Pay For Training Purposes. All time related to training, except for travel, shall be paid at straight-time base hourly rates and shall not be subject to any overtime or other premium, penalty or additional pay. Such pay shall be limited to a maximum of eight (8) hours per day. Training related travel time that is outside scheduled hours of work shall be unpaid time.

Pay For Training Purposes. (a) All time related to training, including but not limited to travel time, shall be paid at straight-time base hourly rates, inclusive of applicable paid rest period(s) but exclusive of unpaid meal period(s) or any “deemed” work time, and shall not be subject to any overtime or any other premium, penalty or additional pay. Such pay shall be limited to a maximum of eight (8) straight-time hours per day, unless the Employer agrees otherwise to a longer time span, subject to management’s sole discretion, because the Employee, at the time of undertaking the training, has recently been working shifts of longer than eight (8) straight-time hours per work day. Training-related travel time that is outside scheduled hours of work shall be unpaid time. (b) An Employee who receives any job-related training paid for by the Employer, except for any “on-the-job” training, and who leaves the employ of the Employer for any reason within one (1) year, defined as being a period of three hundred sixty-five (365) consecutive calendar days after and including the date of completion of any such “off-site” training, adding one (1) additional day in the case of a “leap year”, shall be obliged to reimburse the Employer in full for the cost of such training, including, but not limited to, wage(s) and any other related payment(s), paid for by the Employer, for which purpose the Employer shall have the right to deduct the requisite monies from the final pay of the Employee and if this generates insufficient funds to pursue the matter of reimbursement in full through appropriate legal action, which action by management the Union shall not challenge in any manner or in any forum.

  • Funding for Training (a) In furtherance of the objectives of clause 33 hereof, and as a further initiative to enhance the employment and career opportunities of the Employees, the Parties to this Agreement will continue to facilitate on- going training to improve OHS in the industry and to improve Employees’ work skills so as to advance progression to higher industry skill levels. (b) To support the cost of these training initiatives the Employer will make a payment per Employee per week as per the table below. Such monies will be paid into Incolink to support Incolink’s continued training funding initiatives. 1 July 2024 $12.50 1 October 2025 $13.50 1 October 2026 $16.00 1 October 2027 $18.50 Provided that the Incolink arrangements are appropriately ordered so as to provide for: (i) joint employer/Union management of the training funding; (ii) access to funding in accordance with agreed guidelines, by all participating employers and unions. (c) In the event of Incolink being unable to provide the above arrangements, the Parties to this Agreement agree to establish an alternative mechanism with the intention of meeting the commitments expressed in clause 25.11(b) above. (d) The liability of the Employer to pay for the cost of training courses they approve in accordance with clauses 15.8 and 33, will be met by the making of the contributions on behalf of each Employee as required by this clause.

(c) Each certificate representing Warrant Shares shall bear a legend substantially in the following form: "The securities represented by this certificate have not been registered under the Securities Act of 1933, as amended, and may not be offered, sold or otherwise transferred, pledged or hypothecated unless and until such securities are registered under such Act or an opinion of counsel satisfactory to the Company is obtained to the effect that such registration is not required." The foregoing legend shall be removed from the certificates representing any Warrant Shares, at the request of the holder thereof, at such time as they become eligible for resale pursuant to Rule 144(k) under the Act.

  • Considerations on Review In considering the review, the Plan Administrator shall take into account all materials and information the claimant submits relating to the claim, without regard to whether such information was submitted or considered in the initial benefit determination.

  • Education and Training The foundation of this Program is education and voluntary compliance. It is recognized that alcohol and chemical dependency may make voluntary cessation of use difficult, and one of the Program’s principal aims is to make voluntary steps toward ending substance abuse easily available. The outside contractor shall review and develop on-going educational and training information on the adverse consequences of substance abuse and the responsibility to avoid being under the influence of alcohol or chemicals at work. Certain training required by the DOT Regulations shall be the responsibility of the Substance Abuse Program.

  • General Education Requirements Students who intend to transfer to SUNY Buffalo State College with an A.A. or A.S. degree, will be considered as having fulfilled general education/Intellectual Foundations as long as they complete the 30 credits and 7 of 10 areas of SUNY-GER requirements prior to the start of their studies at SUNY Buffalo State College. Students should have successfully completed the SUNY-GER Basic Communication requirement with a grade of “C” or better, the mathematics requirement, and 5 of the remaining 8 categories. The student is responsible for fulfilling the SUNY Buffalo State College Diversity requirement.

  • Eligibility Requirements for Trustees The Trustee hereunder shall at all times be (i) an institution insured by the FDIC, (ii) a Corporation organized and doing business under the laws of the United States of America or of any state, authorized under such laws to exercise corporate trust powers, having a combined capital and surplus of not less than $50,000,000 and subject to supervision or examination by federal or state authority and (iii) acceptable to the Rating Agencies. If such Corporation publishes reports of condition at least annually, pursuant to law or to the requirements of any aforementioned supervising or examining authority, then for the purposes of this Section 8.06, the combined capital and surplus of such Corporation shall be deemed to be its combined capital and surplus as set forth in its most recent report of condition so published. The Delaware Trustee hereunder shall at all times have its principal place of business in the State of Delaware and shall satisfy the applicable requirements under the laws of the State of Delaware authorizing it to act as the Delaware trustee of the Trust. In case at any time the Trustee or the Delaware Trustee shall cease to be eligible in accordance with the provisions of this Section 8.06, such trustee shall resign immediately in the manner and with the effect specified in Section 8.07.

  • Minimum Condition and Warranty Requirements for TIPS Sales All goods quoted or sold through a TIPS Sale shall be new unless clearly stated otherwise in writing. All new goods and services shall include the applicable manufacturers minimum standard warranty unless otherwise agreed to in the Supplemental Agreement.

  • Staff Training 3.3.5.1 The CONTRACTOR shall provide regular and ongoing comprehensive training for CONTRACTOR staff to ensure that they understand the goals of Centennial Care 2.0, including the integration of physical, Long-Term Care and Behavioral Health, the provisions and limitations of the ABP and the requirements of this Agreement. As issues are identified by the CONTRACTOR and/or HSD, the CONTRACTOR shall provide timely and targeted training to staff. 3.3.5.2 The CONTRACTOR shall provide an initial orientation and training as well as ongoing training, including training targeted to different types of staff, to ensure compliance with this Agreement. Including targeted training regarding: 3.3.5.2.1 Care Coordination; 3.3.5.2.2 Nursing Facility Level of Care Determinations; 3.3.5.2.3 Setting of Care Submissions; 3.3.5.2.4 Community Benefit Services and Supplemental Questionnaire; and
