Municipal Engineer. 4.01 The Municipality shall be entitled to retain the services of the Municipal Engineer to review all matters pertaining to the Development of the Planned Area, including services of the Municipal Engineer related to the preparation or approval of Schedules "D" and "E" within Agreement and the schedules thereto and related to the inspection of any Development within the Planned Area (including lot grading and drainage works) to ensure that such Development is in accordance with the Agreement, the Schedules and any plans and specifications. 4.02 The Developer grants to the Municipal Engineer and to the delegates of the Municipal Engineer free and uninterrupted access to the Planned Area, including access for the purpose of completing surveys, the conducting of inspections and all other actions as the Municipal Engineer or the Municipality deems necessary for the purpose of confirming compliance with the terms of the within Agreement and Schedules. If any materials, design or installation does not conform to this Agreement or to the requirements of the Municipal Engineer, the Municipal Engineer may stop any further work and order the removal and replacement of unsatisfactory works. 4.03 It is understood and agreed that the selection of the Municipal Engineer shall be solely and completely in the discretion of the Municipality and all services to be rendered by the Municipal Engineer in regard to the Development of the Planned Area are for the benefit of the Municipality alone and the Municipal Engineer acts on behalf of the Municipality alone, notwithstanding the fact that the Developer shall be responsible for the reasonable fees and expenses of the Municipal Engineer. None of the foregoing provisions shall prevent the Developer from retaining his own engineering consultants at his own expense, nor shall they prevent the Municipality from designating the Developer's Engineer as the Municipal Engineer.

Municipal Engineer. If a municipality decides to use a consultant to perform the duties of the municipal engineer; using MFT funds, the municipality shall use the State QBS according to Section 5-5.06. However, if the original scope of work does not include all the work needed to be performed by the municipal engineer, the municipality shall perform another selection while avoiding any direct, indirect, or appearance of conflict of interests. For example, a municipality hires the consultant as their municipal engineer using MFT funds. Since the municipality has a satisfactory relationship with the consultant and state funds are being used, the municipality is not required to provide public notice, evaluate multiple firms, and select highest rated firm. The scope of work includes providing preliminary and construction engineering for the municipality’s annual MFT maintenance program and street resurfacing program; and to apply for federal funding through the metropolitan planning organization (MPO) and special department programs.  If the municipality decides to replace a bridge and plans to use MFT funds for the engineering, the municipality would need to perform another State QBS to complete this engineering work, since it was not included in the original scope of work of the municipal engineer.  The consultant, who is acting as the municipal engineer, applies for and the municipality receives federal funds for a complete reconstruction of Main Street through the downtown business district. The federal funding includes preliminary engineering, construction, and construction engineering. The estimated engineering cost for the project is $75,000. The municipality would need to perform a federal QBS to complete this engineering work. Since the estimated cost is $25,000 or greater and the engineering contains federal funds, the existing satisfactory relationship process is not allowed.
Municipal Engineer preferably a civil engineer with atleast eight years of relevant experience, s/he should demonstrate specialist experience of working (design, development and implementation) on city-level infrastructure projects, especially urban sanitation, sewerage and solid waste management projects. S/he will also lead the process of adoption of the service level benchmark (SLB) for all ULBs in Kolkata, roll-out of SLB in KMA areas, as well as preparation of ISIPs and PIPs (as mentioned under the MoUD issued guidance on SLBs) on a pilot basis in at least five ULBs.
Municipal Engineer. Third Party Agreements for consultant engineering services (preliminary engineering, final design, construction services, and construction inspection) that are directly related to a construction project may be completed by a qualified Municipal Engineer. The Municipal Engineer must have been selected utilizing an approved qualification based Normal Selection Procedure or a Modified Selection Procedure.
Municipal Engineer. The Municipality advertises its need for work and services of a Municipal Engineer following the criteria listed for Large Projects. Advertisements must also document the qualifications needed for the Municipal Engineer position. The request for SOI’s must contain the following information: • Professional qualifications necessary for satisfactory performance of potentially required services; • Any specialized experience and technical competence in the type of work that may be required; • The firm’s capacity, or availability of technical staff, to accomplish work in required timeframes; • Knowledge of the Municipality; and • Specific experience and/or qualifications related to any other appropriate evaluation criteria.
Municipal Engineer. The Municipality develops a Final Ranking of the firms. The Municipality then designates the most qualified consultant as their Municipal Engineer by an Act of the Mayor, Council, Board of Supervisors, etc.
Municipal Engineer. For the purposes of this Agreement the “Municipal Engineer” is the Municipality’s Director of Public Works and Engineering or such person as he or she may designate from time to time.

  • Municipal Services Commencing on the effective date of annexation, the City will provide the municipal services set forth below. As used in this Agreement, “providing services” includes having services provided by any method or means by which the City may extend municipal services to any other area of the City.

  • Architect Engineer shall provide assistance to Owner through the commissioning consultant/agent for the purpose of advising and counseling Owner’s personnel in the usage, operation and maintenance of the building mechanical, electrical, and plumbing systems.

  • Engineer Resources The Engineer shall furnish and maintain quarters for the performance of all services, in addition to providing adequate and sufficient personnel and equipment to perform the services required under the contract. The Engineer certifies that it presently has adequate qualified personnel in its employment for performance of the services required under this contract, or it will be able to obtain such personnel from sources other than the State.

  • Reverse Engineering The Customer must not reverse assemble or reverse compile or directly or indirectly allow or cause a third party to reverse assemble or reverse compile the whole or any part of the software or any products supplied as a part of the Licensed System.

  • Professional Engineering and Architect’s Services Professional Engineering and Architect’s Services are not permitted to be provided under this Agreement. Texas statutes prohibit the procurement of Professional Engineering and Architect’s Services through a cooperative agreement.

  • Engineering Forest Service completed survey and design for Specified Roads prior to timber sale advertisement, unless otherwise shown in A8 or Purchaser survey and design are specified in A7. On those roads for which Forest Service completes the design during the contract, the design quantities shall be used as the basis for revising estimated costs stated in the Schedule of Items and adjusting Timber Sale Account. (a) A7 to show Purchaser’s performance responsibility. (b) The Schedule of Items to include costs of survey and design, as provided under B5.24, and adjust Timber Sale Account, as provided in B5.
