Staffing Generally. 3.3.1.1 The CONTRACTOR must notify HSD within ten (10) Business Days of any change in Key Personnel. Hiring or replacement of Key Personnel must conform to all requirements of this Agreement. If HSD determines that a satisfactory working relationship cannot be established between certain Key Personnel and HSD, it will notify the CONTRACTOR in writing. Upon receipt of HSD’s notice, HSD and the CONTRACTOR will attempt to resolve HSD’s concerns on a mutually agreeable basis.
3.3.1.2 The CONTRACTOR may not have an employment, consulting or other agreement with a person who has been convicted of a crime specified in Sections 1128 or 1128A of the Social Security Act for the provisions of items and services that are significant and material to the CONTRACTOR’s obligations under this Agreement.

All key staff positions must reside and work in the state of New Mexico, unless prior written approval has been obtained from HCA.

Staffing Generally. The DBE shall staff the Facilities during the Term of this Contract with qualified personnel who meet the licensing and certification requirements of the State in accordance with the Contract Standards. The DBE shall discipline or replace, as appropriate, any employee of the DBE or any Subcontractor engaging in unlawful, unruly or objectionable conduct. The DBE shall notify WRD of any material change in staffing levels and positions from time to time, and shall not make any such material change if the new staffing level would adversely affect the ability of the DBE to provide the Transitional Operation and Training Services.
Staffing Generally. The Contractor shall staff the Habitat Project Work during the Term in accordance with the Contract Standards with qualified personnel who meet the licensing and certification requirements of the State. The Contractor shall discipline or replace, as appropriate, any employee of the Contractor or any Subcontractor engaging in unlawful, unruly or objectionable conduct. The Contractor shall replace any Contractor or Subcontractor employee at the request of the KRRC, after notice and a reasonable opportunity for corrective action, in the event the KRRC determines, acting reasonably, that such employee does not have the requisite skills for the tasks assigned or has engaged is unlawful, unruly or objectionable conduct.
Staffing Generally. (a) Staff at the Facilities will be suitably experienced and/trained, and of suitable disposition and possess suitable qualifications to enable them to perform their duties in a satisfactory manner;
(b) Whenever staff are not in attendance, pursuant to the terms of this Agreement, the Operator will provide the County Council and the School with contact arrangements to cover routine and emergency contact requirements
(c) The Operator shall disclose to the County Council the names and addresses and as appropriate all convictions of which it is aware of its staff employed at the Facilities (provided such disclosure does not breach any relevant legislation). The County Council may require such staff to be removed from employment at the Facilities if they are unsuitable to work with children.
(d) This clause applies to all individuals engaged by the Operator or its sub-contractors to attend the Facilities regularly to perform the Services ("Relevant Staff"). The Operator shall ensure that, in respect of each individual intended to become a member of the Relevant Staff, before the individual begins to attend the School regularly to perform the Services the results are received of a check of the most extensive available kind made with the Criminal Records Bureau and a copy of the results of such check are notified to the County Council. The County Council reserves the right to refuse any staff being employed at the School whose admission would in the opinion of the County Council be unsuitable.
Staffing Generally. Contractor shall ensure staffing levels comply with the licensing rules of the facility, OAR 411- 054-0070 and are sufficient to meet the scheduled and unscheduled needs of Individuals as follows:
(1) Contractor shall hire qualified staff and assure coverage to meet the needs of each Individual.
(2) All staff hired or who work with Individuals are experienced, qualified, well-trained persons who have completed, submitted and passed a criminal history check.
(3) Copies of completed criminal history checks are made available to the state or AAA Case Manager or DHS Contract Administrator upon request.
(4) Job descriptions are kept and are available to DHS Contract Administrator upon request.
(5) Supervisory and emergency staff are identified and available to direct care staff on a 24- hour basis.
(6) Emergency backup and on-call information for the RN, Behavior Coordinator (either the Program Director or Facility Administrator as defined in RCF rule) are posted and available to direct care staff on all shifts to minimize avoidable emergency placements and to provide crisis management.
