Retention of Seniority. (a) Any employee, other than a probationary employee, whose employment ceases through no fault of his own, shall retain seniority and shall be recalled on the following basis:
(i) An employee with less than one year's continuous service shall retain these rights for six (6) months from the date of lay-off.
(ii) An employee with one or more year's continuous service shall retain these rights for twelve (12) months from the date of lay-off, plus two (2) additional months for each year's service up to an additional twenty-four (24) months.
(b) Failure of the employee to report for work within one (1) week of notice by registered mail at their last address reported to and received by the mill shall result in his termination of employment with the Company. Bona fide reasons for failure to report shall not deprive an employee of his recall rights.
Retention of Seniority.
(a) Laid off regular employees shall retain their seniority and perquisites accumulated up to the time of layoff for a period of one year and shall be rehired, if the employee possesses the capability of performing the duties of the vacant job, on the basis of last off - first on. Laid off employees failing to report for work of an ongoing nature within seven days of the date of receipt of notification by registered mail shall be considered to have abandoned their right to re-employment. Employees required to give two weeks’ notice to another employer shall be deemed to be in compliance with the seven day provision. In the exercise of rights under this section, employees shall be permitted to exercise their rights in accordance with Article 13.3 (Bumping) of this agreement.
(b) Laid off employees shall be rehired to Community Health Worker positions as set out in (a) above, subject to the provisions of Article 15 (Hours of Work and Scheduling-Community Health Workers).
(c) During a laid off employee's recall period, she/he shall be entitled to register for casual work for the duration of the recall period. Registration shall be in accordance with Article 29 (Casual Employees). Should the employee work in a lower rated position, then the employee shall be paid at the lower rate of pay.
Retention of Seniority. A regular employee who resigns a position and within 90 days is re-employed as a regular employee shall be granted a leave of absence without pay covering those days absent and shall retain all provisions and rights in relation to seniority and other fringe benefits, provided the employee has not withdrawn any superannuation contributions.
Retention of Seniority. For the purpose of fringe benefits only, such as vacation, holidays, retirement, etc., an employee's seniority shall continue if transferred from one (1) County department or facility to another. For promotions or job retention, seniority in the Sheriff's Department shall apply.
Retention of Seniority. (a) An employee who is assigned to a position outside the bargaining unit shall have the right to return to the bargaining unit in accordance with clause 42.04, Staffing of Vacant Positions. In this case, the employee upon return shall be deemed to have continued to accumulate seniority during his or her absence from the bargaining unit.
Retention of Seniority. Personnel released under this policy and who are recalled within the recall period shall retain all seniority accrued in the District at the time of release and shall retain all rights under the law accruing to their experience.
Retention of Seniority. An employee shall retain but not accrue seniority during an absence due to an assignment to a position in NAV CANADA outside the bargaining unit.
Retention of Seniority. An employee in the bargaining unit who is laid off because of lack of work or funds and who is recalled within four years shall regain the seniority he/she had and shall be credited with the accumulated sick leave to which he/she was entitled at the time he/she was laid off. An employee who is not recalled within four years shall be considered terminated.
Retention of Seniority. It is agreed between the parties hereto that seniority shall be retained and accumulated on the following basis:
1. Employees who are laid off after less than one (l) year's service shall retain their seniority for a period of six (6) months.
2. Employees who are laid off after one (l) year of service shall retain their seniority for a period of time equal to their length of service to a maximum of three (3) years.
3. Absence due to bona-fide sickness, provided such sickness is attested to by a qualified medical practitioner.
4. Authorized leave of absence. 5. Absence while serving in the Armed Forces, during a national emergency and for a period of ninety (90) days after honourable discharge.
Retention of Seniority. Seniority shall continue to accumulate during absence from work due to sick leave, the first eighteen months of total layoff, holidays, vacations, and leaves of absence granted under Article 19.
