Method of Measurement and Payment. Payments for excavation shall be made at the unit rate per 28.32m3 (1,OOOcft.) agreed upon for the actual quantity excavated in conformity with the plans or directed by the Superintending Engineer but no payment shall be allowed for the measurement, which is outside of the volume bounded by vertical planes 450mm (18") outside of and parallel to the next lines of the footing. Excavations for structures measured in its original position by the cross section method shall not include water or other liquids, but shall include muds muck and other similar semi-solids. The top and bottom limits of completed volume shall be the original ground surface and the bottom of the completed footing. Individual quantities shall be worked out to the nearest O.O28m (1cft.) and the total of 1 set nearest to the O.28m3 (10cft.) When it is necessary in the opinion of the Superintending Engineer to carry the foundation below the levels shown on the plans, the excavation for the first 915mm (3 feet) of additional depth will be included in the item, "Foundation excavation," for which payment will be made at contract unit prices. Excavation below this additional depth will be paid for as extra work, unless the contractor is willing to accept payment at contract prices.

The difference in levels between the compacted surface and the original ground level shall be taken to computer the quantity of earth for the purposes of payment. The ticket shall also contain the date, time and vehicle license plate number. The Vendor will have to provide copies of these tickets in order to be paid. All work, manpower and equipment associated with this pay item is incidental to the pay item and no additional payment shall be made. Litter Collection and Removal by the Center Lane Mile, for Two (2) Lane Highways: This pay item will be measured by center Lane-Miles for litter collected and delivered to the landfill. Truck load tickets will not be required as the Vendor will be paid based on number of center lane miles completed. This pay item work includes litter collection and removal from the roadway and both shoulder to the limits described. The City of Charleston and utility companies will provide rings, risers, and lids as necessary on the job. The Contractor shall place risers and rings as needed to match utility features with finished grade. No valves or manholes will be permitted to be paved over unless directed by the City Engineer. The Contractor will construct asphalt curbing (minimum 4” high, 6” width) in all locations where curbs currently exist or where directed by the City Engineer. All curbing shall be compacted with the use of a hand tamper, at a minimum. All driveway aprons shall not exceed 1-1/2” in height at the edge of roadway and gradually slope into existing driveway. Costs for all curbing and driveway aprons are considered incidental to the project and no separate pay item will be provided. Curbing shall be placed parallel to the longitudinal direction of the roadway and not in a meandering fashion. Any “ponding” areas within newly paved surfaces shall be removed and replaced in full lane widths as directed by the City Engineer. Milling and resurfacing areas of “ponding” shall be completed at no additional cost to the owner. It is expected that all downtown streets shall be paved at a rate not less than 500 tons per working day. If the Contractor is unable to maintain minimum production, Liquidated Damages will be assessed as detailed in 108.7.2 – INTERIM COMPLETION DATE of the WVDOT Specifications. Liquidated Damages will be assessed at a minimum of $500 per calendar day charge.
