Seniority Forfeited. If seniority is forfeited, an employee’s previous seniority is forfeited and no seniority is earned during the specified time.

A. voluntarily terminates his employment B. is discharged for just cause C. laid off in excess of thirty-six (36) months or if time on layoff exceeds the employee’s seniority, whichever is greater
Seniority Forfeited. An employee's seniority shall be forfeited and he/she shall rank as a new employee and such employee shall not be subjected to the probationary period as specified in Article 3.02
Seniority Forfeited a) An employee’s Seniority shall be forfeited as a result of any of the following: i) the employee voluntarily resigns; ii) the employee retires; iii) the employee transfers to a position outside the Bargaining Unit; iv) the employee is discharged without reinstatement through the grievance procedure; v) the employee transfers from one classification to another classification within the Bargaining Unit, in which case the employee shall re-start the accrual of Seniority as of the date of transfer; vi) the employee transfers from Part Time status to Full Time status, or vice versa, in which case the employee shall re-start the accrual of Seniority as of the date of transfer; or, vii) the Union determines that a member is not in good standing. viii) the employee is absent from work due to accident or illness for twenty-four (24) months or becomes permanently disabled. However, it will be the employee’s responsibility to provide the Employer with bi-annual updates as to their condition, supported by medical evidence. b) Where an employee is on leave for the purpose of holding a Union position, Seniority shall continue to accumulate. c) Where an employee accepts on a temporary basis, in the Fare Box Classification (for less than 30 days), there will be no loss of seniority in the original classification the employee’s returns to. This applies only to sickness, vacation, LOA’s and termination.
