Staff Interpreters. (1) St. Xxxxxxxxx shall continue utilizing willing bilingual staff as Staff Interpreters. Only staff whose language skills are determined to be sufficient to interpret effectively to and from the relevant foreign language and English may serve as Staff interpreters. St. Xxxxxxxxx shall assess the foreign language abilities of interested staff and shall maintain the assessment tool(s) used and the test results of staff determined to be qualified to serve as Staff Interpreters. (2) Before serving as Staff Interpreters, staff must complete training in medical interpretation that is offered by an instructor qualified in the training of medical interpreters; provides training and instruction in the role of the interpreter, the mechanics of interpreting effectively, interpreter ethics, medical and anatomical terminology, relevant cultural issues, and (for non-medical staff only) how medical providers gather information; involves some practice exercises (for example, role playing); and provides post-training competency evaluation. Such training may be provided through a “train-the-trainer” model, or other means that promote efficiency without compromising the quality of instruction. (3) On a monthly basis, each Staff Interpreter shall inform the Language Assistance Coordinator of the language assistance services he or she has provided. (4) St. Xxxxxxxxx shall maintain a list including the name, extension, Clinical Department, and foreign language abilities of all Staff Interpreters.

Staff Interpreters. The Hospital may, but has no obligation to, satisfy its obligations under this Settlement Agreement by hiring qualified staff and/or contract interpreters. Staff interpreters and contract interpreters must meet the definition of Qualified Interpreters. Patients and Companions who are provided with staff/contract interpreters must have the same level of coverage (for both duration and frequency) as the Hospital is otherwise obligated to provide under this Settlement Agreement. The Hospital may assign other duties to staff interpreters, but the staff interpreters' performance of those other duties shall not interfere with interpreter coverage responsibilities under this Settlement Agreement.

Patients and Companions who are provided with staff interpreters must have the same level of coverage (for both duration and frequency) as Silver Hill Hospital is otherwise obligated to provide under this Agreement. Silver Hill Hospital may assign other duties to staff interpreters. To the extent that a Hospital does not have staff interpreters or a staff interpreter is not available when needed, Silver Hill Hospital will follow the procedures set forth above to obtain the services of qualified interpreters. As soon as practicable but no later than ninety (90) days after the effective date of this Agreement, the Hospital will provide the following: a. TTY's in public areas. The Hospital will make a TTY device available wherever a telephone is made available to the public (whether public pay telephone, public closed circuit telephone, or otherwise). To satisfy this provision, the Hospital can permanently install the required TTY's or make available a sufficient number of portable TTY's. Standards §§ 4.1, 4.31.9. Each such TTY, whether permanently installed or portable, shall comply with the Standards set forth in Schedule A, attached. b. TTY's required in specific locations. The Hospital will provide a TTY at each public telephone location in or adjacent to an emergency department, recovery room, or waiting room. Standards §§ 4.1, 4.31.9. To satisfy this provision, the Hospital can permanently install the required TTY's or make available a sufficient number of portable TTY's. Each such TTY, whether permanently installed or portable, shall comply with the Standards set forth in Schedule A. c. Shelves and outlets. Wherever portable TTY's are made available as an alternative to installed TTY's (at emergency departments, recovery rooms, and waiting rooms, and where there are banks of four or more public telephones), and wherever there is a bank of three or more public telephones, the Hospital will provide shelves and electrical outlets that comply with the Standards set forth in Schedule A. d. Signs indicating the location of TTY's.
Staff Interpreters. (a) Brooklyn Hospital shall employ a number of staff members collectively fluent in all Brooklyn Hospital Primary Languages who, as part of their regular duties, shall provide face-to-face interpretation services for LEP patients (“Staff Interpreters”). Such interpretation duties shall take precedence over the Staff Interpreters’ other duties during the hours of operation of the Clinical Departments in which they work. Each Clinical Department shall have a minimum of two (2) Staff Interpreters, at least one (1) of whom is fluent in Spanish. If any Staff Interpreters needed to satisfy the obligations set forth in Article IV resign or are terminated, Brooklyn Hospital shall not be deemed in violation of this Agreement so long as it is engaged in prompt and good faith efforts to replace such person(s). (b) Brooklyn Hospital may adjust the number of Staff Interpreters available in each clinical department depending upon the level of demand for language assistance services. (c) Any staff member whom Brooklyn Hospital designates as a Staff Interpreter must, within thirty days of their hire date or designation as a Staff Interpreter and prior to being allowed to serve in that capacity, undergo an assessment evaluation of his or her foreign language abilities as described in paragraph 5.1 of Article V below. (d) All staff members who have passed the required language assessment must, within ninety (90) days of their designation as Staff Interpreters, receive the training described in paragraph 5.1 of Article V below. (e) Each Clinical Department head or manager shall ensure that at least one (1) Staff Interpreter is assigned during all hours that the Clinical Department serves patients. The names, extensions, and availability of the Staff Interpreters shall be disseminated to all Clinical Department staff, maintained at a central location near the reception area or front desk of the Clinical Department, and updated as needed. Each Staff Interpreter shall, when assigned to provide interpretation, wear a button or badge stating in conspicuous print, “I Speak [Primary Language(s)],” written in the applicable Brooklyn Hospital Primary Language(s). (f) In the event the Hospital is unable to meet the requirements in subsection (e) above during the 11 pm to 7 am shift (“night shift”), the hospital shall designate one of the nursing supervisors on duty to be the night-shift language assistance coordinator.
