All present written rules including the Working Rules and all present established practices, and Management and employee rights, privileges and benefits, shall remain in full force and effect unless specifically altered by the provisions of this MOU. 2. The parties hereby agree to be bound by the provisions of the Water and Power Employees’ Retirement, Disability and Death Benefit Plan. 3. Working Rule 5 is inapplicable to employees covered by this MOU.

MAINTENANCE OF EXISTING CONDITIONS. A. The District agrees to maintain the following for the duration of this Agreement: 1. The use of all public utilities in the fire station. 2. Recreational time and exercise periods subject to the approval of the immediate supervisor. 3. The right to work on personal projects and use station facilities after normal working hours, subject to approval of the immediate supervisor. 4. The provision of personal lockers with a serviceable locking mechanism. 5. The provision of kitchen appliances and cooking utensils and the prompt replacement of those items as needed. 6. The initial provision of shield and nametag. 7. The provision of release time at no loss of pay for voting privileges in any state, national, or local election. 8. The provision of potable water where applicable. 9. The District shall provide all employees a copy of the Agreement presently in effect. The District and the Association agree to share equally the cost of printing and reproduction of the Agreement. B. The District shall at all times maintain the stations in a habitable condition. A station is not habitable if it substantially lacks one or more of the following: 1. Effective waterproofing and weather protection of roof and exterior walls and doors. 2. Plumbing facilities that conform to applicable law when installed and which are maintained in good working order. 3. A water supply approved under the law and capable of producing hot and cold running water, furnished with appropriate fixtures and connected to a sewage disposal system approved under applicable law and maintained in good working order to the extent that the system can be controlled by the District. 4. Adequate heating facilities that conform to applicable law when installed and are maintained in good working order. 5. Electrical lighting, outlets, wiring, and electrical equipment that conformed to applicable law when installed and are maintained in good working order. 6. Floors, walls, ceilings, stairways, and railings maintained in good repair. 7. Ventilating, air conditioning, and other facilities and appliances maintained in good repair. 8. Stoves for meal preparation and dishwashers for sanitation purposes. Said appliances shall be maintained in good repair. 9. Washer and dryer for washing station towels, rags, etc. C. MAINTENANCE OF EXISTING CONDITIONS. (A) Without the written consent of the City and except as otherwise specifically provided in this Franchise, Grantee shall not delete, or so limit as to effectively delete, any broad category of Programming identified in Subsection 5.3 carried on Grantee's Cable System as of the Effective Date of this Franchise. (B) In the event of a modification proceeding under federal law, the mix and quality of services provided by the Grantee on the Effective Date of this Franchise shall be deemed the mix and quality of services required under this Franchise throughout its term.

Supervisory employees shall be defined as follows: "Supervisory employee" means any individual, regardless of the job description or title, having authority, in the interest of the employer, to hire, transfer, suspend, lay off, recall, promote, discharge, assign, reward, or discipline other employees, or responsibility to direct them, or to adjust their grievances, or effectively to recommend such action, if, in connection with the foregoing, the exercise of such authority is not of a merely routine or clerical nature, but requires the use of independent judgment. Employees whose duties are substantially similar to those of their subordinates shall not be considered to be supervisory employees. Management shall designate supervisory employees. Said designation or claim shall be reviewed jointly by the City and the Union. Any dispute shall be referred to the Employee Relations Board for resolution.
MAINTENANCE OF EXISTING CONDITIONS. A uniform set of working rules and regulations shall be adopted by all Department Heads and Supervisors, and such written rules and regulations shall be distributed to all employees. It is the intent of the Employer and the employee that any presently existing working conditions are to remain in full force and effect except as specifically modified by this agreement.

B. The Board of Education agrees that its rules and regulations governing teacher conduct shall be reasonable, and that enforcement of teacher discipline shall be lawful and for just causes.
