Nurse Employment Relations Committee. 10 To promote harmonious relations and aid internal communication, the 11 parties agree to establish a Nurse Employment Relations Committee (“NERC”) 12 within thirty (30) days following the signing of the contract. The County’s 13 NERC members will be the Health Department Director (or designee) and a 14 representative from the County’s Labor Relations Division. The Association 15 shall designate four (4) employee members who will be released from duty to 16 serve on the NERC without loss of pay. If the meeting is held at a time outside 17 the member’s regularly scheduled hours of work, he or she shall be permitted 18 to flex his or her regular schedule within the FLSA workweek to compensate. 19 The member and his or her schedule shall confer in advance of the meeting to 20 determine a mutually agreeable flex schedule to achieve this purpose. In 21 selecting members, the Association will select no more than one (1) employee 22 from a particular organizational unit at a time and take into account such other 23 considerations as are necessary to prevent disruption of operations. The 24 Association may also designate its business representative to serve as a fifth 25 (5th) member, if it desires. Either party may sponsor additional attendees at a 26 particular meeting of the NERC after conferring with the Labor Relations 27 Division representative and ONA Labor Relations Representative; PROVIDED, that the release of additional employee attendees must be approved by the employee’s immediate supervisor. The NERC will establish regular quarterly meetings during normal working hours and will schedule such meetings insofar as practical to avoid disruptions and interruptions of work. The Committee may discuss any matter pertinent to maintaining good employer- employee relations. Each party will attempt to give the other reasonable advance notice, insofar as practical, of the agenda items it wishes to discuss at the next meeting. The parties first meeting shall occur within sixty (60) days following signing of this agreement by both sides.
