Servicing and Maintenance. The Lessee shall at the Lessee's expense both as to materials and labour place and keep the Vehicle in good order and repair so that at all times the Vehicle is in first class working condition compared to a Vehicle of the same description and age and without limiting the foregoing the Lessee shall: (a) use keep and service and permit the use, keeping and servicing of the Vehicle in accordance with the manufacturer's instructions by only competent, properly trained and qualified (and where necessary licensed) personnel and only by recognised and approved methods and standards; (b) change all oils and fluids in accordance with the manufacturer's recommendations; (c) ensure that all oils and fluids are kept a proper level recommended by the manufacturer; and (d) not permit any interchange of parts, tyres or accessories with any other vehicle. (e) if requested by BMW at any time during the Term of this Lease effect and keep effected at the Lessee's expense any agreement for the maintenance of the Vehicle with a qualified and competent person and upon terms acceptable to BMW.
Servicing and Maintenance. (1) The Contractor must ensure that the Gallery, and all minor fixtures, fittings (servicing of administration equipment: fax, computers, printers etc) are maintained in good repair and condition, fair wear and tear excepted. (2) The Town shall be responsible for maintaining the building comprising the Gallery, including, pest control, safety and fire equipment, air conditioning, landscaping and its maintenance and water (associated with landscaping) costs of the Gallery. The Town will attempt to rectify any major maintenance or structural defect or problem in relation to the building comprising the Gallery within a reasonable amount of time, having consulted with Council. (3) All requests for major maintenance and repairs must be recorded and reported to the Town representative within 48 hours. Authorisation of the repairs of a capital nature is submitted to the Building Maintenance unit for his / her initial actioning. Building Maintenance will determine any maintenance or structural damage caused by the negligence of the Contractor. (4) The Maintenance Schedules will be reviewed annually in February in each year of the Contract Term. (5) On 31 January in each year of the Contract Term, the Contractor must submit to the Town the proposed Maintenance Schedules (which will include any proposal for upgrades, repairs or major maintenance or the like for the Building) for the next financial year for the Gallery for the Town’s approval. The proposed Maintenance Schedules must be fully itemised and be in a form generally acceptable to the Town. (6) The Town (and where applicable its Council) will review the proposed Maintenance Schedules, and advise the Contractor in writing if the proposed Maintenance Schedules are approved. (7) The Town covenants and agrees to act reasonably, and not to unreasonably fail to approve or withhold approval to the proposed Maintenance Schedules. (8) If the Town does not approve the proposed Maintenance Schedules it will, within 14 days of advising the Contractor of its decision not to approve the proposed Maintenance Schedules (or part thereof), provide to the Contractor written reasons for the decision not to approve the proposed Maintenance Schedules, and will provide the Contractor with a reasonable opportunity to submit further proposed Maintenance Schedules. Servicing and Maintenance. (a) We will ensure all servicing, warranty repairs and replacements are carried out, as and when recommended by the manufacturer, at service stations approved by us. You must make the Vehicle available for such servicing, warranty repairs or replacements. (b) If any servicing, warranty repairs and replacements are required (in our reasonable opinion) as a result of misuse or negligence which has taken place during the Hire Period or if you have failed to make the Vehicle available for such servicing, warranty repairs or replacements when reasonably requested to do so which causes damage or detriment to the Vehicle then, you will be responsible for the cost of such works. (i) We will tell you the cost of the works as soon as practically possible after they are completed. (ii) You must pay such cost plus our Damage Administration Charge by direct debit on the next available direct debit draw-down date that occurs within 14 days of our notifying you of the cost. If the Vehicle is covered by Collision Damage Waiver then, in these circumstances, your liability for the damage or detriment may not be limited to the Excess amount.
Servicing and Maintenance. 1.8.1 A call-out service is also required for unexpected faults and repairs to all equipment not covered by warranty. 1.8.2 Equipment already installed and out of warranty requiring servicing and maintenance could have been supplied and installed by a number of different suppliers. 1.8.3 Sites will e-mail the contractor with a request for a call-out. Details of the equipment to be repaired and the fault, if known, will be provided. The contractor must respond within 48 hours of receipt of the email to confirm when the visit will be made. An official purchase order will then be raised. Repairs must be made within seven days of receipt of the official purchase order. 1.8.4 Spare parts used in the repair of the equipment will be guaranteed for a minimum of six months from fitting. Any part failing within this period shall be replaced free of charge. Servicing and Maintenance. 13.1 It is the Hirer’s responsibility to keep the Vehicle regularly serviced. If the Hire Period is more than twenty-eight (28) days, the Client must take the Vehicle to the Hirer’s nominated service agency at no less than 5,000 kilometre intervals at a time and on the date and at the location notified to the Client or on another day and time as the Hirer shall mutually agree. If the Client fails to attend a service appointment any charges the Hirer incurs will be passed onto the Client. 13.2 The Hirer will pay for the service, parts, tyres and any other issues with the Vehicle providing that these issues were not caused by the Client or any Authorised Driver. 13.3 To ensure the Vehicle is properly maintained, at intervals of no less than fourteen (14) days, the Client must photograph the Vehicle’s odometer and email the photo to xxxx@x-xxxx.xxx.au or text it to 0404 441 630.
Servicing and Maintenance. 8.1 The Hirer shall: 8.1.1 notify the Owner immediately of any breakdown or unsatisfactory working of the Equipment; 8.1.2 under no circumstances repair the Equipment, unless authorised by the Owner; and 8.1.3 upon becoming aware of a problem with the Equipment, at the request of the Owner return the Equipment to the Owner's premises for examination, maintenance and/or servicing. 8.2 In the event that the Equipment is required to be serviced or maintained during the Rental Period, the Owner shall provide at least 5 Business Days written notice to the Hirer of the need for service or maintenance and the date upon which the Owner shall collect the Equipment. 8.3 Upon receipt of the notice in accordance with clause 8.2, the Hirer shall make the Equipment available to the Owner for collection on the date specified in the notice. 8.4 Upon completion of such service or maintenance, the Owner shall notify the Hirer that the servicing or maintenance has been completed and shall arrange for delivery of the Equipment to the Hirer at the Hirer's cost. 8.5 For the avoidance of doubt, no Rental Payments shall be due for the period from when the Equipment has been returned to the Owner for servicing or maintenance until the Equipment has been returned to the Hirer in accordance with clause 8.4.
