Purposes and Functions. 1. The purposes for which the Facility is established are: (i) To provide legal advice and services to African countries in creditor litigation; (ii) To provide technical legal assistance to African countries to strengthen their legal expertise and negotiating capacity in matters pertaining to: A. debt management and litigation; B. natural resources and extractive industries management and contracting; C. investment agreements; and D. related commercial and business transactions, as the case may be; (iii) To strengthen legal capacity building process in African countries. 2. To serve its purposes, the Facility shall carry out the following functions and activities: (i) identification of legal expertise on creditor litigation; debt management; as well as the case may be in extractive industries and other natural resources management and contracting; investment agreements; (ii) provision of financing to African member states of the Facility to assist them with actual creditor litigation and negotiations of complex commercial transactions where should states shall be willing and able to reimburse the Facility for the latter services; (iii) investing in and organizing the training of legal counsel from African member states of the Facility to equip them with legal expertise necessary to address creditor/vulture fund litigation;; (iv) provision of technical legal assistance, other than actual litigation services, to African member states of the Facility; (v) establishing and maintaining a list of specialized law firms and legal experts to represent African member states of the Facility in creditor litigation and, as the case may be, negotiations of complex commercial transactions; (vi) developing a database and systems for making available and retrieving precedents in creditor litigation cases involving sovereign debtors; (vii) promoting an understanding, among African countries, of issues concerning identification and resolution of creditor litigation involving sovereign debtors against vulture funds, and, as the case may be, negotiations of complex commercial transactions, especially natural resource contracts; and (viii) conducting such other related functions or activities as may advance the purpose of the Facility.

Purposes and Functions. The Commission endeavours to secure the co-operation of governments and other authorities in locating persons missing as a result of armed conflicts, human rights abuses, natural and man-made disasters and other involuntary reasons and to assist them in doing so. The Commission also supports the work of other organisations in their efforts, encourages public involvement in its activities and contributes to the development of appropriate expressions of commemoration and tribute to the missing.

Items adopted by the Board will be identified with the date of approval, effective date, and notation that it was developed by the LDEA- Administration Policy Development Committee. 6. Any policy item(s) recommended by the committee and subsequently accepted by the Board may not be unilaterally changed. a) If changes are requested and redeveloped by either party, the items(s) must be restudied by the committee and further recommended for acceptance by the Board. b) A rejected policy(s) may be resubmitted for further consideration immediately to the Board.
Purposes and Functions. The aim of the Union was laid down in article I of the Berne Treaty mentioned above. The terms of this article have been substantially maintained throughout the successive revisions which have taken place. They are as follows: "The countries between which the present Convention is concluded form, under the title of the Universal Postal Union, a single postal territory for the reciprocal exchange of correspondence." The Stockholm Congress of 1924 added the following sentence: "It is also the aim of the Postal Union to provide for the organisation and improvement of the various inter- national postal services." The Paris Congress in 1947 further added to this sentence the words "and to promote the development of international collaboration in this sphere." The functions of the Union are determined by the Acts drawn up by the Congresses. These Acts comprise: (1) a main Convention laying down (a) the statute of the Union and (b) provisions governing the letter- post, which includes letters, postcards, printed matter, samples, commercial papers, small parcels and phono- post articles (e.g., phonograph records); (2) seven accessory agreements covering insured let- ters and boxes, parcel post, cash-on-delivery articles, money orders, debt collection, transfers to and from postal cheque accounts and subscriptions to newspapers and periodicals. (Special provisions annexed to the main Convention and the parcel post agreement govern the optional transport of these articles by air. Similarly, a supplement to the money order agreement regulates the optional exchange of travellers' orders.) Accession to the main Convention is obliga- tory for all members, but accession to the other agreements is optional. The performance of cer- tain special services referred to in the Conven- tion is therefore limited to arrangements between countries which have agreed to undertake them. The provisions of these Acts of the Union acquire the status of law in each country which ratifies them, and it is therefore the responsi- bility of each party to the Convention or to one of the agreements to ensure the application of the respective provisions. Each of these Acts is accompanied by executive regulations, which have also been adopted by the Congress but signed by representatives in the name of their respective postal administrations and not, as in the case of the Convention and the agreements, in their capacity as plenipotentiaries of their governments.
Purposes and Functions. 1. The Centre aims to cater for the regional needs in promoting lifelong learning and provide opportunities for cooperation in the field of lifelong learning among SEAMEO Member Countries and Associate Member Countries. The Centre will help strengthen the relationship and increase mutual understanding between educational researchers, practitioners, and policy makers of the region, in a spirit of mutual respect and partnership. 2. The Centre is expected: a. to become a SEAMEO Regional Centre of Excellence for research and training on lifelong learning, and to serve as a regional forum for educational policy development on lifelong learning; b. to conduct cross-national comparative research on lifelong learning; to explore definitions, concepts and practices of lifelong learning from Asian research perspectives, particularly Asian contexts as compared to international contexts; addressing specific issues on lifelong learning of the SEAMEO Member Countries; c. to conduct training courses for educational personnel, trainers for teachers, and educational managers in the specialized area for the SEAMEO Member Countries; d. to act as a clearing house, information centre and think-tank for governments of the Member Countries on research-based educational reforms, especially across all sectors of post-compulsory education and training; and e. to become a focal point for strengthening linkage between Southeast Asia, Asia and Europe in promoting lifelong learning. 3. To promote and carry out activities to achieve the aims of SEAMEO as laid down in the Charter. 4. Without prejudice to the principle of non-profit making, the Centre may engage in approved income-generating activities.

  • MIXED FUNCTIONS An employee engaged for more than two hours during one day or shift on duties carrying a higher rate than his or her ordinary classification shall be paid the higher rate for such day or shift. If for two hours or less during one day or shift he or she shall be paid the higher rate for the time so worked.

  • MANAGEMENT FUNCTIONS B.1 The Association recognizes that the management of the Hospital and the direction of working forces are fixed exclusively in the Hospital and shall remain solely with the Hospital except as specifically limited by the provisions of this Agreement and, without restricting the generality of the foregoing, the Association acknowledges that it is the exclusive function of the Hospital to: (a) maintain order, discipline and efficiency; (b) hire, assign, retire, discharge, direct, promote, demote, classify, transfer, lay- off, recall, and suspend or otherwise discipline nurses, provided that a claim of discharge or discipline without just cause may be the subject of a grievance and dealt with as hereinafter provided; (c) determine, in the interest of efficient operation and high standards of service, job rating and classification, the hours of work, work assignments, methods of doing the work, and the working establishment for the service; (d) generally to manage the operation that the Hospital is engaged in and, without restricting the generality of the foregoing, to determine the number of personnel required, methods, procedures, and equipment in connection therewith; (e) make, enforce, and alter from time to time reasonable rules and regulations to be observed by the nurses which are not inconsistent with the provisions of this Agreement. B.2 These rights shall not be exercised in a manner inconsistent with the provisions of this Agreement.

  • Duties and functions 23.2.1 The Independent Engineer shall discharge its duties and functions substantially in accordance with the terms of reference set forth in Schedule 16. 23.2.2 The Independent Engineer shall submit regular periodic reports (at least once every month) to the Authority in respect of its duties and functions set forth in Schedule 16.

  • Review Systems; Personnel It will maintain business process management and/or other systems necessary to ensure that it can perform each Test and, on execution of this Agreement, will load each Test into these systems. The Asset Representations Reviewer will ensure that these systems allow for each Review Receivable and the related Review Materials to be individually tracked and stored as contemplated by this Agreement. The Asset Representations Reviewer will maintain adequate staff that is properly trained to conduct Reviews as required by this Agreement.

  • Commercially Useful Function A prime consultant can credit expenditures to a DBE subconsultant toward DBE goals only if the DBE performs a Commercially Useful Function (CUF). A DBE performs a CUF when it is responsible for execution of the work of a contract and carries out its responsibilities by actually performing, managing, and supervising the work involved. To perform a commercially useful function, the DBE must also be responsible, with respect to materials and supplies on the contract, for negotiating price, determining quality and quantity, ordering the material, and installing (where applicable) and paying for the material itself that it uses on the project. To determine whether a DBE is performing a commercially useful function, the Department will evaluate the amount of work subcontracted, industry practices, whether the amount the firm is to be paid under the contract is commensurate with the work it is actually performing and the DBE credit claimed for its performance of the work, and other relevant factors. A DBE will not be considered to perform a commercially useful function if its role is limited to that of an extra participant in a transaction, contract, or project through which funds are passed in order to obtain the appearance of DBE participation. In determining whether a DBE is such an extra participant, the Department will examine similar transactions, particularly those in which DBEs do not participate. If a DBE does not perform or exercise responsibility for at least 30 percent of the total cost of its contract with its own work force, or if the DBE subcontracts a greater portion of the work of a contract than would be expected on the basis of normal industry practice for the type of work involved, the Department will presume that the DBE is not performing a commercially useful function. When a DBE is presumed not to be performing a commercially useful function as provided above, the DBE may present evidence to rebut this presumption. The Department will determine if the firm is performing a CUF given the type of work involved and normal industry practices. The Department will notify the consultant, in writing, if it determines that the consultant’s DBE subconsultant is not performing a CUF. The consultant will be notified within seven calendar days of the Department’s decision. Decisions on CUF may be appealed to the ADOT State Engineer. The appeal must be in writing and personally delivered or sent by certified mail, return receipt requested, to the State Engineer. The appeal must be received by the State Engineer no later than seven calendar days after the decision of XXXX. XXXX’s decision remains in place unless and until the State Engineer reverses or modifies BECO’s decision. ADOT State Engineer will promptly consider any appeals under this subsection and notify the consultant of ADOT’s State Engineer findings and decisions. Decisions on CUF matters are not administratively appealable to USDOT. The BECO may conduct project site visits on the contract to confirm that DBEs are performing a CUF. The consultant shall cooperate during the site visits and the BECO’s staff will make every effort not to disrupt work on the project.
