STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS. 1. The employee shall be placed on sick or other available accrued leave pending determination of eligibility for §207-c benefits. In the event that the employee is denied §207-c eligibility and the employee appeals this denial, and after appealing the denial, the denial of benefits is reversed, the Town will reimburse the officer in time, for

In the event that it is determined that the employee is found not to be entitled to §207-c benefits, he/she will be permitted to use sick leave, vacation, personal leave, compensatory time or other leave time available provided he/she remains medically unable to perform the duties of his/her position.
STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS. (a) In the event an employee asserts an inability to perform some or all of his or her duties due to an injury suffered in the performance of such duties, he or she shall be placed on sick leave until such time as it is determined whether he or she is eligible for the benefits of Section 207- c.
(b) In the case of any employee who has no sick leave time accrued to his/her credit, DOF will advance sick leave for the purposes of this Section 3, until such time as a determination pursuant to Section 4, below, is made. In the event that the employee is denied 207-c eligibility and either the employee does not appeal this denial, or after appealing the denial, the denial of benefits is upheld, the employee will reimburse DOF in time or money for the sick leave time advanced.
(c) In the event that an employee is found to be eligible for Section 207-c benefits, DOF will restore all sick leave used by the employee while the determination was pending.
STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS. A. The Fire Fighter shall be placed on paid department leave, pending determination of his/her eligibility for §207-a leave.
B. If the Fire Fighter is determined to be eligible for §207-a benefits, the time charged to department leave will be converted to §207-a leave. If the Fire Fighter is determined not to be eligible for §207-a benefits, the time charged to department leave will be converted to sick leave. If the employee has no accrued sick leave, the employee will reimburse the City in time (vacation) or money, at the option of the employee, for the sick leave owed.

Where the Town believes it appropriate, the Officer shall be placed on sick leave pending determination of his/her eligibility for section 207-c benefits. In the event that it is determined that the Officer is entitled to section 207-c benefits, the Town shall credit back to him/her all sick leave credits which were expended prior to the determination.
STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS. The Firefighter shall be placed on sick leave pending determination of his eligibility for Section 207-a benefits.
STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS. In the event that a Member gives notice as provided in Paragraph 2 asserting an inability to perform duties, they shall be placed on sick leave. Upon a determination by the Administrator that a Member who has been unable to work is eligible for the benefits afforded by GML 207-c, all sick leave that may have been utilized shall be restored in full. A Member receiving payment of the full amount of regular salary or wages pursuant to GML 207-c shall not suffer any reduction of accrued leave while in receipt of that payment, except as may be set forth in this Agreement. A Member seeking the benefits afforded by GML 207-c who, in the judgment of the Administrator, has a temporary injury or sickness, may be examined by a physician selected by the Administrator to verify the existence of an injury or sickness.

In the event that it is determined that the Officer is entitled to section 207-c benefits, the Town shall credit back to him/her all sick leave credits which were expended prior to the determination. In the event that it is determined that the Officer is not entitled to section 207-c benefits, his/her application will be deemed a request to utilize sick leave and the Officer will be permitted to use available credits provided he/she was and is eligible for such leave.

(b) In the case of any employee who has no sick leave time accrued to his/her credit, the County will advance sick leave for the purposes of this Section 3, until such time as a determination pursuant to Section 4, below is made. In the event that the employee is denied 207-c eligibility and either the employee does not appeal this denial or after appealing the denial, the denial of benefits is upheld, the employee will reimburse the County in time or money for the sick leave time advanced.
(c) In the event that an employee is found to be eligible for 207-c benefits, the employee will have all used sick leave credits restored.
