STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS. 1. The employee shall be placed on sick or other available accrued leave pending determination of eligibility for §207-c benefits. In the event that the employee is denied §207-c eligibility and the employee appeals this denial, and after appealing the denial, the denial of benefits is reversed, the Town will reimburse the officer in time, for the sick or other leave utilized. Should the Town fail to make a determination within fifteen (15) business days, the employee shall be placed on interim §207-c leave until such time that the Town makes a determination. In the event that after hearing the employee is found ineligible for §207-c leave, the employee will reimburse the Town for any interim §207-c leave advanced under this section.
STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS a. The Firefighter shall be placed on sick leave pending determination of his eligibility for Section 207-a benefits.
STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS. In the event that a Member gives notice as provided in Paragraph 2 asserting an inability to perform duties, they shall be placed on sick leave. Upon a determination by the Administrator that a Member who has been unable to work is eligible for the benefits afforded by GML 207-c, all sick leave that may have been utilized shall be restored in full. A Member receiving payment of the full amount of regular salary or wages pursuant to GML 207-c shall not suffer any reduction of accrued leave while in receipt of that payment, except as may be set forth in this Agreement. A Member seeking the benefits afforded by GML 207-c who, in the judgment of the Administrator, has a temporary injury or sickness, may be examined by a physician selected by the Administrator to verify the existence of an injury or sickness.
STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS. A. A member who is injured in the line-of-duty and who makes a good-faith application for GML § 207-a benefits shall be placed on presumptive GML § 207-a leave, pending the City’s determination of his/her eligibility for GML § 207-a benefits. Where a member is already receiving GML § 207-a benefits following a City determination (or arbitrator’s award), if the City decides to remove him from GML § 207-a, and if in response the procedures under part “f” herein are invoked, the member shall remain on presumptive GML § 207-a until an arbitrator has rendered his award, the grievance is withdrawn, or the parties otherwise agree.

(a) In the event an employee asserts an inability to perform some or all of his or her duties due to an injury suffered in the performance of such duties, he or she shall be placed on sick leave until such time as it is determined whether he or she is eligible for the benefits of Section 207- c.

The determination shall be made within the time provided in Section 4 of this procedure. If the police officer has no available sick leave he may use vacation or compensatory time to remain on the payroll. In the event that a timely determination is not made, the police officer shall be continued in pay status until a determination is made. Time spent on the payroll beyond the initial date for making a determination shall not be charged to the employee if it is determined that he is ineligible for the 207-c benefit.
STATUS PENDING DETERMINATION OF ELIGIBILITY FOR BENEFITS. A. The Fire Fighter shall be placed on paid department leave, pending determination of his/her eligibility for §207-a leave.

In the event that it is determined that the Officer is entitled to section 207-c benefits, the Town shall credit back to him/her all sick leave credits which were expended prior to the determination. In the event that it is determined that the Officer is not entitled to section 207-c benefits, his/her application will be deemed a request to utilize sick leave and the Officer will be permitted to use available credits provided he/she was and is eligible for such leave.
