RIGHTS OF THE COMMITTEE. ‌ In recognition of the fact that the laws of the Commonwealth of Massachusetts vest responsibility to the people of the Xxxx Xxxxxxx Regional School Committee for the general charge of school houses, and the efficient and economical operation of the Xxxx Xxxxxxx Regional School District, it is herein agreed that except as specifically and directly modified by express language in a specific provision of this Agreement, the Committee retains all rights and powers that it has or may hereafter be granted by law in managing the School Department and directing the work force and may exercise the same at its discretion without any such exercise being made the subject of a grievance except as expressly provided herein. Said rights and powers include but are in no way to be construed as limited to: the establishment of equal rules and regulations; the right to determine the extent to which work will be performed by members of the bargaining unit; the right to hire, fire, suspend, or in any other manner discipline for just cause; to classify, promote, demote, transfer permanently or temporarily; to determine hours for and the number of Employees required at any location; to determine the qualifications and competence of; to assign an added, lessened or different work or responsibility to; to set standards and requirements applicable to and make determination of the steps and eligibility for any in-step wage increases for; to make any pay deduction because of absence, or failure to perform work by any Employee covered by this Agreement; and to introduce new or to change existing operational methods. The above rights are reserved exclusively and solely as prerogatives of the Committee subject only to such limitations that are expressly provided for in this Agreement.

RIGHTS OF THE COMMITTEE. In recognition of the fact that the laws of the Commonwealth of Massachusetts vest responsibility to the people of the Town of Winthrop in the Committee and the superintendent for quality of education in, and the efficient and economical operation of the Winthrop School System, it is herein agreed that except as modified, amended, or abridged by express language in a provision of this Agreement, the Committee and the superintendent retain all rights and powers that they have or may hereafter be granted by law and may exercise the same at its discretion without any such exercise being made the subject of a grievance. Said rights and powers include but are in no way to be construed as limited to the rights and powers to hire; fire; suspend; or in any other manner discipline; promote; demote; transfer (permanently or temporarily); evaluate the performance of; prescribe hours for and working conditions of; prescribe textbooks and other teaching aids, the curriculum, and methods of teaching used by; assign any added, lessened, or different work responsibility to; set standards and requirements applicable to and make determinations of eligibility for any in-step wage increases for; grant teacher with professional status to; promulgate rules and regulations pertaining to; regulate and restrict the use of school property (real or personal) by; implement improved benefits at any time for all or some of the; make any pay deductions because of the absence of, or failure to perform work by; and prescribe any professional improvement program or policies for: teachers in the School System, and to assign teaching or any other work to whatever personnel—either in or out of the unit—that the Committee and/or the superintendent at their discretion choose. The Association will be given a copy of any policies and reports approved at School Committee meetings. The Association will further be provided a copy of the School Committee packet by the end of the next school day following the delivery of the packet to the Committee members.
RIGHTS OF THE COMMITTEE. SECTION 1 The Committee is a public body established under and with the powers provided by the Statutes of the Commonwealth of Massachusetts. As elected representatives of the citizens of Needham charged with the responsibility for the quality of education in, and the efficient and economical operation of, the Needham Public Schools, it is acknowledged that the Committee has a final responsibility of establishing the educational policies of the public schools in Needham. Nothing in this Agreement shall be deemed to derogate or impair the powers, rights, or duties conferred upon the Committee by the Statutes of the Commonwealth of the Rules and Regulations of any pertinent agency of the Commonwealth. Said rights and powers include, but in no way are construed as limited to, the subjects mentioned in the table of contents of this Agreement. As to every matter expressly not covered by this Agreement, and except as expressly or directly modified by clear language in a specific provision of this Agreement, the Committee retains exclusively to itself all rights and powers that it has or may hereafter be granted by law, and shall exercise the same without such exercise being made the subject of grievance or arbitration.
RIGHTS OF THE COMMITTEE. The Committee is a public body established under and with the power provided by the statutes of the Commonwealth of Massachusetts. As the elected representative of the citizens of Fitchburg charged with the responsibility of education in, and the efficient and economical operation of the Fitchburg School System, it is acknowledged that the Committee has the final responsibility of establishing the education policies of the Public Schools of Fitchburg. Nothing in this Agreement shall be deemed to derogate or impair the powers and responsibilities of the Committee under the statutes of the Commonwealth. Except as expressly modified herein, said rights and powers include, but in no way are construed as limited to, the subjects mentioned in the table of contents of this Agreement. As to every matter not expressly covered by this Agreement, and except as modified by a specific provision of this Agreement, the Committee retains exclusively to itself all rights and powers and responsibilities that it has or may hereafter be granted by law, and may exercise the same at its discretion without such exercise being made the subject of a grievance-arbitration proceeding.
RIGHTS OF THE COMMITTEE. There is reserved exclusively to the Committee all responsibilities, powers, rights and authority expressly or inherently vested in it by the laws and constitutions of Rhode Island and of the United States, and by the Charter of the City of Cranston, excepting where expressly and in specific terms limited by the provisions of this Agreement. It is agreed that the Committee retains the right to establish and enforce reasonable rules and personnel policies relating to the duties and responsibilities of teachers and their working conditions which are not inconsistent with this Agreement. In all matters under this Agreement calling for the exercise of judgment or discretion on the part of the Committee the decision of the Committee shall be final and binding if made in good faith, except where otherwise provided in this Agreement.
RIGHTS OF THE COMMITTEE. 21.1 Except to the extent that there is contained in this Agreement an express and specific provision to the contrary, all the authority, power, rights, jurisdiction, responsibilities and duties that have been or may hereafter be granted by the law to the Committee are retained by and reserved exclusively to the Committee. No such authority, power, rights, jurisdiction, responsibilities or duties shall be deemed waived or modified unless the waiver of modification is in writing and signed by the Committee with respect to such reserved rights and responsibilities, other than as there are specific provisions and directions to the contrary contained elsewhere in this Agreement, shall be subject to grievance and arbitration; nor action reserved to the final decision and/or sole discretion of the School Committee and/or superintendent as elsewhere contained in this Agreement, be subject to the grievance and arbitration provisions of this Agreement.
RIGHTS OF THE COMMITTEE. To the extent permitted by law, the Company shall indemnify the Committee (including any officers and employees of the Company appointed to act on behalf of the Committee) and hold such individuals harmless from and against any damages, losses, costs, and expenses incurred (including, without limitation, expenses of investigation and the fees and expenses of counsel) in the course of administering this Agreement. The Company shall bear all expenses of the Committee incurred in the course of administering this Agreement.

RIGHTS OF THE COMMITTEE. 2.1 It is recognized that, in addition to other functions and responsibilities, the Superintendent has, and will retain, the sole right and responsibility to direct the operations of the employees and in this connection to determine the type of work to be performed, the hours of work, and to select, hire, and demote employees, including the right to make and apply rules and regulations of discipline and efficiency. 2.2 The Superintendent will also have the right and responsibility to discharge or otherwise discipline an employee for just cause, to promote and transfer, and to lay off because of lack of work or other cause unless otherwise hereinafter provided.
RIGHTS OF THE COMMITTEE. Except as specifically provided otherwise in this Agreement, the Employer shall not be deemed to be limited in any way by this Agreement in the performance of the regular and customary functions of management as provided for under applicable statutes and reserves and retains all powers, authority, and prerogatives including without limitation, the exclusive right to issue policies, rules and regulations governing the conduct of the Xxxxxxx Public Schools provided that such rules and regulations are not inconsistent with the expressed provisions of the Agreement. The exercise of rights pursuant to this Article shall not be subject to the arbitration provisions of this Agreement.
