All present employees who are covered by this Agreement shall, as provided for in the first provision to Section 8 (a) (3) of the National Labor Relations Act, as amended, become and remain members of CCNA/PASNAP within sixty (60) days of the effective date of this agreement, as a term and condition of employment, subject to the limitations stated in the second provision to Section 8 (a) (3) and governing United States Supreme Court Decision. All other employees, other than graduate nurses, who are hired after the effective date of Agreement shall, as provided for in the first provision to Section 8 (a) (3) of the National Labor Relations Act, as amended, become and remain members of CCNA/PASNAP within ninety (90) days of the employee's date of hire, as a term and condition of employment, subject to the limitations stated in the second provision to Section 8 (a) (3) and governing United States Supreme Court decisions. Graduate nurses who are hired after the effective date of Agreement shall, as provided for in the first provision to Section 8 (a) (3) of the National Labor Relations Act, as amended, one hundred twenty (120) days of the employee's date of hire, as a term and condition of employment, subject to the limitations stated in the second provision to Section 8 (a) (3) and governing United States Supreme Court decisions. Any employee covered by this Agreement shall as a condition of employment, from the onset of employment, tender to CCNA/PASNAP monthly such dues and/or fair share fees as may be periodically assessed by CCNA/PASNAP. Any employee who fails to comply with this requirement shall be discharged from his or her position with CROZER within twenty (20) days after receipt of written notice from the Association.

Association Security and Check Off. Section 1. The County and the Association agree to a "Fair Share" agreement for all employees in the bargaining unit.   • ASSOCIATION SECURITY 5.01 The Hospital will deduct from each nurse covered by this Agreement an amount equal to the regular monthly Association dues designated by the Association. The deduction period for a part-time nurse may be extended where the nurse does not receive any pay in a particular month. Where a nurse has no dues deducted during the payroll period from which dues are normally deducted, that deduction shall be made in the next payroll period provided the nurse has earnings in the next payroll period. If the failure to deduct dues results from an error by the Hospital, then, as soon as the error is called to its attention by the union, the Hospital shall make the deduction in the manner agreed to by the parties. If there is no agreement, the Hospital shall make the deduction in the manner prescribed by the union.

  • Security and Charge 14.1 In consideration of the Contractor agreeing to supply the Materials, the Client charges all of its rights, title and interest (whether joint or several) in any land, realty or other assets capable of being charged, owned by the Client either now or in the future, to secure the performance by the Client of its obligations under these terms and conditions (including, but not limited to, the payment of any money).

  • Use, Security, and Retention Local Agency shall use, hold and maintain State Confidential Information in compliance with any and all applicable laws and regulations in facilities located within the United States, and shall maintain a secure environment that ensures confidentiality of all State Confidential Information wherever located. Local Agency shall provide the State with access, subject to Local Agency’s reasonable security requirements, for purposes of inspecting and monitoring access and use of State Confidential Information and evaluating security control effectiveness. Upon the expiration or termination of this Agreement, Local Agency shall return State Records provided to Local Agency or destroy such State Records and certify to the State that it has done so, as directed by the State. If Local Agency is prevented by law or regulation from returning or destroying State Confidential Information, Local Agency warrants it will guarantee the confidentiality of, and cease to use, such State Confidential Information.

  • Information Security Program (1) DTI shall implement and maintain a comprehensive written information security program applicable to the Personal Information ("Information Security Program") which shall include commercially reasonable measures, including, as appropriate, policies and procedures and technical, physical, and administrative safeguards that are consistent with industry standards, providing for (i) the security and confidentiality of the Personal Information, (ii) protection of the Personal Information against reasonably foreseeable threats or hazards to the security or integrity of the Personal Information, (iii) protection against unauthorized access to or use of or loss or theft of the Personal Information, and (iv) appropriate disposal of the Personal Information. Without limiting the generality of the foregoing, the Information Security Program shall provide for (i) continual assessment and re-assessment of the risks to the security of Personal Information acquired or maintained by DTI and its agents, contractors and subcontractors in connection with the Services, including but not limited to (A) identification of internal and external threats that could result in unauthorized disclosure, alteration or destruction of Personal Information and systems used by DTI and its agents, contractors and subcontractors, (B) assessment of the likelihood and potential damage of such threats, taking into account the sensitivity of such Personal Information, and (C) assessment of the sufficiency of policies, procedures, information systems of DTI and its agents, contractors and subcontractors, and other arrangements in place, to control risks; and (ii) appropriate protection against such risks.
