RECOGNITION (continued). 2.06 The articles of the collective agreement will apply to both the Outside and Office work units unless specifically indicated otherwise. Specifically, the subheadings “Outside Unit” or “Office Unit” preceding an article, or the reference to “outside employees” or “office employees” within an article, shall denote a provision applying either to the Outside work unit or to the Office work unit, respectively.
RECOGNITION (continued). 2.03 During the effective period of this Agreement, its terms, except for error or omission, shall be applicable to all Members of the Bargaining Unit.
RECOGNITION (continued). 2.06 The members of the Union's Negotiating Committee, Local’s Liaison Committee, Grievance Committee or Local Executive shall not leave their regular duties as an Occasional Teacher without first obtaining the permission of the Occasional Teacher's principal or designate. Permission for such leave shall not be unreasonably withheld. It is understood that the Committee members will not absent themselves from their regular duties unreasonably. The Board shall not be obligated to pay a Committee member in respect of such absences, but shall pay the replacement for any such Committee member where it determines that a replacement is necessary in respect of any such absences.
2.07 Both the Board and the Union have the right to authorize any advisor, agent, counsel or solicitor, or their duly appointed representatives, to assist, advise or represent them in all matters pertaining to this Collective Agreement.
2.08 An Occasional Teacher is entitled, upon request, to have a representative of the Union present when any formal disciplinary actions are undertaken.
2.09 The Local shall appoint one of its members as a delegate to the Instructional Programs/Curriculum Committee of the Board. Such a delegate shall have the right to:
a) receive all material published for general distribution which will be made available to the Instructional Programs/Curriculum Committee;
b) make comment about matters relevant to Elementary Occasional Teachers; and
c) ask questions which might arise from briefs, reports and delegations coming before the Instructional Programs/ Curriculum Committee.
RECOGNITION (continued). Only full-time permanent employees will be represented by this Union that come within the jurisdiction of this Agreement. Part time and seasonal employees are excluded from the bargaining unit. The number of hours that establish Part time employment shall be defined by the City. Seasonal employees are defined as those employees who are hired for limited periods of time not to exceed six months including employees sponsored by the jobs training partnership act (JTPA) and Michigan Youth Corps (MYC) or other federal or state jobs programs. Where Union concurrence is required prior to City participation in JTPA or MYC programs, the Union shall not withhold such concurrence and specifically shall not do so as a result of a dispute with the City over grievances or contract negotiations.
RECOGNITION (continued) a. The damages have not resulted from the negligence, misfeasance, or malfeasance of the Board or its agents.
b. The Association, after consultation with the Board, has the right to decide whether to defend any said action or whether or not to appeal the decision of any court or other tribunal regarding the validity of the article or the defense, which may be assessed against the Board by any court or tribunal.
c. The Association shall notify the Board of the Association's attorney, and the Association's attorney shall consult with the Board's attorney as to all phases of the suit or action.
d. The Association shall have the right to compromise or settle any claim made against the Board under this article.
RECOGNITION (continued). 3.07 a) The Union shall notify the Board as to the members of its Negotiating Committee, Grievance Committee, Labour Managemement Committee, Training Committee and Union Executive, and the Board shall not be required to recognize any person as such a Committee or Executive member until so notified.
RECOGNITION (continued). If the Board requires an Employee to meet with his/her supervisor in order to receive a formal reprimand, suspension, or discharge, the supervisor will inform the Employee that he/she has the right to have an Union representative present.
RECOGNITION (continued). Teachers holding bachelor’s degree only, who end the school year as a permanent (60 day) substitute and who are subsequently hired into any teaching position, will be placed at Step 1.5 on the BA salary schedule unless they work at least 1 ½ semesters in one position, which would then qualify them for Step 2 of the BA salary schedule.
RECOGNITION (continued). It is the mutual understanding and intent of the Board and of the Association that the above language shall be interpreted so as to protect the Board and the District from incurring any costs or expenses whatsoever with regard to any tenure hearing or other related appellate or collateral proceeding in any court, administrative agency or other forum arising out of any attempt by the Board to comply with the provisions of the Agency Shop/Dues Deduction provisions of this Agreement, such as attorneys' fees, witness' fees, court reporter's costs, transcript expenses and costs of any unemployment compensation. In the event of any action against the Board brought in a court or administrative agency because of its compliance with this Article, the Association agrees to defend such action, at the Association's expense and the Association's counsel, provided:
(a) The Board gives timely notice of such action to the Association and permits the Association intervention as a party if it so desires, and
(b) The Board gives full and complete cooperation to the Association and its counsel in securing and giving evidence, obtaining witnesses, and making relevant information available at both trial and appellate levels.
RECOGNITION (continued). Provided the association files such a request with the board within ten (10) workdays after receipt of such notice, the board will meet with representatives of the association. The association may present its views on the proposed policy(s) to the board at this meeting. It is the intent of this clause to provide the association with an opportunity to express its opinions which will not be binding on the board. Such policy shall not be adopted until the regular board meeting following the notification to the association.
