REJECTION CRITERIA. Notwithstanding the above, deviation to the following clauses of Tender document shall lead to summarily rejection of Bid:

(b) Xxxxxxx Money Deposit / Bid Security
(c) Specifications & Scope of Supply
(d) Schedule of Rates / Price Schedule / Price Basis
(e) Duration / Period of Contract/ Completion schedule
(f) Period of Validity of Bid
(g) Price Reduction Schedule
(h) Contract Performance Security
(i) Guarantee / Defect Liability Period
(j) Arbitration / Resolution of Dispute/Jurisdiction of Court
(k) Force Majeure & Applicable Laws
(l) Integrity Pact, if Applicable
(m) Any other condition specifically mentioned in the tender document elsewhere that non-compliance of the clause lead to rejection of bid Note: Further, it is once again reminded not to mention any condition in the Bid which is contradictory to the terms and conditions of Tender document.
REJECTION CRITERIA. In the event of Bidders taking deviation in following criteria their Bids will be treated as irresponsive and shall be summarily rejected.

REJECTION CRITERIA. AOL shall have the option of rejecting a Simultaneous Access if any one or more of the following performance thresholds are met or exceeded (such thresholds collectively the "REJECTION CRITERIA"):
3.2.1 greater than [**]% of user sessions terminate without a user-initiated logoff sequence;
3.2.2 greater than [**]% of user calls fail to connect (data demonstrating compliance with this criterion shall be provided by Vendor on a daily basis, and notwithstanding the foregoing, the Acceptance Test Period shall be extended one business day for each day that AOL does not receive such data commencing with a Simultaneous Access activation or move, as applicable); and
3.2.3 greater than [**]% of user calls which successfully connect to the Simultaneous Access fail to connect to the AOL front end.
REJECTION CRITERIA. Management reserves the right to reject applicants for admission if it is determined that the applicant or any member of the household falls within any one or more of the following categories:
REJECTION CRITERIA. Deviations to critical stipulations of bidding document as mentioned below are not acceptable. Bidder taking deviations to the following bid stipulations may not be considered for price opening
REJECTION CRITERIA. 5.1 Bidder to quote for all items enlisted in the BOQ otherwise bid shall be rejected. Offers received after the due date / time shall be rejected.
5.2 Techno-commercial offer without EMD shall be rejected. However, PSU’s / firms registered with NSIC / MSME vendors registered with State department of Industries & Commerce (DIC) are exempted from submission of EMD.
5.3 Non adherence to technical / commercial terms and incomplete bids and bids in deviation to tender conditions will be liable for rejection
5.4 Bidders failure to enter into Integrity Pact as applicable for the Tender along with the bid duly signed shall be liable for rejection.
5.5 If technical bid & price bid are submit tted together.
5.6 Bids found to have been submitted with falsified / incorrect information
5.7 The bidders who are on Holiday / Negative list of OWNER on due date of submission of bid/ during the process of evaluation of the bids, the offers of such bidders shall not be considered for bid opening / evaluation / Award. If the bidding document were issued inadvertently / downloaded from website, offers submitted by such bidders shall also be not considered for bid opening / evaluation / Award.
5.8 Consortium / Joint bids shall not be accepted.
5.9 Offers not meeting statutory requirement are liable for rejection.
5.10 Bidder to quote for all items enlisted in the SOR(Prefilled), otherwise bid shall be rejected
REJECTION CRITERIA a. The proposal of a Bidder is liable to be disqualified in the following cases or in case Bidder fails to meet the bidding requirements as indicated in this RFP:
i. Proposal not submitted in accordance with the procedure and formats prescribed in this document.
ii. During validity of proposal, or its extended period after last date and time for submission of Bids, if any, the Bidder increases the quoted prices.
iii. The Bidder qualifies the proposal with his own conditions.
iv. Proposal is received in incomplete form.
v. Proposal is received after due date and time.
vi. Proposal is not accompanied by all the requisite documents.
vii. Information submitted in qualification proposal is found to be misrepresented, incorrect or false, accidentally, unwittingly or otherwise, at any time during the processing of the Agreement (no matter at what stage) or during the tenure of Agreement including the extension period if any.
viii. Commercial proposal is enclosed in the same envelope as Qualification Proposal.
ix. Bidder tries to influence the proposal evaluation process by unlawful means at any point of time during the Bid process.
x. In case any Bidder submits multiple proposals or if common interests are found in two or more Bidders, the Bids are likely to be disqualified, unless additional proposals/Bids are withdrawn immediately upon conflict of interest.
xi. Bidder fails to deposit the Performance Guarantee prior to signing of the Agreement or fails to enter into an Agreement within 15 working days of the date of Letter of award of Contract (LOI) or within such extended period, as may be specified by UPLC.
b. Bidders may specifically note that while evaluating the proposals, if it comes to UPLC‟s knowledge expressly or implied, that some Bidders may have colluded in any manner whatsoever or otherwise joined to form an alliance resulting in delaying the processing of proposal then the Bidders so involved are liable to be disqualified for this Contract as well as for a further period of three years from participation in any of the tenders floated by the UPLC.
c. UPLC will reject a proposal for award if it determines that the Bidder recommended for award, or any of its personnel, or its agents or, Vendors and/or their employees, has, directly or indirectly, engaged in corrupt, fraudulent, collusive, coercive, or obstructive practices in competing for the Contract in question;

REJECTION CRITERIA. Any load containing prohibited materials or contamination in excess of the proportions given in the tables, shall be subject to rejection by Veolia and not processed. The procedure for determining whether a load is to be rejected is described below and outlined in the load evaluation procedure flow charts following this text in paragraph 2.9. A load shall not be rejected where prohibited materials can be removed, or the level of contamination can be brought within the maximum allowable indicated in the tables, including the total contamination level, by minimal and safe (assuming normal personal protective equipment e.g. gloves, steel soled boots etc.) hand sorting or picking. Minimal hand sorting shall be undertaken by Veolia and shall not normally take one person more than five minutes.
REJECTION CRITERIA. Bidder's Bid shall be considered non-responsive and rejected, if deviations are taken to the under mentioned provisions of Bid Document by the Bidder:-
