the value of the item of DGD Vehicles on the date of loss, and upon such payment this Agreement shall terminate with respect to the item of DGD Vehicles so paid for and MTI shall thereupon become the owner thereof. The obligations of NDI pursuant to this Section 1.7 shall be offset to the extent that any insurance proceeds are received by DGD with respect to the subject DGD Vehicles.

3. Resident will be held financially responsible for the cost of repairing all room and common area damage which, in the University’s sole determination, occurred due to irresponsible behavior, abuse, vandalism or violation of any term of this Housing Agreement. Residents of a specific living area or room will be held responsible for repair costs if the University determines that individual billing is not appropriate or possible. When damage occurs in common areas of the Chapter House, the costs for the repair of damages will be billed to all Residents of the Chapter House if the University determines that individual billing is not appropriate or possible. The University has the sole right to determine whether damages are billed to an individual or all Residents in a specified living area (i.e., room, suite, floor or Chapter House), after consulting with the Chapter.
4. LOSS/THEFT/DAMAGE. The City shall have no responsibility for the loss, theft, mysterious disappearance of, or damage to equipment, tools, materials, supplies, and other personal property of Vendor or its employees, subcontractors, or material-men.
LOSS/THEFT/DAMAGE. Waldens Music is not responsible for loss, theft or damage (with exception to normal wear and tear) to the instrument during the rental period, when instrument is not in possession of Waldens Music. Any such instance of damage, whether it occurred in transportation from home to school (left on school grounds, bus, playground, etc.), at home, church, etc. shall be considered negligence on the lessee part. If an instrument is stolen, Xxxxxx is responsible for providing a police report filed within 48 hours of suspected loss. Customer will be responsible for a replacement fee up to $200 dollars for insured losses. Replacements for loss due to negligence will not be covered and Lessee will be responsible for full replacement cost of instrument up to retail value of instrument. Lessee will not retain any ownership of replacement or damaged instrument. Repairs All repairs must be done exclusively by Waldens Music (unless prior authorization is given). Repairs due to normal wear and tear are covered during the term of the rental. Repairs due to negligence (such as drops, sat on, dents, improper maintenance, etc.) are not covered, and subject to appropriate repair fees at current market rates. LOSS/THEFT/DAMAGE. You should treat your Wildwood Card like cash in a wallet. If you lose your Wildwood Card or if it is stolen you may lose any value which is stored on it in the same way as if you lost your wallet. In the event of loss, theft, fraud or other unauthorised use of your Wildwood Card, or if your Wildwood Card is damaged or malfunctions, we may, at our sole discretion, replace your Wildwood Card and transfer any credit value stored on it to a replacement card. Non-exhaustive circumstances in which we may determine, in our sole discretion, that we will not replace your Wildwood Card include those where we reasonably believe that the notified incident has been caused by your wilful breach of these Terms and Conditions or if there are reasonable grounds for suspecting that you are or have been engaged in fraudulent or other unlawful conduct. Alternatively, we may, at our sole discretion, procure a redemption payment in respect of any outstanding value stored on your Wildwood Card. If we agree to replace your Wildwood Card, a replacement card will be delivered to your home address as registered against the card, usually within 5 days of you first notifying Wildwood Customer Services of the incident. If we decide to redeem any outstanding balance to you the redemption payment amount will be paid to you by cheque, to your home address, but the redemption fee will not be charged. Replacement cards will be posted to your registered home address only. We reserve the right to charge a replacement card fee for each replacement card in the event that you are issued with more than two replacement cards within any 6 month period. If you subsequently find or retrieve a Wildwood Card which you have reported lost or stolen, you must notify Wildwood Customer Services immediately.
