Seniority and Other Definitions. Seniority means the rights secured by a pharmacist by length of continuous employment service as provided herein. Seniority shall apply exclusively to economic layoffs, recalls and store closings, unless otherwise herein provided. Seniority starts from the last date when the pharmacist is hired by the Employer, except that new pharmacists shall not acquire any seniority rights until they have completed a probationary period of ninety (90) days for full-time pharmacists or four hundred and eighty (480) hours for part-time pharmacists, after which their seniority shall date back to the date of last hiring.

An employee's seniority shall be broken if he: (1) quits; (2) retires; (3) is discharged for just cause; (4) fails to report after a layoff within seven (7) calendar days after the Employer sends, to the last known address, a written notification to return to work; or (5) has been out of employment by the Employer for a period of twelve (12) months. When two (2) or more employees are hired on the same day, the Employer shall determine their relative seniority. The Employer agrees to submit to the Union, on a monthly basis, a Formatted: Right Union Proposal 4/12/2016 list of all newly hired employees. The Employer agrees to submit to the Union a seniority list each six (6) months during the term of the union contract. It is agreed that pharmacy students and pharmacy interns may rotate in and out of the bargaining unit without interruption of their seniority status, provided they are enrolled in an accredited pharmacy program to become a registered pharmacist. However, the employee must return to work for the Employer within a one-year period in order for bridging of seniority to apply.
