N o Strike or Lockout. 1. No Employee, during the term of this Agreement, shall engage in any strike, sympathy strike, slowdown, sit-down, sit-in, cessation, stoppage, refusal to perform work, picketing, or any other interference with the work and statutory functions or obligations of the Employer. 2. Neither the Union nor its officers or agents shall in any way authorize, institute, aide, condone, or participate in any strike, sympathy strike, slowdown, sit-down, sit-in, cessation, stoppage, refusal to perform, picketing, or any other interference with the work and statutory functions or obligations of the Employer. 3. In addition to any other liability, remedy, or right provided by applicable law or statute, should a strike, sympathy strike, slowdown, sit-down, sit-in, cessation, stoppage, refusal to perform work, picketing, or other interference as stated above occur, the Union, within twenty-four (24) hours of a request by the Employer, shall: (a) publicly disavow such action by the Employees; (b) advise the Employer in writing that such action by Employees has not been caused or sanctioned by the Union; (c) notify Employees, including its local officers and representatives, of its disapproval of such action and instruct such Employees to cease action and return to work immediately. (d) post notices on Union bulletin boards advising that it disapproves of such action and instructing Employees to return to work immediately. 4. In addition to any other rights and remedies provided by law, the Employer may discharge or otherwise discipline an Employee, subject to the grievance and arbitration procedure of this Agreement, for a violation of the employee’s obligations under this Article. 5. Nothing contained herein shall preclude the Employer from obtaining judicial restraint and damages in the event of a violation of this Article.
N o Strike or Lockout. It is mutually agreed that there shall be no strike, lockout or slowdown, whether sympathetic or otherwise, during the term of this Agreement. It is understood and agreed between the Employer and the Union that the operation of subsections (2) and (3) of Section 50 of the Labour Relations Code is hereby excluded from and shall not be applicable to this Agreement.
N o Strike or Lockout. During the life of this Agreement, there shall be no strike, slowdown, suspension, or stoppage of work in any part of the City’s operations by any nurse, nor shall there be any lockout by the City in any part of the City’s operation.
