RIGHTS OF COMMITTEE. The Committee is a public body established under, and with the powers provided by, the statutes of the Commonwealth of Massachusetts. As the elected representative of the citizens of Groton and Dunstable charged with the responsibility for the quality of education and the efficient and economical operation of the Groton- Dunstable Regional School System it is acknowledged that the Committee has the final responsibility for establishing education policies of the Groton-Dunstable Regional School District. Nothing in this Agreement shall be deemed to derogate or impair the powers and responsibilities of the Committee under the statutes of the Commonwealth or the rules and regulations of any agencies of the Commonwealth. Except as expressly modified herein, said rights and powers include, but in no way are construed as limited to, the subjects mentioned in the table of contents of this Agreement. As to every matter not covered by this Agreement and except as directly modified by a specific provision of this Agreement, the Committee retains exclusively to itself all rights and powers that it has or may hereafter be granted by law and may exercise the same at its discretion without such exercise being made the subject of grievance, arbitration proceeding, or unfair labor practice charge.
RIGHTS OF COMMITTEE. Apprentice Glaziers shall not be permitted to work for any person or firm other than their first Individual Employer, except by permission of the Joint Apprenticeship Training Committee. The Joint Apprenticeship Training Committee may rotate Apprentice Glaziers into different shops if necessary to receive well-rounded training.

As elected representatives of the citizens of this District charged with the responsibility for the quality of education in, and the efficient and economical operation of the Greater Xxxxxx Technical High School, it is acknowledged that the Committee has a final responsibility of establishing the educational policies of the Greater Xxxxxx Technical High School. Nothing in this agreement shall be deemed to derogate or impair the powers, rights or duties conferred upon the Committee by the Statutes of the Commonwealth or the Rules and Regulations of any pertinent agency of the Commonwealth. It is recognized that the Superintendent-Director has and will continue to retain, whether exercised or not, the sole and unquestioned right, responsibility and prerogative to direct the operation of the Greater Xxxxxx Regional Vocational Technical School District in all aspects. These rights, responsibilities and prerogatives are not subject to delegation in whole or in part, except that the same shall not be exercised in a manner inconsistent with or in violation of any of the specific terms and provisions of these general regulations.

As the elected representatives of the citizens of Westford the Committee is charged with final responsibility for the quality of education in, and the efficient and economical operation of, the Westford Public Schools. It is acknowledged that the Committee has the final responsibility of establishing the education policies of the Public Schools of Westford insofar as the law allows. Nothing in this Agreement shall be deemed to derogate or impair the powers and responsibilities of the Committee under the statutes of the Commonwealth or the rules and regulations of any agencies of the Commonwealth. Except as expressly modified herein, said rights and powers include, but in no way are construed as limited to, the subjects mentioned in the table of contents of this Agreement.
RIGHTS OF COMMITTEE. The Committee is a public body established under and with the powers provided by the Statutes of the Commonwealth of Massachusetts. It is acknowledged that as the chosen representatives of the citizens of the sixteen towns which constitute the Minuteman Regional Vocational Technical School District, the Committee has the responsibility for setting standards for the efficient and economical operation of the school system. The Committee has the final responsibility for establishing the educational policies of the District’s school. Nothing in this Agreement shall be deemed to derogate or impair the powers, rights, or duties conferred upon the Committee by the Statutes of the Commonwealth or the rules and regulations of any pertinent agency of the Commonwealth. Said rights and powers shall also include, but in no way be construed as limited to, the subjects mentioned in the table of contents of this Agreement and the right to establish standards of performance. As to every matter expressly not covered by the Agreement, and except as expressly or directly modified by clear language in a specific provision of this Agreement, the Committee retains exclusively to itself all rights and powers that it has or may hereafter be granted by law, and shall exercise the same without such exercise being made the subject of grievance or arbitration. However, the Association may request that Committee or administration action on any change in working conditions not covered in this contract be delayed for up to forty five calendar days from the date that the change is announced to the staff so that the Association may enter into negotiation with School Committee representatives in an attempt to define a mutually satisfactory implementation action. The Committee may grant such a delay or proceed with emergency implementation. In the case of emergency implementation judged necessary by the Committee, negotiation designed to explore the possibility of mutually satisfactory action will still be scheduled within the forty five calendar day period. If agreement is not defined within the forty five calendar day period, the final judgment of the Committee will be or remain implemented.
RIGHTS OF COMMITTEE. The exercise by the committee, superintendent and principals of any of the following rights shall not alter any of the specific provisions of this Agreement. The parties agree that the operation of the Southern Berkshire Regional School District, the supervision of the employees and of their work are the rights of the committee, its superintendent and principals alone. Accordingly, subject to the provisions of this agreement, the making of reasonable rules to ensure orderly and effective work; to determine the quantity and types of equipment to be used; to introduce new methods and facilities; the making of work schedules; the determination of what and where duties will be performed and of employee competency; the hiring, transfer, promotion, demotion, lay-off and recall of employees: discipline or discharge of employees for just cause, provided that such just cause standard shall apply to only those employees with professional status, as defined by the Massachusetts Education Reform Act of 1993, are rights of the committee in determining policy, the rights of the principals with the approval of the superintendent in all operational matters, including the discipline of staff. The foregoing enumeration of the Committee's rights shall not be deemed to exclude other rights not specifically set forth, the committee therefore retaining all rights not otherwise specifically restricted by this Agreement.

As the legislative body charged with the responsibility for the quality of education in, and the efficient and economical operation of, the Montachusett Regional School District, it is acknowledged that the Committee has the final responsibility of establishing the educational policies of the Montachusett Regional Vocational Technical School. As it relates to the enforcement of this agreement, any references herein to “District”, “
RIGHTS OF COMMITTEE. The Committee may summon, question, and examine any party to this Agreement, or their representatives or agents, in connection with any question or matter over which the Joint Industry Committee may act. The Joint Industry Committee may also have the books and accounts of any party covered by or signatory to this Agreement examined by an independent certified public account as to payroll records, payments made to Employees by this Agreement, and payment of fringe benefits.
RIGHTS OF COMMITTEE. Under the laws of Massachusetts, the Committee, elected by the citizens of Millis has final responsibility for establishing the educational, financial and business policies of the public schools of Millis. The Committee is a public body established under and with powers provided by the statutes of the Commonwealth of Massachusetts and nothing in this contract shall be deemed to derogate from or impair any power, right or duty conferred upon the Committee by statute or any rule or regulation of any agency of the Commonwealth. As to every matter not specifically mentioned or provided for in this contract, the Committee retains all the powers, rights and duties that it has by law and may exercise the same at its discretion without any such exercise being considered in any way to be in violation of the terms of this contract.
