M/WBE Program. Provider acknowledges that it is familiar with the requirements of the Board's “Remedial Program for Minority and Women Owned Business Enterprise Participation in Goods and Services Contracts”, which is incorporated by reference as if fully set forth herein. Provider agrees to adhere to the minimum participation goals and to all other applicable MBE/WBE requirements as set forth in the plan. Provider agrees to submit such documentation in connection with the plan as may be requested by the Board. Provider and its subcontractors shall provide all required compliance data with respect to the Remedial Plan via the Board’s electronic system available at xxxx://xxx.xxxxxxxxxxxxxxxxxxx.xxx.Xxxxxxxx and its subcontractors shall be responsible for responding to any requests for data or information by the noted response due dates, and shall check the electronic system on a regular basis to manage contact information and contract records. Provider shall also be responsible for ensuring that all subcontractors have completed all requested items with complete and accurate information and that their contact information is current.
M/WBE Program. Local Law No. 129 of 2005 added and Local Law 1 of 2013 amended Section 6-129 to the Administrative Code of the City of New York (hereinafter “Section 6-129”). Section 6-129 creates participation by minority and women-owned business enterprises (MBEs and WBEs) in City procurement. The intent is to address the impact of discrimination on the City’s procurement process, and to promote the public interest in avoiding fraud and favoritism in the procurement process, to increase competition for City business and to lower contract costs. As part of the Owner’s M/WBE Program, the Owner endorses these goals and participation by XXXx and WBEs in the provision of the Work. The following goals and provisions are integral to achieve these goals. The Contractor shall comply with all requirements of the Owner’s M/WBE Program applicable to this Contract.
M/WBE Program. Vendor acknowledges that it is familiar with the requirements of the Board's Remedial Program for Minority and Women Owned Business Enterprise Participation in Goods and Services Contracts and agrees to comply with the provisions of such program.
M/WBE Program. The Department may suspend contract payments in accordance with Article 8 No Payment on Contractor’s Non-Compliance of the NEW YORK STATE DEPARTMENT OF TRANSPORTATION STANDARD SPECIFICATIONS of May 1, 2008 As Amended
M/WBE Program. (a) The Lessee has submitted to the Agency an M/WBE Participation Plan which states the Lessee’s proposed plans for participation by minority-owned business enterprises (“MBEs”) and women-owned business enterprises (“WBEs”, together with MBEs collectively referred to as “M/WBEs”) in the Project Work until the Project Completion Deadline, and includes the MWBE Participation Goals, defined as the target percentage of the Project Improvements Investment that will be paid to M/WBEs. The M/WBE Participation Plan is attached hereto as Exhibit O-1.
(b) The Lessee agrees that from the Commencement Date until the Project Completion Deadline, the Lessee and its successors and assigns shall use its good faith efforts to comply with the terms and conditions and reach the goals outlined in the Lessee’s M/WBE Participation Plan set forth in Exhibit O-1 and the M/WBE Program Requirements set forth in Exhibit O-2. The Lessee agrees to be bound by each of the provisions in such M/WBE Participation Plan and the M/WBE Program Requirements, including without limitation, the provision of all Compliance Reports (as defined therein) and the payment of any liquidated damages set forth therein.

The contract provisions contained herein are pursuant to Section 6-129, and the rules of the Department of Small Business Services (“DSBS”) promulgated thereunder. All provisions of Section 6-129 are hereby incorporated in the Contract by reference and all terms used herein that are not defined herein shall have the meanings given such terms in Section 6-129. Article I, Part A, below, sets forth provisions related to the participation goals for construction, standard and professional services contracts.

The Owner endorses these goals and has adopted an M/WBE Program to further participation by XXXx and WBEs in the provision of the Services. All Consultants shall comply with all requirements of the Owner’s M/WBE Program applicable to this Contract.
M/WBE Program. Construction Phase
i. Provide M/WBE and Economic Inclusion Close-Out Report to Owner and PMO for all Design Phase M/WBE activities of the Architect/Engineer.
ii. The Architect/Engineer will consult with Owner and PMO and assist Owner in preparing a list of M/WBE firms by discipline with preliminary availability analysis.
iii. Work with OBD Manager to develop construction phase M/WBE implementation plan for the construction phase to include:
a. Outline contractor’s roles and responsibilities for M/WBE inclusion b. Review Contractor’s schedule for identified M/WBE contractor participation
M/WBE Program. The Architect/Engineer will provide the following:
i. Preliminary analysis of potential contract packaging strategies to promote M/WBE participation in subsequent phases of the project including construction.
ii. Preliminary list of project labor needs and subcontract opportunities by discipline along with estimates to be used by OBD for early outreach activities.
M/WBE Program. To ensure program effectiveness, the Architect/Engineer agrees to:
i. Participate in a M/WBE Inclusion workshop to assist in determination of optimum contracting, subcontracting and procurement strategies to maximize M/WBE objectives for the construction phase and make recommendations at the design development milestone.
ii. Identify and recommend economic inclusion opportunities for construction of the Project.
iii. Participate in inclusion outreach and project orientation meetings.
iv. The Architect/Engineer will obtain current M/WBE and other Economic Inclusion language and forms from Owner for bid documents and include such language as appropriate in the preliminary bid documents
